Res No 089-21-15709RESOLUTION NO.089-21-15709 A Resolution pursuant to Section 20-8.9 and other provisions of the City of South Miami Land Development Code approving a Special Exception for a large-scale development on a 6.6-acre property identified as folio numbers 09-4025-063- 0010 and 09-4025-063-0020 generally located along SW 68th Street and as legally described herein. WHEREAS, the applicant, Residences at SoMi Parc, LLC, submitted an application requesting a Special Exception approval for a Large -Scale Development for a mixed -use project located at 5949 and 5941 SW 681h Street; and WHEREAS, the property is legally described as: Tract C, "University Gardens Subdivision No. 3", according to the Plat thereof, as recorded in Plat Book 102, Page 19, of the Public Records of Miami Dade County, Florida And Tract D, "University Gardens Subdivision No. 3", according to the Plat thereof, as recorded in Plat Book 102, Page 19, of the Public Records of Miami Dade County Florida; and WHEREAS, the site consists of 6.6 acres and the proposed development will provide 476 residential units and 15,160 square feet of commercial space; and WHEREAS, pursuant to Land Development Code (LDC) Section 20-8.9 Special exceptions, any site that is in excess of 40,000 square feet or any development in excess of four (4) stories, shall be designated as a Large Scale Development and reviewed by the Planning Board and shall require approval by the City Commission; and WHEREAS, at its July 13, 2021 meeting, the Planning Board held a public hearing on the application, considered each of the requirements and conditions for Large Scale Development listed in Section 20-8.9 of the LDC, and voted unanimously to recommend approval of the requested Special Exception; and WHEREAS, Section 20-8.9 (C) requires that all uses in a large scale development must comply with the following general requirements and any other requirements that the City Commission may consider appropriate and necessary. 1. All such uses shall comply with all requirements established in the appropriate zoning use district, unless additional or more restrictive requirements are set forth below or by the City Commission. Page 1 of 5 Res. No. 089-21-15709 2. All such uses must be of a compatible and complementary nature with any existing or planned surrounding uses. 3. The City Commission shall determine the overall compatibility of the development with the existing or planned surrounding uses; and WHEREAS, Section 20-8.9 (C) requires that the development will: 1. Not adversely affect the health or safety of persons residing or working in the vicinity of the proposed use; 2. Not be detrimental to the public welfare, property or improvements in the neighborhood; and 3. Complies with all other applicable Code provisions; and WHEREAS, the Mayor and City Commission of the City of South Miami, having considered each of the Special Exception requirements and conditions and having found that those conditions have been met, desire to approve the application for the Special Exception. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: Section 1: The recitals set forth in this resolution are true and they are supported by competent substantial evidence and they are incorporated into this resolution by reference as if set forth in full herein. Section 2. The application submitted by Residences at SoMi Parc, LLC, requesting a Special Exception for a Large Scale Development for a mixed -use building consisting of commercial and residential uses within the TODD (MU-5) zoning district located at 5941 and 5949 SW 68th Street, South Miami, Florida, complies with the requirements of 20-8.9 (C) and (D) and is hereby approved with the following conditions: General Conditions 1. The proposed development will be substantially built in accordance with the documents submitted as the application package, including: Letter of Intent; SoMi Parc Planning Board Submittal Set of Plans prepared by Civica Architecture and Urban Design (signed and sealed by Registered Architect Rolando Llanes on June 29, 2021) and Gardner Semler Landscape Architecture (signed and sealed by Registered Landscape Architect Taylor Kiehl Semler on June 29, 2021); and Traffic Impact Study prepared by Kimley-Horn and Associates, LLC (April 2021). 2. All documents submitted with this application are to be made a part of the record. Page 2 of 5 Res. No. 089-21-15709 3. All off -site improvements required under any approvals shall be completed prior to the first Certificate of Occupancy unless such deadline is extended by the City Manager. 4. Any improvements in the Public Right -of -Way shall be approved by the City of South Miami. 5. All impact fees shall be paid by the Applicant prior to issuance of the building permit. 6. The Applicant shall provide a letter acknowledging compliance with the applicable Level of Services requirements prior to the issuance of final permit to the property. If any concurrency approvals expire a re -review shall be required by the appropriate agency. 7. Any changes that increase densities, intensities or population shall require a new Concurrency Analysis. 