A Resolution relating to a Tentative Plat application to allow a replat of the
Marshall Williamson property identified as folio numbers 09-4025-000-0850,
09-4025-065-0090, and 09-4025-000-0852 which is generally located south of
SW 64th Terrace and approximately between SW 60th Avenue and SW 61 st
Court/aka SW 61 st Drive Court and as legally described herein.
WHEREAS, the City of South Miami, owner of the three parcels identified as folio
numbers 09-4025-000-0850, 09-4025-065-0090, and 09-4025-000-0852, which are generally
located south of SW 64 th Terrace and between SW 60th Avenue and SW 6pt Court/aka SW 6pt
Drive Court, submitted Application No. PB-21-020 requesting approval of a tentative plat; and
WHEREAS, the proposed tentative plat will combine the three parcels into one parcel and
remove a restriction that prohibits one of the parcels from being used as a building site; and
WHEREAS, the lot created by the proposed plat complies with the requirements of
Section 20-4.2(B) of the Land Development Code; and
WHEREAS, at a public hearing on December 14,2021, the Planning Board voted five (5)
to two (2) to recommend approval of the proposed tentative plat; and
WHEREAS, the City Commission desires to approve the tentative plat.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1: The recitals set forth in this resolution are true and they are supported by
competent substantial evidence and they are incorporated into this resolution by reference as if set
forth in full herein.
Section 2: The subject application, No. PB-21-020, submitted by the City of South Miami
requesting approval of a proposed tentative plat for the property legally described in Section 3
below, pursuant to the Land Subdivision Regulations outlined in Land Development Code Section
20-4.2 is hereby approved.

The parcel along SW 6pt Drive Court was created during a platting process in 1975 and conveyed
subject to a restriction that it not be used as a building site. The former owner, the South Miami
Community Redevelopment Agency (SMCRA), had begun the process of removing this restriction
through a replatting and planned to record a Unity of Title to join the properties. The work was
not completed before the SMCRA was disbanded. As the new owner, the City wishes to finalize
the project. There are no plans at this time to develop the property. Approval of any future plans
to develop the site, whether by the City or a new owner, will follow the appropriate procedures.
Approval of a tentative plat (''T-plat'') is the first step in the replatting process. The proposed T-
plat combines all three parcels into one property as shown below:
BACKGROUND:
Section 20-4.2 of the Land Development (LDC) regulates the platting of property. It provides the
requirements for the lots created, information to be included in the application package, and
conditions of approval that the Commission shall impose. An ordinance amending the Code is
currently pending second reading and adoption by the City Commission. A final decision by the
Commission is expected on December 21, 2021. Consequently, this application is analyzed based
on the proposed ordinance; if the ordinance is not approved, then the plat application cannot be
considered until it complies with the code requirements.
ANALYSIS:
Section 20-4.2{B)(2) of the LDC provides the seven specific guidelines the City Commission shall
use in evaluating a T-plat application. Each guideline is described below along with Staff's analysis
of how the application satisfies them.

1. Section 20-4.2(B)(2)(a)(i): The building site created by the proposed tentative plat should be
equal to or larger than the median of the existing building sites in the Surrounding
area ... surrounding area is defined as all lots within the same zoning district and within five
hundred (500) feet from the exterior boundaries of the subject property.
Staff Response: Not applicable as there are no other properties with the RT-9 zoning
designation within 500 feet.
2. Section 20-4.2(B)(2)(b): The building sites created will not result in existing structures becoming
nonconforming as they relate to setbacks, lot area, lot width and depth, ground coverage, and
other applicable regulations.
Staff Response: Not applicable as there are no existing structures on the site.
3. Section 20-4.2(B)(2)(c): The building site created will be free of encroachments from
abutting building sites.
Staff Response: Complies; there will be no encroachments on the site created.
4. Section 20-4.2(B)(2)(d): The building site created is free of any declarations of
restrictive covenants, unit of title, easements, or the like, which would prevent the
separation of the site.
Staff Response: Complies
5. Section 20-4.2(B)(2)(e): The scale of any proposed new construction shall be
compatible with the as-built character of the surrounding area, and shall not create
adverse impacts on the surrounding area.
Staff Response: Not applicable as new construction is not proposed at this time.
Staff notes, however, that scale and compatibility of any future construction must still be
reviewed and approved by the Environmental Review and Preservation Board prior to a
building permit being issued.
6. Section 20-4.2(B)(2)(f): The building site(s), lot(s) or parcel(s) created comply with the
regulations of the LDC.
Staff Response: Complies. The RT-9 district requires a minimum size of 10,000
square feet and a lOa-foot frontage. Once joined, the property will consist of 41,556
square feet. Two frontages, on SW 64th Terrace and SW 6pt Court, will exceed the 100-
foot minimum.
7. Section 20-4.2(B)(2)(g): The building site(s) created cannot constitute an irregular parcel (one
that has more than four (4) corners) unless the City Commission determines by a 4/5th vote that

the irregularity arises from irregularity in the original parcel and cannot be corrected, or that the
irregularity is compatible with the surrounding area.
Staff Response: The site will be irregular, but the irregularity arises from the original
parcel and cannot be corrected.
STAFF RECOMMENDATION:
Staff recommends approval of the proposed tentative plat application.
PLANNING BOARD RECOMMENDATION:
After a public hearing on December 14, 2021, the Planning Board voted five (5) to two (2) to
recommend approval of the T-plat application.

