Res No 127-21-15747RESOLUTION NO.127-21-15747 A Resolution authorizing the City Manager to expend an amount not to exceed $790,000 for Miami Dade County to cover solid waste disposal payments for disposal of solid waste. WHEREAS, the City requires that all contracts for goods and services in excess of $5,000 must be approved by the City Commission; and WHEREAS, the City has an Agreement with the County for utilization of its facility with a disposal of $66.12 per ton, and a transfer fee of $14.46 per ton; and WHEREAS, the City forecasts the expenditure up to $790,000 to Miami Dade County for the procurement of solid waste disposal services for the fiscal year 2021/2022; and WHEREAS, the Agreement provides continued use by the City of the County Solid Waste Management System to satisfy concurrency requirements of the Local Government Comprehensive Planning and Land Development Regulation as it applies to Solid Waste disposal capacity for the Solid Waste which the City collects for disposal, and which is committed to the County for disposal in the County Solid Waste Management System in accordance with the Agreement; and WHEREAS, the expenditure will be charged to the Public Works Solid Waste 001.1720.534.4340 which has an account balance of $790,000 before this request. NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSIONERS OF THE CITY OF SOUTH MIAMI, FLORIDA: Section 1. The foregoing recitals are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution upon adoption hereof. Section 2. The City Manager is authorized to expend an amount not to exceed $790,000 to cover the disposal invoicing for usage of Miami Dade County Facilities for the use of disposal of solid waste for the fiscal year 2021/2022, charged to Solid Waste account number 001.1720.534.4340 which has a current balance of $790,000. Section 3. Corrections. Conforming language or technical scrivener -type corrections may be made by the City Attorney for any conforming amendments to be incorporated into the final resolution for signature. Section 4. Severability. If any section clause, sentence, or phrase of this resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding will not affect the validity of the remaining portions of this resolution. BACKGROUND: The City forecast the expenditure up to $790,000 to Miami Dade County Solid Waste Management for the use of disposal of solid waste through the utilization of the County Resource facility. The agreement provides continued use by the City of the County Solid Waste Management System to satisfy concurrency requirements of the Local Government Comprehensive Planning and Land Development Regulation Act only as it applies to Solid Waste Disposal capacity for the Solid Waste which the City collects for disposal, and which is committed to the County for disposal in the County Solid Waste Management System in accordance with the Agreement. The disposal fee shall be $66.12 per ton delivered to a County Resources Recovery facility for fiscal year 2021-2022 and a transfer fee of $14.46 per ton delivered to the County Solid Waste Management System transfer facility for fiscal year 2021-2022. Pursuant to the Waste Disposal Inter -Local Agreement, I would like to take this opportunity to inform you of the changes to the contract disposal fee and the transfer fee for the 2021-22 Fiscal Year. On September 28, 2021, the Board of County Commissioners approved an increase, by the Bureau of Labor Statistics Consumer Price Index (CPI) of 5 percent (%). However, based on the language in your current disposal agreement, the CPI increase is capped at 4%. Therefore, the tipping fee for the Contract Rate will increase from $63.57 to $66.12 and the Transfer Fee will increase from $13.90 to $14.46. Since the CPI exceeds the 4% cap, the additional 1 % may be applied in future years.
