A Resolution relating to a Special Use application to permit a Child Care
Facility (7 or more children) at 6301 Sunset Drive.
WHEREAS, pursuant to Section 20-5.8 of the Land Development Code (LDC), the
applicant, Pineview Preschools Sunset, submitted Application No. PB-21-021 to the City
requesting a Special Use approval for a Childcare Facility (7 or more children) at 6301 Sunset
Drive, within the Residential Office (RO) zoning district; and
WHEREAS, Childcare Facilities are permitted as a Special Use within the RO zoning
district and are subject to meeting the Special Use conditions specified in LDC Section 20-3.4 and
subject to meeting the Special Use requirements as set forth in Section 20-3.4(B)(23) of the LDC;
and
WHEREAS, the application meets the Special Use requirements set forth in Section 20-
3.4(B)(23) of the LDC; and
WHEREAS, the approval of a Special Use requires a recommendation from the Planning
Board and the approval of the City Commission after a public hearing; and
WHEREAS, at a public hearing on December 14, 2021, the Planning Board voted
unanimously to recommend approval of the Special Use request to permit a Childcare Facility (7
or more children); and
WHEREAS, the City Commission desires to approve the application for Special Use for
a Childcare Facility (7 or more children) at 6301 Sunset Drive.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1: The recitals set forth in this resolution are true and they are supported by
competent substantial evidence and they are incorporated into this resolution by reference as if set
forth in full herein.
Section 2: The subject application, No. PB-21-021, submitted by Pineview Preschools
Sunset to operate a Childcare Facility (7 or more children) at 6301 Sunset Drive, within the
Residential Office (RO) zoning district is hereby approved. This approval is subject to all
applicable City ordinances, codes, rules and regulations, and the adherence to the Special
Requirements applicable in Section 20-3.4(B)(23) of the LDC entitled "Schools and Child Care
Facilities," the Special Use Approval requirements provided in Section 20-5.8 of the LDC, and the
following terms and conditions which include but are not limited to:
I. Submittal and approval of the Unity of Title application by the City;

2. Should the City identify any traffic circulation deficiencies in the future that impact the
adjacent public right-of-way, the applicant shall make the necessary modification to
the site to address such problems;
3. The site plan shall be revised to provide sight distance triangles for the access driveway,
nothing shall be erected, located, planted, or allowed to grow and no vehicle shall be
parked which materially impedes vision between a height of three (3) feet and six (6)
feet within the visibility triangles. This item should be evaluated further for safety
concerns;
4. The maximum capacity of the childcare center shall be governed by life safety codes
and licensing standards for such facilities, as amended;
5. The drop off and pick-up loading zone areas for the students and children attending the
childcare facility shall be completely accommodated on site;
6. Any issues in the future that arise from the backup of traffic onto the public right-of-
way must be addressed;
7. All playground and athletic activities areas shall be accommodated on site;
8. No school activities are permitted on site after 11 :00 p.m.;
9. The childcare facility shall be financially responsible for the appropriate solution of
any problems that arise after approval;
10. If the proposed school or child care facility, or the traffic generated by the school or
facility is, in the future, determined by the Director of Planning, to be adversely
affecting the health or safety of persons residing or working in the vicinity of the
proposed use, or to be detrimental to the public welfare or to the property or
improvements in the neighborhood, or to be not in compliance with other applicable
Code provisions, the special use approval may be modified or revoked by the City
Commission upon notification and public hearing; and
11. If required by the Code, any and all exterior renovations or modifications for the new
establishment may be subject to approval by the Environmental Review & Preservation
Board.
Section 3. Corrections. Conforming language or technical scrivener-type corrections may
be made by the City Attorney for any conforming amendments to be incorporated into the final
resolution for signature.

