A Resolution authorizing a temporary change in the permitted hours of construction
operations for Florida Power & Light (FPL) to perform work at the FPL South Miami
Substation at 5797 SW 68 Street for 3 Transformer Replacements.
WHEREAS, Pursuant to Section 7-16(g) of Code of the Ordinances, as amended by Ordinance
No. 5-15-2212, all construction sites shall comply with the city's noise code and it provides in
pertinent part as follows:

All construction sites shall comply with the city's noise code. Construction activity is limited
to the hours of 7:00 a.m. through-6:00 p.m. on the weekdays of Monday thru through Friday;
and between the hours of 9:00 a.m. through 5:00 p.m. on Saturday. No construction activity
is permitted on Sunday. Notwithstanding the above, no construction activities shall take place
in, or within 500 feet of, residentially zoned districts, other than those in the Hometown
District, on either Saturday or Sunday and, as to construction activities in non-residentially
zoned districts and in the Hometown District, all days of the week and hours of the day may
be changed by resolution of the City Commission upon a finding of extraordinary
circumstances.
WHEREAS, FPL will perform work at the South Miami Substation for transformer replacement;
WHEREAS, FPL is requesting authority to conduct Transformer replacement for transfer
services at night; and
WHEREAS, FPL is going to be replacing the 3 Power Transformers and associated
switches/equipment that serve the South Miami area and that are located at the South Miami
Substation. The scope of the work entails transporting the transformers from Metrorail station area
to South Miami Substation through the Community Center parking lot that will require a temporary
rolling gate installed ahead of time along the west perimeter of the South Miami Substation. FPL will
exercise the shortest duration possible to lessen impact to the area for each early morning operation.
All of the operations will take place between the hours of 12:00 AM to 5:00 AM. The first transformer
will be transported and installed on January 8-9th and January 16-17th • The second transformer will
be moved and installed on February 1st--2 nd and Feb. 9th and -10 th • The third transformer will be
moved and installed on February 25 th -26 th and March 5th _6 th • Other options were considered, but
this schedule was determined by the City Manager to have the least impact on traffic and on the
community in general.
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSIONERS OF THE CITY
OF SOUTH MIAMI, FLORIDA:
Section 1. The foregoing recitals are hereby ratified and confirmed as being true and they are
incorporated into this resolution by reference as if set forth in full herein.

Section 2. The construction hours are hereby changed temporarily for the current
construction activities of FPL for twelve days, commencin g on January 8 th , 2022 or until such time as
the City Commission or the City Manager revokes these extended hours of operation. The temporary
hours of construction operations are limited to the hours of 12:00 AM to 5:00 AM . FPL and/or
contractor shall contact the City of South M i ami Parking division, and at their own expense, prepay
for metered parking on SW 68 ST for use of parking spaces during transformer disassembly. Th e
exte nded hours for construction activity authorized by this Resolution may also be reduced or
revoked upon determination of the City Manager, at her sole and abso lute discret ion , that a v iol at ion
of any of the City's ordinance or this Resol ution has occurred and has not been resolved to her
satisfaction or that the noise l evel is otherwise excessive. This resolution may also be revoked at any
time in the sole and abso lute discretion of the City Commission.
Section 3. Corrections. Conforming language or technica l scr ivener-type corrections may be
made by the City Attorney for any conforming amendments to be in corporated into the final
resolution for signature.
Section 4: Severability. If any section, clause, sentence, or phrase of this resolution is for any
reason held invalid or unconstitutional by a court of competent jurisdiction, the holding w ill not affect
the va li dity of the remain in g portion s of thi s re so l ution.
Section 5: Effective Date: Thi s re solution w ill become effective immediately upon adoption.

