Res No 113-21-15733RESOLUTION NO. 1 13 - 21 -1 5 7 3 3 A Resolution re -appointing Mariano Corral to serve on the Environmental Review and Preservation Board as landscape architect for an additional two-year term ending September 3, 2023. WHEREAS, the Mayor and Commission recognize the important contributions made by those who serve on the various city boards and committees, and wish to appoint a full complement to each of the active boards and committees; and WHEREAS, pursuant to Article VI, section 20-6.1(C)(1)(a)(ii) of the Land Development Code, if the position of landscape architect cannot be filled by a qualified individual who resides or works in the City, the residency requirement may be waived by the Commission; and WHEREAS, the City Commission desires to re -appoint Mariano Corral to serve for an additional two-year term on the Environmental Review and Preservation Board. Appointment shall expire September 3, 2023 or until a successor is duly appointed and qualified, or until removed; and WHEREAS, commencing with appointments made after January 1, 2009, Sec. 2-22 "Term Limits" of the Code of Ordinances provides that, appointees are limited to two (2) consecutive two-year terms of membership on a specific commission, board, or committee. After serving a maximum of two (2) consecutive year terms, an appointee shall not be reappointed to the same commission, board or committee unless at least one year has elapsed between the term limited position and the effective date of commencement of the proposed appointment for a new term; and WHEREAS, pursuant to Sec. 2-22 "Term Limits" of the Code of Ordinances, this will be Mr. Corral's second consecutive two-year term. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, THAT: Section 1. The foregoing recitals are hereby ratified and confirmed as being true and they are incorporated into this resolution by reference as if set forth in full herein. Section 2. The City Commission hereby re -appoints Mariano Corral to the Environmental Review and Preservation Board and waives the residency requirement pursuant to Article VI, section 20-6. 1 (C)(1)(a)(ii) of the Land Development Code. Section 3. The expiration date of this appointment shall be September 3, 2023, or until a successor is duly appointed and qualified, or until removed. Section 4. Corrections. Conforming language or technical scrivener -type corrections may be made by the City Attorney for any conforming amendments to be incorporated into the final resolution for signature. Section 5. Severability. If any section clause, sentence, or phrase of this resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding Page 1 of 2 Res. No. 113-21-15733 will not affect the validity of the remaining portions of this resolution. Section 6. Effective Date. This resolution takes effect immediately upon adoption. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, THAT: Section 1. The City Commission finds that the conditions have been met for extending Mr Mariano Corral's term limits. Mr. Corral's term limits are hereby extended and he is hereby appointed to serve on the Environmental Review and Preservation Board for an additional two-year term. Section 2. The expiration date of this appointment(s) shall be on September 3, 2021, or unless removed earlier. Section 3. This resolution shall take effect immediately upon adoption.