8. Flood elevations shall be reviewed and approved for consistency with FEMA requirements and the City's National Flood Insurance Program Ordinance prior to building permit approval. 9. The Applicant shall comply with applicable conditions and requirements by Miami -Dade County Public Works Department, Fire Rescue Department, Department of Regulatory and Economics Resources - DERM (DRER), and Miami -Dade County Water and Sewer Department, if any. 10. Plans shall be submitted for review and approved by the Environmental Review and Preservation Board prior to the issuance of building permits. 11. The plans shall comply with the Green Building requirements of Section 20-8.13(A). 12. A restrictive covenant for the perpetual maintenance for the public plaza on SW 615t Court shall be recorded with Miami Dade County in a form approved by the City Attorney pursuant to Section 20-8.15(A). 13. A Unity of Title shall be recorded with Miami Dade County in a form approved by the City Attorney. Construction Conditions 14. A Construction and Maintenance of Traffic (MOT) Plan shall be provided by the Applicant to the Building and Public Works Departments for approval prior to start of construction. Access points by construction vehicles shall be provided within the MOT. 15. The Applicant shall provide for the reconstruction of the adjoining roadways, sidewalks and drainage to their conditions prior to construction, or better, and to provide a Page 3 of 5 Res. No. 089-21-15709 performance bond equal to 100% of the total cost of reconstruction, or such other amount as determined appropriate by the City Manager. 16. The Applicant shall provide a Construction Air Quality Management Plan to the Department prior to the start of construction. 17. A Construction, Demolition and Materials Management Plan (CDMMP) must be submitted by the Applicant at time of building permit. 18. Construction shall only take place Monday through Friday during the hours of 8:00 a.m. and 5:00 p.m. Landscaping Conditions: 19. The Applicant shall meet all of the minimum requirements of the City Code, Chapters 18 and 24 of the Miami -Dade County Code and specifically comply with all conditions imposed by Miami -Dade County Department of Regulatory and Economic Resources - DERM (DRER), if any. 20. The property shall be landscaped in substantial accordance with the landscape plan included in the application package. 21. Pursuant to Sec. 20-4.5, as may be amended, the Applicant shall preserve existing trees (including native trees) during the development of the project, wherever possible. If the trees must be removed, the Applicant shall be required to submit a tree removal permit and mitigate the impact in accordance with City requirements. If the relocated trees do requirements. Environmental Conditions: 22. The Applicant shall meet the requirements of the Miami -Dade County Water -Use Efficiency Standards Manual, effective January 2009, as may be amended from time to time. 23. All storm water drainage systems shall be maintained in working order at all times in order to avoid localized flooding during and after a storm. Architecture Conditions: 24. Conforming language or technical scrivener -type corrections may be made by the City Attorney for any conforming amendments to be incorporated into the final resolution for signature. Section 4. Severability. If any section clause, sentence, or phrase of this resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding will not affect the validity of the remaining portions of this resolution. APPLICANT Residences at SoMi Parc, LLC PROPERTY INFORMATION Owned by Miami -Dade County (MDC) and known as South Miami Gardens, the site consists of two parcels and is developed with fifteen (15) two-story buildings containing fifty-eight (58) public housing units that were built in the mid-1970s. Bounded by SW 68' Street, SW 5811 Place, SW 6711 Street, SW 66' Terrace and SW 61s` Drive, the entire site is approximately 6.6 acres in size. SW S9` Place separates the two (2) parcels. The property was rezoned in 2019 to Transit Oriented Development District Mixed -Use 5 (TODD (MU-5) to facilitate redevelopment and create a mixed -income community that included additional affordable and workforce housing and market rate units along with new commercial space. This zoning change boosted the apartments' ranking in the County's list of redevelopment projects, and helped make the project more appealing to potential developers. Related Urban Development Group, LLC (RUDG) was selected as the lessee. RUDG has partnered with the County on other redevelopment projects that have resulted in 1,963 units of new affordable and workforce housing. Residences at SoMi Parc, LLC, a subsidiary of RUDG, has now subleased the property and is the Applicant for this request. THE PROJECT The application was submitted to allow the development of a multi -building, mixed -use project containing 478 residential units and 15,160 square feet of commercial space (please refer to the PDF of the plans which is entitled, "SoMi Parc Planning Board Submittal Set of Plans" or the 11"x17" paper copy for full details). The Plans are broken out as follows: * Detailed information about the project is provided on Sheets SP-1, SP-2, and SP-3. * Floor