An Ordinance related to the fee schedule; amending Ordinance No. 12-21-2402 to revise
descriptive language, to edit existing fees, and to add new fees to the schedule.
WHEREAS, the Mayor and Commission adopted the City's "Schedule of Fees and Fines,"
which includes descriptive language, various fees the City charges for services, and fines for code and
parking violations; and
WHEREAS, as illustrated in Table A below, staff recommends revisions to the current
descriptive language and a new fee related to Personal Trainers/Instructors who desire to conduct
one-on-one training at the Gibson -Bethel Community Center —Fitness Center, effective on Friday,
October 1, 2021; and

_gymnasium indoor basketball court(s). The indoor basketball court
is available during public open gymnasium hours —hours of
operation may vary depending on the seasons and may be subiect
to change.
WHEREAS, the proposed Fitness Center and Gymnasium Membership Pass entails access to
the strength and cardio rooms as well as the indoor basketball gymnasium at the Gibson -Bethel
Community Center. Staff recommends combining both amenities into a membership to entice new
customers to sign up and to offset operating and personnel cost associated with maintaining and
staffing the indoor gymnasium during peak basketball play hours; and
WHEREAS, there has been an uptick in individual personal trainers/instructors utilizing the
fitness center at the Gibson -Bethel Community Center. Staff recommends requiring individual
personal trainers/instructors to apply for an annual permit in the amount of $600.00; and

WHEREAS, there has been a steady demand for private instruction tennis rentals at Brewer
Park and Marshall Williamson Park over the past year, which results in further wear and tear on city
facilities and overall city resources. Illustrated below in Table B, staff recommends a new Private
Instructor rental fee ($20 per hour) for organized training and a modest increase for non-residents
($9 per hour) and not -for -profits ($4 per hour) at both sites.

NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY
OF SOUTH MIAMI, FLORIDA THAT:
Section 1: The foregoing recitals are hereby ratified and incorporated by reference as if fully
set forth herein and as the legislative intent of this Ordinance.
Section 2: The Schedule of Fees and Fines, as approved in Ordinance 12-21-2402, is hereby
amended and shall read as follows:.

Section 3: Any such fees may be waived or reduced by the Mayor and City Commission by
way of Resolution.
Section 4: Corrections. Conforming language or technical scrivener -type corrections may be
made by the City Attorney for any conforming amendments to be incorporated into the final
ordinance for signature.
Section 5: Severability. If any section, clause, sentence, or phrase of this ordinance is for any
reason held invalid or unconstitutional by a court of competent jurisdiction, this holding will not
affect the validity of the remaining portions of this ordinance.
Section 6: Ordinances in Conflict. All ordinances or parts of ordinances and all sections and
parts of sections of ordinances in direct conflict herewith are hereby repealed.
Section 7: Effective Date. This ordinance will become effective on Friday, October 1, 2021.

operation may vary depending on the seasons and may be subject
to change.
Fitness Center & Gymnasium Membership Pass
The proposed Fitness Center and Gymnasium Membership Pass entails
access to the strength and cardio rooms as well as the indoor basketball
gymnasium at the Gibson -Bethel Community Center. If approved, a
membership pass would be required to access both facilities whereas
presently only an active membership is required to utilize the Fitness
Center. Staff recommends combining both amenities into a membership
to entice new customers to register and to offset operating and personnel
cost associated with maintaining and staffing the indoor gymnasium
during peak hours of basketball play.
Fitness Center Personal Trainer
City staff has experienced an uptick in individual personal
trainers/instructors utilizing the fitness center at the Gibson -Bethel
Community Center. Staff recommends requiring individual personal
trainers/instructors to apply for an annual permit in the amount of
$600.00.
The proposed permit fee is for a one-year permit beginning October 11
through September 30". If a permit is granted after October 1s`, the permit
fee shall be prorated, as appropriate, for each month remaining in the
fiscal year. Additional information related to and required by individual
personal trainers/instructors such as conditions of permit, approved
equipment, documentation (i.e. resume) and background check,
applicable license(s) and certification(s), indemnification and insurance,
rules, regulations and guidelines will be outlined accordingly in the
Department's Individual Personal Trainers/Instructors Handbook.

In order to balance the need for the City of South Miami to function and
conduct vital business during the COVID 19 pandemic and, at the same
time, to protect the health, safety and welfare of its citizens, officers, officials

drugs that wash ashore
continues.
This time, a 2.7-pound
brick of cocaine was
found by a "concerned
citizen" near Little Torch
Key in the Lower Keys on
Tuesday, according to
U.S. Border Patrol spokes-
man Adam Haffner.
The person notified
local authorities, who
turned the brick over to
Border Patrol agents.
The cocaine isworth
about $61,000 on the
street, Haffner said.

in a statement, noting the
