OCTOBER 8, 1974 The meeting was called to order by Chairman Harvey Pierce at 7:40 P. M. The Pledge of Allegiance to the Flag of the United States was followed by the roll call. PRESENT: James Bowman Edward Coburn Jacques Fleischer Eva Longbrake Pat Masters Harvey Pierce Robert Regan Mr. William Godwin, Public Works Director, Mr. Gilbert Russe, Building Official, and Lt. Cochran and Mr. Tarrant of the Metropolitan Dade County Fire Department were also present. The first item to come before the Board was approval of the Minutes of the Meeting of September 10, 1974. MOTION: By Mr. Fleischer, seconded by Mr. Coburn, to approve the Minutes of the Meeting of September 10, 1974. Mrs. Masters suggested that approval of the Minutes be deferred until after the Public Hearings and discussion with Lt. Cochran and Mr. Tarrant. Mr. Fleischer withdrew his motion to approve and Mr. Coburn withdrew his second to the motion. MOTION: By Mrs. Masters, seconded by Mr. Bowman, to defer approval of the Minutes of the Meeting of September 10, 1974 until after the Public Hearings and discussion with Lt. Cochran. VOTE IN FAVOR OF MOTION: Yes - (7) MOTION CARRIED. PUBLIC HEARING #72• J S_ _ rley Homes, Inc. Request: Variance to permit construction of single family residence on existing lot which is only 40 feet in width (75 feet required) and variance to permit construction of single family residence on lot approximately 4,800 Sq. Ft. (10,000 Sq. Ft. required) . Legal Description: . Lot 12, Block 1, SEAVIEW PARK, PB 17/80. Location: 5751 S. W. 84 Street. Robert M. Brake, Attorney for the applicant, requested that both hearings be heard at the same time. Mr. Ben Hendricks, Jr. , Attorney representing Mrs. Margaret Shaw who owns property adjacent to the properties at Lot 12, Block 1 and Lot 16, Block 2, SEAVIEW PARK, requested that the hearings be heard separately. Mr. Brake presented the request of the applicant to the Board and offered into evidence four photographs of houses which have been built on 40 foot lots (two of which are located in Coral Gables) ; Affidavit of John G. De War and Ruth A. De War, his wife, stating that they are the owners of Lot 12, Block 1 and Lot 16, Block 2 of SEAVIEW PARK, PB 14/34, that said lots were obtained by Warranty Deed dated September 15, 1962 from Agnes T. Beatty a.s Grantor, and John G. De War and Ruth A. De War, his wife, Grantees, that the said Grantor, Agnes T. Beatty, now deceased, was the mother of Ruth A. De War, and said property was deeded by Agnes T. Beatty to John G. De War and Ruth A. De War as part of the distribution of the Estate of Agnes T. Beatty and at no time did either Agnes T. Beatty or John G. De War and Ruth A. De War ever own any of the lots which are immediately adjacent to the two lots in question; Warranty Deed between Agnes T. Beatty and John G. De War and Ruth A. De War dated September 15, 1962 ; and Warranty Deed No. E16551 of Clifford Country Estates, Inc. These documents were accepted by the Chairman and made a permanent part of the file. Mr. Hendricks spoke in opposition to granting the request of the applicant stating that a 40 foot lot is too narrow to provide for the necessity of an aesthetically appealing residence. He stated that granting of these variances would create a hardship to his client, Mrs. Shaw, who owns the adjacent properties. Mr. Hendricks questioned the validity of the original application inasmuch as Shirley Homes, Inc. is not the owner. Chairman Pierce stated that Power of Attorney had been given by Mr. and Mrs. De War to Shirley Homes, Inc. and Robert M. Brake to act in their behalf in this application. Chairman Pierce asked if there was anyone present who wished to speak in favor of or against granting the request of the applicant and there was not. Chairman Pierce declared the public hearing closed. Page 2 - 9/24/74 jk A discussion was hac y the Board wherein it wa .elt by the members that { this constitutes a. self-imposed hardship on the part of the applicant and that the variances requested should not be granted. The question was raised as to whether or not the property was contracted for with the knowledge that the lots do not conform. It was further felt that houses on 40 foot lots consisting of 4, 800 Sq. Ft. would be detrimental