ANALYSIS:
Pursuant to the Special Use Conditions, Section 20-3.4 of the LDC, a special use may be approved
and permitted by the City Commission at a public hearing, after a recommendation by the
Planning Board, provided that such use complies with the general requirements, special
requirements, and any other conditions that the City Commission may consider appropriate and
necessary. When reviewing the project, the following items are noted:
• The applicant's intent is to purchase the subject property and convert the ground floor of the
building into space for a childcare facility. The second floor of the building will continue to be
leased for office uses.
• Per the attached site plan, the existing two-story building is approximately 7,936 square feet
and sits on a 24,000 square foot lot.
• The applicant has submitted a Unity of Title application that will unite 6333 Sunset Drive and
the subject property together.
• After review of the City's Zoning Map, it was determined that the subject property abuts the
following zoning districts:
o Low-Density Single-Family Residential (RS-3)
o South: Residential Office (RO)
o East: Residential Office (RO)
o West: Residential Office (RO)
• The attached proposed Site Plan, sheet SP-1, and the attached proposed Floor Plan, sheet A-
1, detail the proposed site and floor plan for the proposed childcare facility. Also included is
the pt floor demolition plan (Sheet 0-1) as well as proposed elevations for the building
(Sheets A-2 -Sheet A-3) that show that there will are exterior renovations proposed for the
building. It is important to note that all site and exterior building renovations must first be
reviewed and approved by the City's Environmental Review & Preservation Board (ERPB)
prior to the issuance of any building permits for exterior renovation or renovation of the site.
PARKING SPACE ANALYSIS
Pursuant to Section 20-3.3(0) of the LOC, the minimum parking space requirement for a Childcare
Facility use is as follows:
• One (1) space per two hundred fifty (250) square feet of gross floor area.
Pursuant to the attached site plan, sheet A-1, the ground floor of the existing building has a
square footage of approximately 3,797.45 square feet. Based on the information provided, the
minimum amount of parking spaces required for the proposed Childcare Facility is:

Additionally, the second floor of the building will be occupied by office space. Pursuant to Section
20-3.3(0) of the LOC, the minimum parking space requirement for an Office:

Based on the above listed calculations, the total amount of parking required for the subject
building is:

Based on the calculations listed above, the minimum amount of required off-street parking
spaces needed to satisfy the parking for the subject property is thirty-two (32) parking spaces.
When reviewing the proposed site plan, it has been determined that a total of twenty-four (24)
existing off-street parking spaces are provided on the subject property. Based on this
information, the subject site does not have enough off-street parking available to satisfy the
proposed uses in the building.
Pursuant to the attached site plan, sheet A-l, the 6333 building has a square footage of
approximately 6,054 square feet which is occupied by the applicants by both existing childcare
facility and office space. Based on the information provided, the minimum amount of parking
spaces required for the 6333 building is:

Once united via the Unity of Title process, the total amount of off-street parking available will be:

Once united, the minimum off-street parking spaces requirements for both sites will be satisfied
by the existing parking that is provided.
TRAFFIC STUDY
As required by Section 20-3.4(B)(23)(e) of the LDC, a traffic study that includes a parking impact
on the surrounding neighborhood and requirements for adequate queuing on site shall be
provided. Pursuant to the requirement, the applicant has provided the attached traffic study
that was prepared by Adriana Rodriguez, P.E., PTOE of Beacon Traffic Consulting, Inc. Per the
report conclusion, Ms. Rodriguez states that:
Trip generation calculations per/ormed for the proposed expansion of the childcare
facility at 6301 Sunset Drive is expected to generate 138 additional daily trips, 38
additional trips during the AM peak hour {19 inbound and 19 outbound}, and 38
additional trips during the PM peak hour {19 inbound and 19 outbound}.
The parking utilization survey data show that parking demand is different for the
preschool when compared to that of the general offices. Therefore, the concept of
shared parking is reasonable to be used, in particular, when the connection
between properties is depicted on the site plan and facilitated by having the same
property owner.
The parking analysis indicates that when combining the number of available
parking stalls at the existing preschool and the building at 6301 Sunset Drive a
surplus of parking spaces would be available which could accommodate any
changes in parking demands for the proposed expansion of the preschool. We
believe this analysis demonstrates that the proposed expansion of the preschool
will not result in any adverse parking impacts.
The report submitted was reviewed by the City's consultant, Ms. Diana White, P.E. of Calvin,
Giordano, & Associates who provided the following comments:
1. According to City of South Miami Code of Ordinance 20-4.4 the width of a two-
way drive aisle for 90-degree parking shall be 23-foot wide. The site is existing
non-conforming and only shows 22 feet, but when measured with a scale it
measures about 19 feet. Site plan provided must be consistent with the existing
site.
2. According to City Code Section 20-4.1, the standard 90-degree parking stall
dimension is 9-foot wide by 18-foot long. The detail shown on the plans
references 8.5' by 18'. The site is existing non-Conforming.
3. Angle parking #10 looks smaller that angle parking stall #1 to 9. Plans must be
consistent with the existing site.

