A Resolution of the City Commission for the City of South Miami, urging the Miami-
Dade County Board of County Commissioners to condition Mini Warehouse of
Kendall LTD application, Process No: Z21-177, to modify Resolution Z-29-18 on
preserving, retaining and maintaining the existing street barricade blocking ingress
and egress from S.W. 67 Avenue onto S.W. 84 Street and denying it access to and
from SW 84th Street.
WHEREAS, Mini Warehouse of Kendall LTD ("Mini Warehouse") has applied for a non-use
variances of zoning regulations and the deletion of past agreements (restrictive covenants) to develop the
property at 8395 SW 67 A venue with a mixed use building in the Downtown Kendall Urban Center District;
and
WHEREAS, to have the Downtown Kendall Urban Center District continue northward on USI
until it abuts the City of South Miami is not supported by the evidence in the record; and
WHEREAS, the Property Appraiser's aerial map of the area shows that estate residential uses of
the Snapper Creek Court subdivision begin 170 feet to the south of the subject property, and the single
family houses of the Snapper Creek Groves subdivision begin 350 feet to the east of said property; and
WHEREAS, there is a barricade located on SW 84 St parallel to SW 67 Avenue that has been in
existence for approximately 33 years;" and
WHEREAS, Traffic Count Data taken Wednesday December 12, 1984 by the Highway Division
of the Department of Public works is in existence; and
WHEREAS, a letter from neighbor Ron and Elaine Neurhing to Dade County Commissioner Clare
Oesterle dated June 7, 1985 indicated that the barrier was erected May 31, 1985; and
WHEREAS, a letter from Dade County Commissioner Clare Oesterle dated April 10, 1985
acknowledges the Neurhing's work on the road closure and indicates proper steps were taken to officially
close the road; and
WHEREAS, a barricade blocking ingress and egress from S.W. 67 Avenue onto S.W. 84 Street
has been in existence for over 33 years, and appears to have been installed by Miami-Dade County since it
includes a sidewalk separating S.W. 67 th Avenue from S.W. 84th Street and the sidewalk and the barrier has
been effective at keeping traffic on S.W. 67 Avenue from entering the adjacent residential neighborhoods
to the east, which also include the "Snapper Creek" area of the City of South Miami; and
WHEREAS, to the knowledge of the representative of the local residents in 2018, no additional
tragic deaths have occurred since the barricade was erected; and
WHEREAS, in 2001 the City of South Miami spent over $200,000 to build a traffic calming
rotunda in an attempt to calm eastbound traffic on S.W. 84 Street at 59 Avenue; and
WHEREAS, the City of South Miami, in order to protect its residents' health, safety and welfare,
has placed a priority on eliminating cut through traffic and commercial traffic in residential neighborhoods;

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE ClTY OF SOUTH MIAMI, FLORIDA THAT:

lead in any way to allowing future access to and fr o m S W 84th Street becau s e it w ill enco ura ge the intru s ion
of comm e rcial and co mm erc ial-re la ted traffic in a s table re s idential ne ighborhood.
Section 2. The C ity of So uth Miami C ity Co mmi ss ion respectfully reque s t s that the Miami-Dade
Co un ty Board of County Co mm issioners condition th e gra ntin g of the application process no. 22 1-1 77 to
modify Resolution 2 -29-18 o n preserving, retai nin g and maintaining the exist in g s treet barricade blocking
ingres s and egress from S.W. 67 Avenue onto S.W. 84 Street.
Section 3. The C ity Clerk s hall forward a co py of this Resoluti o n to the Miami-Dade Co un ty
Board of County Commissioners.
Section 4. Corrections. Co nformin g lan g uage or technical scrivener-ty pe correction s m ay be
m ade by the City Attorney for any conforming a me ndment s to be incorporated int o the final resoluti o n for
signa tur e.
Section 5. Severability. I f a ny sect io n c la use, se ntence, or phrase of this re so luti on is for any reaso n
held invalid or un constituti ona l by a court of competent juri sdiction , the ho ldin g s ha ll not affec t the validity
of the remaining pOltion s of t hi s re soluti o n.
Section 6. Effective Date. Th is re sol uti o n s hall become effect ive imm ed iat ely up o n
adopt io n by vote of the C ity Co mmis s ion.
