This letter is in response to my conversations with Mrs. Boatwright, regarding the property
located at 5818WS: ,ttreet. Currently, this property is not occupied; and, no occupational

license has been maintained for the property since September 30, 1994. The last permit for this
property was issued on August 8, 1995, which was issued for painting and pressure cleaning.
On June 5, 1995, zoning approval was granted for occupational licenses at 5818 S.W. 68 Street
for an automotive repair shop. Approval was granted based on the January 30, 1995 expiration
date of the previous license for automotive use (per letter on file); however, no fee was paid and,
consequently, no license was issued. In addition, permits fees have not been paid for the fence.
Section 20-4.4 (A)(6) of the City's Land Development Code states that"No building or land,
used for a non-conforming use,which remains vacant and unused for a continuous period of six
(6) months, whether or not fixtures are removed, shall again be used except in conformity with
the regulations of the district in which such building or land is located." Under sub-section (7)
which follows, an occupational license is identified as the vehicle for the continuation of use.
Pursuant to Section 20-4.4 of the Land Development Code, your property can no longer be used
as an automotive repair facility or similar use. A list of permitted uses is highlighted for you in
the attached Permitted Use Schedule. Your property is currently zoned Low-Intensity Office.
Please, be aware that the City Commission will consider a proposed ordinance which contains
provisions that will again permit automotive repair facilities in the area where your property is
located. The City Commission is scheduled to meet on February 4, 1996, at 7:30 P.M. You
may wish to attend in order to follow the process, and you may wish to speak regarding your
property under the Remarks section at the end of the meeting. This ordinance, if approved by
the City Commission, will proceed to the Planning Board for Public Hearing in March and will
return for Public Hearing before the City Commission and for final consideration in April, 1997.