4. Dead end parking lots must provide adequate turnaround area for safe vehicle
maneuvering. Provide an auto-turn exhibit to demonstrate that enough
turnaround area is being provided for the design vehicle to turn back around to
exit the site after reaching the western limits of the parking-lot area. Applicant
must make the necessary modification to the site to address any traffic
circulation deficiencies should these arise in the future.
Note: The applicant submitted a revised site plan on 12-21-21 showing the reconfiguration
of the parking spaces in order to provide a turnaround area.
5: Please provide sight distance triangles for the access driveway, nothing shall be
erected, located, planted or allowed to grow and no vehicle shall be parked
which materially impedes vision between a height of three (3) feet and six (6)
feet within the visibility triangles. This item should be evaluated further for
safety concerns.
Note: The revised site plan includes the triangle of visibility but it is not located correctly.
This item remains a concern and must be addressed prior to the issuance of any building
permits or a Business Tax Receipt, whichever occurs first.
6. Please provide a signing and pavement marking plan prepared by a registered
engineer in the state of Florida.
Note: A signage and pavement marking plan has been submitted.
Furthermore, Ms. White's observations are as follows:
1. Based on the City Code, a total of 32 parking spaces would be required for the
proposed uses of the existing building. The existing parking lot provides 24
spaces, leaving a shortage of 8 spaces. The adjacent existing preschool building
has a parking space requirement of 24 spaces and currently provides 32 spaces,
providing a surplus of 8 spaces. When viewed as one complete site, the
proposed development would satisfy the parking requirements based on City
Code.
2. A Parking Utilization Study was performed by the applicant. The results show
that for the Preschool use, the city code requirement is almost identical to the
field results. For the Office use, the field results demonstrate a lower parking
demand than the city code requires. Based on the ratio of occupied spaces to
the square feet of office space, the reduced office space would have a peak
demand of 11 spaces. Combined with the 15 spaces for the Preschool use, a
total of 26 spaces would be needed.

3. AdditionallYI the results of the Parking Utilization Study demonstrate that the
peak demand time for the Office and Preschool do not occur at the same time.
Based on the peak demand time for both uses at oncel a total of 23 parking
spaces is projected to be needed at once. Based on these resultsl the existing 24
parking spaces would accommodate the proposed uses for the site.
Ms. White concluded that the existing parking on the subject site will accommodate the proposed
uses.
SPECIAL USE REGULATIONS & ANALYSIS
To be approved, the proposed Childcare Facility must comply with the general listed in Section
20-3.4{A) of the LOC. Additionally, Section 20-3.4{B)(23) of the LDC provides the standards against
which this application must be reviewed. The following is staff's analysis of the Special Use
conditions for the proposed Child Care Facility:
SCHOOLS AND CHILD CARE FACILITIES: The following requirements shall be
applicable to all schools and childcare facilities allowed as a special use:
(a) The maximum student capacity of a school (K-12) shall not exceed one hundred
and fifty (150) students per net acre based upon the site size of the property.
Staff Response: Condition is not applicable. Proposed use is a childcare
facility.
(b) The maximum capacity of a childcare center shall be governed by life safety
codes and licensing standards for such facilitiesl as amended.
Staff Response: the maximum capacity of the proposed use shall be governed
by life safety codes and licensing standards for such facilities, as amended.
(c) Notwithstanding the parking requirements set forth in Section 20-4.4(8)(12),
all schools, except high schools, shall provide one parking space for every three
hundred (300) square feet of gross floor area. High schools shall provide one
(1) parking space for every two hundred (200) square feet of gross floor area.
Staff Response: Condition is not applicable. Proposed use is a childcare
facility.
(d) The proposed school shall meet State standards for class size and for
recreation and open space.
Staff Response: Condition is not applicable. Proposed ~se is a childcare
facility.
(e) A traffic study to include a parking impact on the surrounding neighborhood
and requirements for adequate queuing on site shall be provided indicating

