Ord No 25-21-2415Ordinance No. 25-21-2415 An Ordinance related to the fee schedule; amending Ordinance No. 15-21- 2405 to establish fees for Boardinghouses and Hotel/Motel. WHEREAS, the Mayor and Commission adopted the City's "Schedule of Fees and Fines," which includes the fees established for various local business licenses; and WHEREAS, the Commission may amend the Land Development Code to redefine the word "Boardinghouse" and to add it to the list of uses permitted in the Hometown Overlay District; WHEREAS, "Boardinghouses" are not provided for in the current "Schedule of Fees and Fines" and staff recommends that the use be added to the schedule. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: Section 1. The foregoing recitals are hereby ratified and incorporated by reference as if fully set forth herein and as the legislative intent of this Ordinance. Section 2. The Schedule of Fees and Fines, as approved in Ordinance No. 15-21-2405, is hereby amended and shall read as follows: COLLECTIONS FEE SCHEDULE Description CODE Fee Local Business Tax RESIDENTIAL USE (Apartments only) Up to 5 Units 100 $91.16 6 to 50 Units 101 $158.03 51 to 100 Units 102 $243.11 101 to 200 Units 103 $303.88 201 to or More Units 104 $364.65 BOARDINGHOUSE (per unit) 105 $150 HOTEL/MOTEL 106 $7.500 Section 3. Any such fees may be waived or reduced by the Mayor and City Commission by way of Resolution. Section 4. Corrections. Conforming language or technical scrivener -type corrections may be made by the City Attorney for any conforming amendments to be incorporated into the final ordinance for signature. Section 5. Ordinances in Conflict. All ordinances or parts of ordinances and all sections and parts of sections of ordinances in direct conflict herewith are hereby repealed. Section 6. Severability. If any section, clause, sentence, or phrase of this ordinance is for any reason Page 1 of 2 Ord. No. 25-21-2415 held invalid or unconstitutional by a court of competent jurisdiction, this holding will not affect the validity of the remaining portions of this ordinance. Section 7. Effective Date. Tompkins, AICP, Planning Director DATE: September 21, 2021 SUBJECT: An Ordinance related to the fee schedule; amending Ordinance No.15-21-2405 to establish fees for Boardinghouses and Hotel/Motel. BACKGROUND: Boardinghouses and Hotel/Motel are permitted to operate within the City of South Miami. Currently, though, the City's Schedule of Fees does not include these uses in the list of Local Business Tax fees. Staff could not find records of any licensed boardinghouses to determine how much they might have been charged previously. Further, the only hotel operating in South Miami has historically been charged as a Residential Use. ANALYSIS: During the first reading of an ordinance amending the Land Development Code to allow boardinghouses in the Hometown District Overlay, the Commission discussed the need to establish a fee for such use. Upon discussion on first reading of the proposed ordinance amending the fee schedule, the Mayor and Commission voted in favor of a fee of $250 per unit for a boardinghouse and staff recommends $2,500 flat fee for a hotel/motel.