Ordinance No . 5-15-2212 prohibits construction activity to take place during night hours
from 6:00 PM though 7:00 AM. FPL is going to be replacing the 3 Power Transformers
and associated switches/equipment that serve t he So uth Miami area currently located
at the South Miami Substation. The sc ope entails driving in the transformers from /to
South Miami Substation to Metrorail station parking lot entry area v ia parking lot access
road that will require a temporary rolling gate in stalled ahead of time along the west
perimeter of the So uth Miami Substation. FPL will exercise the Shortest duration
between the hours of 12:00 AM to 5:00 AM for Transformer 1 on January 8-9'" and
January 16-17'". Transformer 2 on February 1"2 " and Feb. 9'10'". Transformer 3 on

Scope of the Project
• FPL is going to be replacing the 3 power transformers and
associated switches/equipment that serve the South Miami area
currently located at South Miami Substation.
• After initial discussions with the City of South Miami, FPL will
not be installing a temporary transformer in front of the
substation or temporarily expanding the south side of the
substation towards the sidewalk.
• Note: FPL will be responsible for any unplanned damages to
city facilities.

Project Scope and Impact
• Scope -Drive transformers from/to South Miami Substation to
the Metrorail station parking lot entry area via parking lot access
road. This will require a temporary rolling gate installed ahead
of time along the west perimeter of South Miami Sub.
• Impacts:
-South Miami Metrorail Station Parking -will need access to the entrance
of the parking lot during the hours of 00:00-05:00. (If possible, starting to
prepare equipment at 23:00 the night before with partial lane closure)
-Parking area for Community Center -will need to drive transformers
through the parking area, overnight starting at 23:00-03:00.

MOT Request
• FPL will require a partial lane closure in front of South Miami
substation on SW 68ST as well as the use of the two parking
spots in front of South Miami substation.
• Impacts:
-The dates for the MOT will be 1/3/21-3/30/21.
-It will be multiple days for a few hours as we will use the MOT to move
material in and out of the substation and load it into a trailer for removal
from the substation.
-We anticipate a maximum of 30 days during off peak hours and there will
be an off duty City of South Miami Police Officer present during this time.
-FPL will be responsible for paying for the two parking spots .

An Ordinance amending Section 7-16. (g) of the Code of Ordinances of the
City of South Miami in pertinent part to provide for Commission approved
change in construction days and hours of operation.
WHEREAS, from time to time a project that will benefit the City of South Miami may,
due to extraordinary circumstances require work to be performed on Sundays and earlier than
9:00 am. on Saturdays and
WHEREAS, the Mayor and the City Commission desire to provide for more flexibility
under extraordinary circumstances for changing the days and hours of pennissible work.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. Section 7-16. (g) of the Code of Ordinance of the City of South Miami is
hereby amended in pertinent part to read as follows:
Sec. 7-16. -Pre-construction and construction standards for sites.

(g) All construction sites shall comply with the city's noise code. Construction

Section 2. Codification. The provisions of this ordinance shall become and be made
part of the Code of Ordinances of the City of South Miami as amended; that the sections of this
ordinance may be renwnbered or re-Iettered to accomplish such intention; and that the word
"ordinance" may be changed to "section" or other appropriate word.
Section 3. Severability. If any section, clause, sentence, or phrase of this ordinance is
for any reason held invalid or unconstitutional by a court of competent jurisdiction, this holding
shall not affect the validity of the remaining portions of this ordinance.
Section 4. Ordinances in Conflict. All ordinances or parts of ordinances and all
sections and parts of sections of ordinances in direct conflict herewith are hereby repealed.
However, it is not the intent of this section to repeal entire ordinances, or parts of ordinances,
that give the appearance of being in conflict when the two ordinances can be harmonized or
when only a portion of the ordinance in conflict needs to be repealed to harmonize the
ordinances. If the ordinance in conflict can be harmonized by amending its terms, it is hereby
amended to harmonize the two ordinances. Therefore, only that portion that needs to be repealed
to harmonize the two ordinances shall be repealed.

I listened to the meeting and the following is what I believe the amendment to have been to both ordinances.
Sec. 7-15.2. -Demolition requirement standards.