the impact of the proposed facility on the surrounding area; the traffic study
consultant shall contract with the City and be paid for by the school applicant.
Staff Response: The applicant has provided a traffic study, which was
reviewed by Ms. Diana White, P.E. of Calvin Giordano & Associates via the
Traffic Study Memorandum dated December 9,2021.
(f) Childcare facilities with fifteen (15) or more children shall be required to
provide a traffic circulation plan, a traffic study, if required, and a facilities
impact statement to the Planning Department for review. The Planning
Department and the Police Department will assess the information and
determine whether a traffic study is warranted based on the proposed number
of children and the surrounding neighborhood conditions. The traffiC
circulation plan must be supported by the data for the use before a license to
operate the facility may be issued. If a traffic study is warranted, the traffic
study consultant shall contract with the City and be paid for by the childcare
facility applicant. If the traffiC circulation plan is not supported by the data,
then the permit may not be issued unless the applicant complies with
appropriate mitigation.
Staff Response: Per the site plan provided, a maximum of sixty-four (64)
children can occupy the pt floor of the subject building. The proposed project
was reviewed by Police Chief Rene Landa who indicated he did not think a
traffic study was needed.
(g) All required parking for the school and childcare facility shall be located on site.
Staff Response: A total of twenty-four (24) existing off-street parking spaces
are provided for the uses in the building. Furthermore, the applicant has filed
a Unity of Title application to combine 6333 Sunset Drive with the subject
property. Once combined, a total of existing off-street parking will be available
to both buildings on the site. That said, all required parking will be located on
the site.
(h) The drop off and pick-up loading zone areas for students and children
attending the childcare facility shall be completely accommodated on site.
Staff Response: It will be required that the drop off and pick-up loading zone
areas for the students and children attending the childcare facility shall be
completely accommodated on site
(i) All proposed driveways, vehicular Circulation, and parking areas shall be
designed to avoid a backup of traffic onto a public right-of-way.
Staff Response: Perthe Memorandum from Ms. Diana White, P.E., the parking
areas are all existing non-conforming areas. Because there is adequate parking
area at 6333 Sunset, there shouldn't be an issue with backup traffic onto the
right-of-way.

(j) No ingress or egress to a school or childcare facility shall be permitted through
abutting residentially zoned parcels.
Staff Response: Per the site plan provided, all ingress and egress are located
within the RO zoning district. There is no ingress or egress through the
abutting RS-3 zoning district.
(k) When adjacent to a residential zone district, a landscape opaque buffer shall
be constructed along dividing property lines.
Staff Response: An existing fence and some landscaping are located along the
property line separating 6301 Sunset from the property to the north. There is
very little room for additional landscaping in this narrow area, but the fence
should serve the intended purpose of screening the use.
(I) All playground and athletic activities areas shall be accommodated on site.
Staff Response: Per the attached email dated December 8, 2021 from the
applicant, Ms. Cynthia Suarez, the areas along the eastern, southern, and
western perimeters of the property consist of sod and will be used for
playground areas. Furthermore, the playground equipment will not be
anchored down.
(m) There may not be any school activities on site after 11:00 p.m.
Staff Response: Pursuant to the regulation, no school activities shall be
permitted on site after 11:00 p.m.
(n) The school and childcare facility shall be financially responsible for the
appropriate solution of any problems that arise after approval.
Staff Response: Pursuant to the regulation, the applicant will be financially

STAFF RECOMMENDATION:
Staff recommends approval of the Special Use application for the Child Care Facility. This approval