plans for each building along with a breakdown of the units by type (i.e., number of bedrooms), the number of each unit type provided, the minimum size required by code, and the actual size provided are shown on Sheets FP-1 through FP-9 * Renderings of each building facade, street cross -sections, and aerial renderings and shown on Sheets EL-1 through EL-6 show. * Minor construction details are shown on Sheet DT-1. * The tree disposition information, landscape plans, hardscape materials, plant information and planting details are given Sheets LA-101, -102, -201, -202, - 301, -401, - 402, -403, -501, -502, -503, and -504). The western parcel will contain three buildings: a seven -story mixed -use building consisting of residential and ground floor commercial ("Building A") that fronts SW 59th Place; a three-story residential building that fronts SW 615t Court ("Building B"); and a second three-story residential building that fronts SW 66th Terrace ("Building C"). Three public plazas, a private playfield, a shade pavilion, and a tot lot complete the site. Between the three buildings, a total of 172 residential units will be provided on this parcel. Building A will also include loading berths, bicycle parking, and 215 parking spaces. The eastern parcel will also be developed with three buildings: a seven -story mixed -use building consisting of residential and ground floor commercial space that fronts onto SW 681h Street ("Building D") and two buildings each containing ten two-story townhomes fronting onto SW 67th Street (collectively identified as "Building E"). Another plaza and swimming pool complete this parcel. This parcel will provide a total of 306 residential units. Building D will include loading berths, bicycle parking and 422 parking spaces. 41Pago, e 6 Residences at SoMi Parc Special Exception for Large Scale Development August 3, 2021 Page 5 of 13 According to the Applicant, the project will be a mix of apartment units that qualify as Affordable or Workforce and Market Rate(see Terminology table on SP-1). Affordable is described as income that's 80% of area median income (AMI) or less and Workforce is 80-120% of Affordable Housing means a AMI. These categories are comparable to the Low -Income and Rent -Restricted Unit that is only Moderate -Income definitions in the South Miami Land made available for rent to Very Development Code (LDC) (please see text box for more details). Low -Income Tenants. Low - The townhomes, according to the Applicant, will be sold Income Tenants, or Moderate - individually at market rate. Income Tenants. Workforce Housing means a Rent -Restricted units that are occupied by ANALYSIS Moderate -Income Tenants. All new development must comply with the specific regulations of the applicable zoning district. The maximum change in level between any portion of a sidewalk shall be one-half (%:) inch, and must be beveled, with a slope no greater than 1V:2H (2:1). For developing "cross-thru's" from an One additional floor adjoining street to a public open space as part of the public pedestrian walk system, on owner's property (maintenance required in Section 20-8.15) Staff Response: The project meets the minimum height of two -stories. The Applicant seeks approval for seven stories on buildings A and D, each with a maximum height of 86 feet. The Actions included in the project that make it eligible for seven stories include: (1) A floor of residential use; (2) A public plaza; and (3) Full frontage of the property with streetscape design. The plaza that meets the Action of Sec. 20-8.10 is located along SW 61st Court, between buildings A and B. Several other plazas area scattered throughout the two parcels, but do not meet the minimum requirements. The east side of Building A, fronting SW 591h Place, and the south side of Building D, fronting SW 68th Street, are designed as part of the pedestrian walkway system, with awnings and ground floor uses that engage pedestrians. 6 1 P a a e 8 Residences at SoMi Parc Special Exception for Large Scale Development August 3, 2021 Page 7 of 13 3. Minimum Floor Area for Residential Units: Efficiency/Studio 290 sf One Bedroom 550 sf Two Bedroom 700 sf Three Bedroom 850 sf Staff Response: The proposed minimums are 430 sf, 655 sf, 875 sf, and 1,180 sf respectively which complies with the code. 4. Density. As many units as can be provided with parking as required by Sec. 20-8.8. A minimum density of fifty (50) units per net acre shall be provided. Staff Response: The project complies. As noted below, the project provides sufficient parking for the 478 proposed units. According to the survey, the two parcels combined total 6.6 acres; thus, the minimum density is 330 units. S. Location of Residential Units: Allowed on all floors. Staff Response: The project complies. 6. Affordable Housing: At least ten percent (10%) of the new dwellings. Staff Response: The project will produce 420 new dwelling units (478 proposed minus 58 existing units). With 196 units qualifying as Affordable (available to those at the 80% of AMI or below), the project far exceeds the ten percent minimum required. 7. Location of Commercial Uses: Allowed on all floors. Staff Response: The project complies. 