to the health and welfare of the City because of problems with parking and septic tank placement. MOTION: By Mr. Fleischer, seconded by Mr. Bowman, to recommend denial of the request of the applicant. VOTE IN FAVOR OF MOTION: Yes - (7) MOTION CARRIED. PUBLIC HEARING #72-21 Shirley Homes, Inc. Request: Variance to permit construction of single family residence on existing lot which is only 40 feet in width (75 feet required) and variance to permit construction of single family residence on lot approximately 4,800 Sq. Ft. (10, 000 Sq. Ft. required) . Legal Description: Lot 16, Block 2, SEAVIEW PARK, PB 17/80. Location: 5780 S. W. 84 Street. Robert M. Brake, Attorney for the applicant, presented the request to the Board and requested that the documents presented in the previous hearing also be entered into the file in this hearing. Mr. Ben Hendricks, Jr. , Attorney representing Mrs. Margaret Shaw who owns property adjacent to the properties at Lot 12, Block 1 and Lot 16, Block 2, SEAVIEW PARK, spoke in opposition to the request of the applicant for the same reasons as stated in the previous hearing. Chairman Pierce asked if there was anyone present who wished to speak in favor of or against granting the request of the applicant and there was not. Chairman Pierce declared the public hearing closed. A discussion was had by the Board wherein it was felt by the members that if a hardship exists in this ca.se it is self-imposed and that the variances requested should not be granted. It was the opinion of the Board that while the owner of a property is entitled to the highest and best use of his property, its use must be in accordance with the laws designed to protect the interest of the majority. A recommendation was made to the. City Council that the provisions of Section 8-5 of the Zoning Ordinance No. 20-71-724 are clear and provide for the universally recognized idea that 50 ' is the minimum acceptable width for the construction Page 3 - 9/24/74 jk of a single family residence. MOTION: By Mr. Fleischer, seconded by Mr. Bowman, to recommend denial of the request of the applicant and to suggest to the City Council that to grant this request would be in violation of Section 8-5 of the zoning Ordinance No. 20-71-724 of the City of South Miami. LOTION: By Mrs. Masters, seconded by Mrs. Longbrake, to amend the Motion by adding the words, " and would not contribute to the health and welfare of the City of South Miami". VOTE IN FAVOR OF AMENDMENT: Yes - (3) No - (4) Bowman, Coburn, Fleischer, Pierce MOTION DEFEATED. VOTE IN FAVOR OF ORIGINAL MOTION: Yes - (7) MOTION CARRIED. Chairman Pierce called a. recess to the meeting at 8:25 P. M. The Meeting was called back to order at 8: 55 P. M. PUBLIC HEARING #74-15 T. R. Crockett Request: Change of zoning from RS-4 (Single Family) to C-3 (Arterial Commercial) . Legal Description: Lots 18, 19; 20, 21 and 22, Block 8, TOWNSITE OF LARKINS, PB 2/105 . Location: 5825 S. W. 68 Street. Mr. Joseph Gassen of 101 East Flagler Street, Miami, Fla. , Attorney for the applicant, presented the request to the Board. He stated that he had previously appeared before the Board representing Mr. LaPlant, who owns property in this same block, on July 31, 1973. At that time, Mr. James Duncan, Planning Consultant for the City of South Miami, stated that he had reviewed the history of the zoning and uses of the properties (of which this parcel is a part) and stated that he preferred either C-1 or C-3 zoning. He stated that Mr. LaPlant eventually was granted C-3 zoning for his property. Legal Description: Lots 13, 14, 15, 16 and 17, Block 8, TOWNSITE OF LARKINS, PB 2/105 . Location: 5825 S. W. 68 Street. Mr. Joseph Ga.ssen of 101 East Flagler Street, Miami, Florida, Attorney for the applicant, presented the request to the Board. He restated the arguments presented in the previous hearing. Chairman Pierce read into the record a. card received from Mr. Walter A . Mobley of Mobley Enterprises stating that, as a property owner within the .500 foot vicinity of the lots in question, he fully concurred with the requested zoning change and stated that he felt the change would be an asset to the area . Chairman Pierce asked if there was anyone present who wished to speak either for or against the