Beacon Traffic Consulting, Inc., has prepared this letter report to document a
Parking Evaluation due to the proposed expansion of the Pineview Preschools
Sunset Campus located at 6333 Sunset Drive, South Miami, Florida. The site
plan indicates that the expansion will consist of using a two-story building
located at 6301 Sunset Drive to provide additional area for childcare and
general offices. A total of 3,798 square feet will be allocated to childcare, and
an additional 4,139 square feet will be allocated to general offices. A copy of
the site plan is included in Attachment A.
Trip Generation
The expected vehicular trip generation for the proposed expansion of the
preschool by using the two-story building at 6301 Sunset Drive was calculated
using rates contained in the Institute of Transportation Engineers' (ITE) Trip
Generation, 10th Edition. The trip generation for the eXisting and proposed land
uses was determined using ITE Land Use 710 -General Office and ITE Land
Use 565 Day Care.
Project trips were estimated for daily, AM peak-hour, and PM peak-hour
conditions. Table 1 summarizes the trip generation calculations. ITE's Trip
Generation Manual (10 th Edition), trip generation rates/equations are included
in Attachment B.
Table 1 shows that the proposed expansion of the childcare facility at 6301
Sunset Drive is expected to generate 138 additional daily trips, 38 additional
trips during the AM peak hour (19 inbound and 19 outbound), and 38 additional
trips during the PM peak hour (19 inbound and 19 outbound).

Parking Analysis
Based o n comments provided by the C ity of Sout h Miami , one (1) parking
space is required per 250 square feet of gross floor area for chi ldcare facilities ,
an d one (1) pa r king space is required pe r 250 square feet o f gross floor area
fo r genera l offices . Accordingly , 15 parking spaces are requ ired for the
proposed chi ldcare facility and 17 parking spaces wi ll be req u ired for the
proposed gene ral offices.
The number of parki ng stal ls at the existing preschool (i.e ., address 6333
S un set Driv e) and the proposed bu il di ng for the expa ns io n at 6301 S unset
Drive were di v ided into three zones, as illustrated in Figure 1. Tab le 2
summarizes the number of e xisting pa rk ing sta ll s at each of the three zones.

A parking utilization study was performed on November 4, 2021 , to determine
the number of occupied and unoccupied parking stalls at the two-story building
located at 6301 Sunset Drive and at the existing preschool located at 6333
Sunset Drive . The parking ut iliza tion survey w as conducted between 7:00 AM
and 6:00 PM. Detailed parking survey data are included i n Attachment C .
The parking utilization survey data show that the existing property at 6301
Sunset Drive ; which currently corresponds to general offices , exhibits different
parking demand patterns throughout the day when compared to the parking
utilization of the exi sting preschool. T herefore , it is reasonable to consider the
concept of shared parking for the proposed expansion since the building at
6301 Sunset Drive w ill maintain the second floor as general offices and the first
floor will be utilized fo r childcare . It is important to highlight that the proposed
site plan show s a connection between the properties at 6333 Sunset Drive and
6301 Sunset Drive which w ill further facilitate shared parking .
Table 3 summarizes the ma ximum num ber of occ upied parking stalls ,
ma x imum number of unoccupied parking stalls , and the average number of
unoccupied parking stalls that were recorded during the parking utilization
surve y (7:00 AM and 6 :00PM ). The data presented in Table 3 indicate that the
existing parking lot is not 100 % utilized during the study period .

Also. Table 3 shows that a surplus of parking stalls from Zones 1 and 2 is
available throughout the day. A maximum surplus of 28 parking stalls is
expected to occur between of 5:00 PM and 6:00 PM. This surplus of parking
stalls could easily accommodate any changes in parking demands related to
the proposed land uses in Zone 3 (Le .• the property at 6301 Sunset Drive).
Conclusion
Trip generation calculations performed for the proposed expansion of the
childcare facility at 6301 Sunset Drive is expected to generate 138 additional
daily trips, 38 additional trips during the AM peak hour (19 inbound and 19
outbound), and 38 additional trips during the PM peak hour (19 inbound and 19
outbound).
The parking utilization survey data show that parking demand is different for the
preschool when compared to that of the general offices. Therefore, the concept
of shared parking is reasonable to be used, in particular, when the connection
between properties is depicted on the site plan and facilitated by having the
same property owner.
The parking analysis indicates that when combining the number of available
parking stalls at the eXisting preschool and the building at 6301 Sunset Drive a
surplus of parking spaces would be available which could accommodate any
changes in parking demands for the proposed expansion of the preschool.
We believe this analysis demonstrates that the proposed expansion of the
preschool will not result in any adverse parking impacts. If there are any