The City of South Miami Code of Ordinances, Section 8A -5, requires thot af/lobbyists, as defined in that section,
must register with the City Clerk before engaging in any lobbying activities and in most cases pay an annual fee 0/
$500.00 and an additional $100 for each additianal issue. This applies to all persons who are retained with or
without compensDtion to influence any action, decision, recommendation of someone with the city, including the
city manager, city attorney, department heads, city personnel, or members 0/ the city commission or members of
any city board, concerning a matter that could foreseeably be address by the city commission or a ci ty
board. There ore some exceptions and exemptions. The following are not considered to be lobbyist: a
representative of a principal at a quasi·judicial hearing, experts who present scientific or t echnical information at
public meetings, representatives of a neighborhood association without compensation and re prese ntatives of a
not-far-profit community based organization for the purpose of requesting a grant who seek to influence without

IV. Public Hearings:
1. PB-21-020
Applicant: The City of South Miami
A Resolution relating to a Tentative Plat application to allow a replat of the Marshall Williamson
property identified as folio numbers 09-4025-000-0850, 09-4025-065-0090, and 09-4025-000-
0852 which is generally located south of SW 64 th Terrace and approximately between SW 60 th
Avenue and SW 61 st Court/aka SW 61st Drive Court and as legally described herein.
Applicant: The City of South Miami, represented by Ms. Jane Tompkins, AICP (Planning Director)
Ms. Bonich read PB-21-020 into the record.
Ms. Tompkins presented the item to the B~a'rd. '
Mr. Jacobs asked if the zoning district for the subject property, RT-9, was the only RT-9 zoned
property in the area. Ms. Tompkins responded,t,hat it W~S the only property zoned RT-9 in the
area and was surrounded by sin~le-~amily residential properties that are zoned RS-4.
Mr. Jacobs then asked for some :backgt~und on the covenant and the reasons as to why it was
made. Ms. Tompkins responded that the covenant was made in 1975 as part of the development
of the adjacent lR.E. Lee school. Mr. Pepe then added that the JRE Lee School is part of a
subdivision that included Tract K which include~-a restriction that prevented development of the
tract. The County later gave the tract toth~Cify's Commu,nity Redevelopment Agency (CRA). In
addition to Tract K, the CRA owned two (2) other adjacent lots and decided to develop them into
affordable housing. For Tract K to be used as a buildable site in the project, the restriction needs
to be removed.
Mr. Jacobs asked if the property was beingreplated so that it was salable, to which Mr. Pepe
stated no. The lot was being replated so that if the City wanted to develop the site, they would be
able to get the maximum amount of development out of the site and potentially save more of the
trees.
Ms. Dodard asked if the subject tract was twenty-five (25) linear feet or something more
substantial. Mr. Pepe responded that the tract was twenty (25) feet wide by approximately
seventy-six (76) feet long.
Mr. Borges asked what the maximum number of units that could be developed on the site was.
Ms. Tompkins responded that the RT-9 district allows for a density of nine (9) units per acre and
because of its size, the maximum number of units that could be built would be eight (8) units, but
the project would still need to comply with all the other dimensional standards for the district.
Mr. Borges then asked if the district allowed for one or two stories, to which Ms. Tompkins
responded that two (2) stories was permitted.

Ms. Bonich asked if the property with the folio number ending in 0854 was privately owned, to
which Ms. Tompkins stated yes. Mr. Pepe added that the property is where the Marshall
Williamson home is located. Mr. Lightfoot added that the property was not owned by the City.
Mr. Pepe stated that an email dated December 14, 2021 from Ms. Lashawnda Williams was
received by the City. Mr. Borges and Ms. Bonich then stated for the record that they received the
email. Mr. Jacobs then requested that the email be read into the record.
Mr. Borges asked staff to provide a correlation between the email and the City's request for T-
Plat approval. Ms. Tompkins responded that there is nothing in the item that mentions the
removal of the trees. Any plans for building on the site would need to follow the normal course
of procedure. Like PB-21-019, this item was a technical cleanup.
Ms. Dodard asked if the intent of the item was to eventually place a building on the site, to which
Ms. Tompkins stated that she could not respond. Ms. Tompkins then informed the Board that
there are no plans at this time for the development of the site.
Mr. Miller stated based on the information provided in the package, the item was setting up the
plat for future review but there weren't any future plans for development of the site. Mr. Borges
added that if the property were to be developed in the future, the City has provisions in place to
protect the trees.
Mr. Basu stated that the proposed amendment to the subdivision ordinance that will give the
Commission the ability to pick and choose which trees will remain. He then stated that he doesn't
have an issue with the ·replat, but the issue is over the trees that are on the site. There are many
other options that can be explored without re-platting the property.
Mrs. Readon asked why the City is requesting to replat the property. Mr. Basu stated that the CRA
originally initiated the ·process to build townhouses but was never finished because the CRA was
abandoned~ When the City came into possession of the site afterwards, they chose to complete
the process.
Mr. Pepe stated that the City is not picking up the mantle of the CRA to develop the site. The
problem that the CRA found was that with a larger the building site, they had a better chance of
preserving the trees on the site. Ms. Bonich then added that based the City Commission tends to
favor the protection of trees and less development.

something that the City could conslder, is that something that the Board could have a conversation
about and ask someone that is knowledgeable on the subject to give a presentation to the Board.
Mr. Borges asked whatanAPU was, to which Mr. MiUer stated thatit was another name for mother-
in-law quarters or efficiencies.'The Board then held'a brief discussion on the topic.
Mr. Pepe stated that you would need to speakwith the Planning Department staff about listing it on
the agenda so that the ~oard could discuss it. A way to make it productive would be to have someone
give a presentation on the topic and had some material that was distributed to the Board members
beforehand.
Mr. Miller stated that he will work on getting the topic scheduled for discussion on a future agenda
in 2022