request of the applicant and there was not. Chairman Pierce declared the public hearing closed. A discussion was had by the Board wherein it was their opinion that this zoning should be increased either to C-2 or C-3 due to the zoning of the immediate surrounding properties and they felt that a. recommendation should be requested of the City Planning Consultant. MOTION: By Mr. Bowman, seconded by Mr. Fleischer, to recommend granting the request of the applicant. MOTION: By Mr. Fleischer, seconded by Mrs. Masters, to amend the Motion to approve to C-2 or C-3 zoning, depending upon the recommendation of the City Planning Consultant. VOTE IN FAVOR .OF MOTION: Yes - (7) MOTION CARRIED. PUBLIC HEARING #74-17 Anselmo L. Alliegro Request: Variance to permit an 8, 237 Sq. Ft. lot size (10, 000 Sq. Ft. required) for single family residence. Legal Description: Lot 140 Block 1, SOLIMAR SUBDIVISION, PB 94/50. Location: 4899 Ludlan Road. Mr. Alliegro was not present and, .a.fter a. discussion of the Board, it was decided to defer this hearing. MOTION: By Mrs. Masters, seconded by Mr. Bowman, to defer this hearing to the next regular meeting, in view of applicant 's failure to appear. VOTE IN FAVOR OF MOTION: Yes - (7) MOTION CARRIED. EXECUTIVE SESSION: After discussion of the Board it was decided to postpone the Executive Session of the meeting until after the "Remarks" due to the fact that a discussion was scheduled at that time with Lt. Cochran and Mr. Greenwald of the Metropolitan Dade County Fire Department and they had been present and waiting for some time. REMARKS A discussion was had with Lt. Cochran and Mr. Tarrant (Mr. Tarrant in place of Mr. Greenwald who could not attend) regarding the fire code, fire prevention and fire protection in the City of South Miami. Various questions were raised by the Board members concerning the adequacy of the water supply in the City, inspection of high rise buildings and the require- ment of redevelopers to bring water systems up-to-date. Page 6 - 9/24/74 jk EXECUTIVE SESSION: MOTION: By Mrs. Masters, seconded by Mr. Bowman, to approve the Minutes of the Meeting of September 10, 1974 as read. VOTE IN FAVOR OF MOTION: Yes - (7) MOTION CARRIED. A discussion was had by the Board concerning the number of fire hydrants in the City and it was the general consensus of the Board that the number of fire hydrants within the City limits needs to be increased. The Board members were also in agreement that a. general survey of the City' s water supply and availability should be made. A discussion was had concerning overgrown lots within the City and in particular the lot at 80th Street and 67th Avenue and also overgrown lots along the south side of Sunset Drive. The question was raised as to whether our Ordinance governing overgrown and unkept lots was adequate and that it should be reviewed and revised, if necessary. A discussion was had about Planning Board procedure in hearing applications and improving communications with the City Council. A discussion was had about Melaleuca trees being replaced, not just removed. There being no further business to come before the Board, the meeting was, upon Motion duly made and seconded, adjourned at 10:45 P. M. This is at the corner of South West 68th Street and 58th Place and is -vacant land. At the Planning Board meeting on September 24, 1974, Mr. Ralph Coker, Jr. and Mr. T. R. Crockett, my two immediate neighbors, requested a change of zoning from RS-4 (single family) to C-3 (arterial commercial) ; the Planning Board approved both requests and is recommending C-3 zoning to the City Council on both pieces of property. In 1973, Mr. LaPlante, whose property is at the other end of the block from me, next to Mr. Crockett, had his property reinstated to the C-3 zoning that the entire block had been when we bought it in 1966. Mr. James .Duncan, the attorney for the Council, suggested at that time that this whole strip on 68th Street be re-_ instated back to C-3 but it was not done. My property on the corner is next to a plumbing company and across the . street from warehouses, a junk yard and an air conditioning company. I would like to -do something with the property that would both provide me with some income and the City with some tax revenue.