PARKING STU DY OBS ER VAT IONS
1) Based on the C ity Code, a total o f 32 parking spaces would be required for th e
proposed uses of th e exist ing building. The existing parking lot provides 24
spaces, leaving a shortage of 8 spaces . The adjacent ex isting p reschool
building has a parking space requiremen t of 24 spaces and currently provides
32 spaces, providing a su rplus of 8 spaces . When viewed as on e complete site,
the proposed development would satisfy the parking requiremen t s based on
C ity Code .
2) A Park ing utilization Stud y was performed by the applicant. The results show
tha t for the Preschoo l u se, th e city code req uirement is almost iden tical to the
field results. For the Office use, the field resu lts demonstrate a lower parking
demand than the c ity co de requires. Based on th e ratio of occupied spaces
t o the square feet of office space, the reduc e d o ffice space would have a
peak demand o f 11 spaces. Combined w it h the 15 spaces for the Preschool
use , a total of 26 spaces would be needed.
3) Additionally, t he results o f the Parking Utilization Study demonstrate that the
peak demond time for the Office and Preschool d o not occur a t the some
time. Based on the peak demand time fo r both uses at o nce, a total of 23
park ing spaces is projected t o be needed at once. Based on these results, the
ex isting 24 parking spaces would acco mm o date the proposed uses for th e site.

As many of you may know, Pineview Preschools Sunset has been serving preschool age children in the
South Miami community since 2012. We have built a wonderful rapport with our neighbors, many whose
children attend our preschool. We are in the process of leasing the adjacent building at 6301 Sunset Drive
with the purpose of adding additional classrooms. Due to our current capacity, we have limited spacing
and have many neighborhood families on our waiting list. We hope we are granted this special use permit
and can accommodate these families.
We are currently submitting a Special Use Permit for the City Commission to review. This project will
allow Pineview Preschools to continue bringing quality early childhood education to residents in the area
with preschool age children. The proposed Project complies with all applicable code provisions.

The City of South Miami Code of Ordinances, Section BA -5, requires that aI/lobbyists, as defined in that section,
must register with the City Clerk before engaging in any lobbying activities and in most cases pay an annual fee 0/
$500.00 and an additional $100 for each additional issue. This applies to 01/ persons who are retained with or
without compensation to influence any action decision, recommendation of someone with the city, including the
city manager, city attorney, department heads, city personnel, or members of the city commission or members of
Gny city board, concerning a matter that could /oreseeably be address by the city commission or a city
board. There are some exceptions and exemptions. The following are not considered to be lobbyist: a
representative of a principal at a quasi -judicial hearing, experts who present scientific or technical information at
public meetings, representatives of a neighborhood association without compensation and representatives of a
not-for-profi t community based organization for the purpose of requesting a grant who seek to influence without
special compensation.

