An Ordinance amending the City of South Miami Comprehensive Plan to create a new
Property Rights Element.
WHEREAS, Section 163.3167, Florida Statutes, requires each local government to address in its
Comprehensive Plan principles, guidelines, standards, and strategies for the orderly and balanced future
economic, social, physical, environmental, and fiscal development of the area; and
WHEREAS, these principles, guidelines, standards, and strategies are generally expressed as
goals, objectives, and policies; and
WHEREAS, Section 163.3177, Florida Statutes, further requires that the comprehensive plan
consist of the following elements: future land use, transportation, housing, infrastructure, conservation,
recreation and open space, intergovernmental coordination, and capital improvements; and
WHEREAS, Section 163.3177(6), Florida Statutes, was recently amended to add a requirement
that each local government include in its comprehensive plan a property rights element to ensure that private
property rights are considered in local decision-making; and
WHEREAS, the South Miami Planning Board, sitting in its capacity as the Local Planning Agency,
reviewed the amended Comprehensive Plan at a public hearing on August 10, 2021 and voted unanimously
to recommend approval of the amendment; and
WHEREAS, the City Commission considered the amendment on September 7, 2021 and voted
unanimously to approve the amendments on the first reading of the Ordinance; and
WHEREAS, the amendment was transmitted to the Florida Department of Economic Opportunity
(DEO) and other reviewing agencies in accordance with the state coordinated review process set forth in
Sections 163.3184(2) and (4), Florida Statutes (F.S.), for compJiance with Chapter 163, Part II, F.S.; and
WHEREAS, the DEO provided the Objections, Recommendations, and Comments Report on
October 14, 2021, which identified no objections to the proposed amendment.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. The foregoing recitals are hereby ratified and incorporated by reference as if fully set
forth herein and as the legislative intent of this Ordinance.
Section 2. The City of South Miami Comprehensive Plan is hereby amended as provided in
"Exhibit A", which is attached hereto and made a part of this Ordinance.
Section 3. Corrections: Confonning language or technical scrivener-type corrections may
be made by the City Attorney for any confonning amendments to be incorporated into the final
ordinance.

Rights Element.
BACKGROUND:
Comprehensive Plans are the document through which communities indicate goals, objectives,
and policies that guide decisions about their future development. Florida state law requires that
each local government maintain a comprehensive plan (F.S. Sec. 163.3167). It further provides
the required subjects, or "elements" that must be included (F.S. Sec. 163.3177). Earlier this
summer, Governor DeSantis signed into law a bill (House Bill 59) that requires each local
government include in its comprehensive plan a property rights element to ensure that private
property rights are considered in local decision-making. The relevant portion of House Bill 59
reads as follows:
163.3177 Required and ,optional elements of comprehensive plans; studies and surveys. -

(6) In addition to the requirements of subsections (1) -(5), the comprehensive plan shall include
the following elements:

(ill. In accordance with the legislative intent expressed in ss. 163.3161(10) and
187.101(3) that governmental entities respect judicially acknowledged and constitutionally
protected private propertY rights. each local government shall include in its comprehensive plan
a property rights element to ensure that private property rights are considered in local
decisionmaking. A local government may adopt its own property rights element or use the
following statement of rights:

2. Each local government must adopt a property rights element in its comprehensive plan
by the earlier of the date of its adoption of its next proposed plan amendment that is initiated
after July 1. 2021. orthe date of the next scheduled evaluation and appraisal of its comprehensive
plan pursuant to s. 163.3191. If a local government adopts its own property rights element. the
element may not conflict with the statement of rights provided in subparagraph 1.
The proposed ordinance establishes a new element in the Comprehensive Plan, Property Rights,
and incorporates the provisions of House Bill 59. Since there is a development application
pending that will require a comprehensive plan amendment, staff recommends proceeding with
the adoption of this new element.
The ordinance was approved by the City Commission on first reading on September 7, 2021. As
required by state law, it was then distributed to a variety of state, regional and local agencies for
review and comment. The review period has now passed and none of the agencies expressed any
concern with the proposal.
PLANNING BOARD RECOMMENDATION:
After a public hearing on August 10, 2021, the Planning Board voted unanimously to recommend
approval of the proposed amendment.
STAFF RECOMMENDATION:
Staff recommends approval of the proposed ordinance.

The Department of Economic Opportunity ("Department") has reviewed the proposed
comprehensive plan amendment for the City of South Miami (Amendment No . 21-01ESR) received on
September 21, 2021. The review was completed under the expe dited state review proces s. We have no
comment on the proposed amendment .
The City should act by choosing to adopt, adopt with changes, or not adopt the proposed
amendment . For your assistance, we have en closed the procedures for adoption and transmittal of the
comprehensive plan amendment. In addition, the City is remi nd ed that:
• Section 163.3184(3)(b), F.S., authoriz es other reviewing agencies t o provide comments dire ctly
to the City . If the City receives reviewing agency comments and they are not resolved, these
comments could form the basis for a challenge to the amendment after adoption.
• The second public hearing, which shall be a hearing on whether to adopt one or more
co mprehensive plan amendments, must be held within 180 days of your receipt of agency
comments or the amendment shall be deemed withdrawn unless extended by agreement w ith
notice to the Department and any affected party that provided comment on the amen dment
pursuant to Section 163.3184(3)(c)1., F.5.
• The adopted amendment must be rendered to the Department. Under Section
163 .3184(3)(c)2. and 4 ., F.S ., the amendment effective date is 31 days after the Department
notifies the City that the amendment package is complete or, if challenged , unti l it is found to be
in compliance by t he Departmen t or the Administration Commission.

An Ordinance amending the City of South Miami Comprehensive Plan to create a new Property
Rights Element.
Applicant: The City of South Miami, represented by Ms. Jane Tompkins, AICP (Planning Director)
Mr. Miller read PB-21-012 into the record.
Ms. Tompkins presented the item to the Board.
Mr. Miller asked if there was anything that was being given up by approving the item, to which
Ms. Tompkins stated no. Mr. Pepe stated that the item was the bare minimum required by the
·State. He then added that the State will not accept any future Comprehensive Plan amendments
until this element is a part of the Comprehensive Plan.
Mr. Jacobs asked if there have been any problems regarding the draft ordinance, to which Mr.
Pepe responded no.
Mr. Miller asked if the Board has a choice in the item, to which Mr. Pepe stated no.
Mr. Miller asked if other municipalities are reviewing and adopting this new Comprehensive Plan
amendment, to which Mr. Pepe stated yes.
The Chairperson opened the floor to public comments on PB-21-012 •

Ms. Readon asked if the new element will affect public or private property. Mr. Pepe responded
that the new element would provide rights for private property owners only.
With no further discussion, the Board made a motion on the item.

seconded by Mr. Ms. Readon.

In order to balance the need for the City of South MIaml to function and
conduct vital business during the COVIO 19 pandemlc and, at the same
time. to protect the health, safety and .... 1!I1are of its citizens. officers. officials
and administrative staff. and pursuant City of South Miamt Code. Chapter
286.011. As. Stat. the City's Home Rule Powers. and City Manager's
dedaratlon 01 a state of emergency due to the Coronavirus, the City will be
holding its City Commission Meeting livo In chambors and Vl RTU All Y
through communications media technology (CMTj until the state of emergency
has ended or social dlstancfng Is no klnger roqulmd by any relevant Executive
Orders. All Commission members will participate In Chambers or by video
conferencing through the Zoom platform and membecs of the pubfic may
