Ord No 12-21-2402Ordinance No. 12-21-2402 An Ordinance related to the fee schedule; amending Ordinance 03-21-2393 to add new fees related to the payment -in -lieu option for solar panels, to amend the fees for zoning verification letters, and to add a new fee category. WHEREAS, on February 2, 2021, the City Commission adopted Ordinance No. 03-21-2393 which amended the City's adopted Fee Schedule; and WHEREAS, the Commission has adopted an amendment to the Land Development Code allowing for a payment into a trust fund in lieu of installing solar photovoltaic systems on certain new construction; and WHEREAS, the Planning and Zoning Department wishes to make additional changes to the Fee Schedule to clarify the application fees for Variances, to clarify the provisions for Zoning Verification Letters and to add a new category, Land Development Code Interpretation Letters, to reflect requests which require extensive research and analysis; and WHEREAS, the City Commission wishes to revise the adopted Fee Schedule as presented. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: Section 1. The Schedule of Fees and Fines, as approved in Ordinance 03-2102393, is hereby further amended to revise the Building Permit Fees to add a payment -in -lieu of solar panels as follows: BUILDING PERMIT FEES SCHEDULE SECTION A — BUILDING PERMIT FEES Description Fee REINSPECTION FEE Each $50 PAYMENT -IN -LIEU OF SOLAR PANELS Per square foot of available solar zone 25 Section 2. The Finance Department is hereby instructed to establish a Solar Collector Trust Fund, the purpose of which is to invest in the acquisition and development of solar collectors on City -owned properties; and Page 1 of 3 Res. The Schedule of Fees and Fines, as approved in Ordinance 03-21-2393, is hereby further amended to revise the Planning and Zoning Fee Schedule as follows: PLANNING AND ZONING FEE SCHEDULE Description Fee VARIANCES* Request to reduce standard by 10% or less $2,000 Request to reduce standard by more than 10% but less than 20% $3,000 Request to reduce standard by more than 20% $4,000 Request for non -quantifiable regulations $3,000 Each extension request $500 * If more than one request is submitted on an application, then the fee for the second and any successive requests are reduced by $1,500. * * * LETTERS Condominium conversion letter $1,000 Flood Zoning letter $100 Zoning and land use verification letter per folio (basic information) $100 Land Development Code interpretation letter $200 Section 4. Corrections. Conforming language or technical scrivener -type corrections may be made by the City Attorney for any conforming amendments to be incorporated into the final ordinance for signature. Section S. Severability. If any section, clause, sentence, or phrase of this ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, this holding will not affect the validity of the remaining portions of this ordinance. BACKGROUND: The Land Development Code (LDC) requires the installation of solar collectors on certain new construction. Several property owners have objected to the requirement, and staff was asked to draft an option for property owners to pay into a trust fund in place of installing the system. An ordinance amending the LDC to create the payment -in -lieu option is presented concurrently with this ordinance. REQUEST: To amend the Fee Schedule to establish the Solar Collector Trust Fund and establish a fee of $50.00 per square foot of available solar zone. Planning Department staff also requests additional amendments to clarify the Variance application fee and the Zoning Verification Letter fee, and to add a new category, Land Development Code Interpretation Letters, which require more extensive research and analysis than the typical Zoning Verification Letter. STAFF RECOMMENDATION: Staff recommends approval of the proposed ordinance.