IV. Public Hearings:
1. PB-21-021
Applicant: Pineview Preschools Sunset
A Resolution relating to a Special Use application to permit a Child Care Facility (7 or more
children) at 6301 Sunset Drive.
Applicant: Pineview Preschools Sunset, represented by Cynthia Suarez (Owner)
Ms. Bonich read PB-21-021 into the record.
Mr. Lightfoot presented the item to the Board.
Mr. Borges asked if the property would comply with the City's minimum parking space
requirements once the Unity of Title is in place, to which Mr. Lightfoot stated yes.
Mr. Jacobs asked if a traffic study was provided in the package, to which Mr. Lightfoot stated yes.
Mr. Borges stated that he was under the impression that the item before them was the Unity of
Title for the property. Mr. lightfoot informed him that Unity of Title applications are typically
reviewed solely by either the City Commission or the City Attorney and not the Planning Board.
Mr. Borges stated that they must own the properties before they can unite them. There is a letter
in the package stating that the applicant will be leasing space in the building. Mr. Lightfoot then
stated that the applicant informed staff of their intent to file a Unity of Title application to unite
6301 Sunset Drive and 6333 Sunset Drive so that the parking can be shared throughout both
buildings.
Mr. Pepe swore in the applicant representatives who testified on the item.
Mr. Borges asked what the correlation was between Pineview Preschools and Sunset
Management, LLC. Ms. Suarez responded that Sunset Management, LLC is the corporation that
she used to purchase the property. She then added that she maintains same ownership between
the two (2) entities.
Mr. Jacobs asked how many children were currently enrolled in the preschool. Ms. Suarez stated
that they currently have just over 100 children enrolled, and the proposed site would have sixty-
four (64) children.
Mr. Basu asked what the hours of operation would be. Ms. Suarez stated that the hours were
approved by the Department of Children and Family (DCF) and are 7am -6pm.
Mr. Miller asked what the ages of the kids were, to which Ms. Suarez stated that they accept kids
that are between the age of 8 weeks old to four (4) years old. Mr. Miller asked why they needed
to close by 11pm, to which Mr. Lightfoot stated that the LDC has a standard condition that a school
or daycare cannot be open past 11pm.

Mr. Miller asked if the residential neighbors to the north were notified of the hearing, to which
Mr. Lightfoot stated yes. As required, notices were sent to all property owners that are within 500
feet of the subject property, a sign with the hearing information was posted on the property, and
an ad was run in the newspaper.
Mr. Miller inquired about the length of time that the current preschool was operating. Ms. Suarez
responded that they have been .in operation at the site since 2012. Mr. Miller then asked what
the relationship was with the neighbors, to which Ms. Suarez stated that neighbors are in favor
of the preschool. She then stated that she put together letter of support from neighbors and
existing clients which was handed out to the board members.
Ms. Oodard asked what the maximum number of kids would be for both properties, to which Ms.
Suarez stated that it would be under 200 kids for both properties which is based on the square
footage of the sites.
Mr. Miller asked what the change in occupancy would be for the building. Ms. Suarez responded
that they are only taking the ground floor of the building and would have 64 children. She then
added that the previous tenant was a medical facility.
Ms. Bonich asked if the item before the Board was for the approval to use both lots, that the
parking was enough and that th~ traffic will be enough. Mr. Lightfoot stated that the Board is only
approving the use of the 6301 building. The use of the 6333 building was previously approved for
daycare use.
Mr. Miller asked what the hours of operation would be for the 6333 building, to which Mr.
Lightfoot responded that he was not sure of what the hours of operation would be since it was
not governed by the LOe.
Mr. Borges asked if the applicant wUl be performing a Unity of Title. Mr. Lightfoot stated that the
applicant will be required to satisfy their parking requirement either by uniting the properties or
by either obtaining a Variance or purchasing parking passes from the City. Ms. Suarez stated that
they have already purchased and closed on the property and are in process of submitting the
Unity of Title request to the City.
Mr. Jacobs stated that he knows that there is an entrance on Sunset Drive but could not locate
the second entrance. Ms. Suarez stated that the second entrance was on SW 63 rd Avenue. Mr.
Jacobs asked if the lots connect, to which Ms. Suarez stated that they currently do not connect
but are looking into the possible connection of the sites.

Mr. Miller asked if the Board wanted to talk in the future about Auxiliary Dwelling Units (ADU) as
something that the City could consider, is that something that the Board could have a conversation
about and ask someone that is knowledgeable on the subject to give a presentation to the Board.
Mr. Borges asked what an ADU was, to which Mr. Miller stated that it was another name for mother-
in-law quarters or efficiencies. The Board then held a' brief discussion on the topic.
Mr. Pepe stated that you would need to speak with the Planning Department staff about listing it on
the agenda so that the Board could discuss it. A way to make it productive would be to have someone
give a presentation on the topic and had some material that was distributed to the Board members
beforehand.
Mr. Miller stated that he will work on getting the topic scheduled for discussion on a future agenda
in 2022