8. Required Parking by Use: Land Use Type Min. Max. Based on the table above, the project is required to provide between 437 and 588 spaces for the residential units, and 51 spaces for the commercial uses, for a total ranging from 488 to 639 spaces. Required Bicycle Parking: Commercial uses: 1 bicycle parking space/1,000 sf Residential uses: 1 bicycle parking space/15 vehicular spaces required Staff Response: With 54 bicycle parking spaces, the project complies. 10. Sec. 20-8.17 Regulating plan — Graphic: TODD developments must adhere to the provisions of Sec. 20-8.17 in terms of the building's placement on the property, setbacks, stepbacks, and open space. Staff Response: The project complies with Sec. 20-8.17. Special Exception for a Large -Scale Development: Section 20-8.9(C) of the LDC provides the following general requirements for a Large -Scale Development (LSD): (1) All such uses shall comply with all requirements established in the appropriate zoning district, unless additional or more restrictive requirements are set forth below or by the City Commission. (2) All such uses must be of a compatible and complementary nature with any existing or planned surrounding uses. (3) The City Commission shall determine the overall compatibility of the development with the existing or planned surrounding uses. Staff Response: The project complies. The uses comply with the TODD (MU-5) district and the area is already a mix of multi -story, multi -family buildings and small commercial uses similar to what's proposed. Properties to the south and east have the same designations on the Future Land Use and Zoning maps, and further development of this nature is anticipated. Section 20-8.9(D)(a) further provides that the City Commission must find that the development also: (1) will not adversely affect the health or safety of persons residing or working in the vicinity of the proposed use; (2) will not be detrimental to the public welfare, property or improvements in the neighborhood; and (3) complies with all other applicable Code provisions. Staff Response: Staff believes that the project meets standards (1) and (2). Compliance with standard (3) is described below, in Other Land Development Code Regulations. Pursuant to Sec. 20-8.9(I), the Commission has the discretion to condition the granting of a Special Exception on an agreement with the Applicant which includes all the conditions of approval ("Development Agreement'). A separate agreement or covenant that provides for 8 1 P a a e 10 Residences at SoMi Parc Special Exception for Large Scale Development August 3, 2021 Page 9 of 13 maintenance of common elements and any other condition specified as a prerequisite to approval of the Special Exception shall also be signed by the owner. Staff Response: Staff recommends that a Development Agreement be executed as well as a maintenance covenant for the Public Plaza. After this review, staff believes that the SoMi Parc application as proposed is consistent with Article Vlll, Sections 20-8.1 through 20-8.17, and complies with the general requirements of Special Exceptions (Section 20-8.9) of the Land Development Code. Other Land Development Code Requirements Landscape Plan: Sections 20-4.5 and 20-4.5.1 detail the requirements for landscape plans and tree removals. In general, the plans, as evidenced by the tables on Sheet LA-401 indicate compliance with a few minor exceptions that can be easily addressed. This will be included as a recommended condition of approval. Concurrency Analysis: An analysis of public facilities and services is required when a development permit is issued (LDC Sec. 20-4.1(A)). The analysis ensures that the additional residents generated by a new development can be provided with the appropriate level of public services. The attached exhibit demonstrates that the project complies with, or is expected to comply with, the adopted level of service standards. Traffic Study: As part of the application package, a Traffic Impact Analysis was prepared by Kimley-Horn and Associates, Inc. (dated April 2021). Xavier Falconi of Calvin Giordano and Associates reviewed it on behalf of the City. Currently, there are only minor issues with the width of the driveways and interior directional signage in Buildings A and D. South Miami Community Advisory Committee Recommendations Miami Dade County has established a series of Community Advisory Committees (CAC) to help foster and sustain civic engagement in various targeted areas of the county. The committees are made up of community residents and are given the opportunity to identify community conditions and needs, develop and implement plans, and monitor their effectiveness in improving the conditions in which low-income people live. The subject property is within the jurisdiction of the South Miami CAC. The South Miami CAC reviewed the project on May 20, 2021 (see attached meeting minutes). The Applicant indicated a commitment to providing a number of community benefits such as job 91Paue 11 Residences at SoMi Parc Special Exception for Large Scale Development August 3, 2021 Page 10 of 13 training programs. Further dialogue between the CAC, MDC and the Applicant will occur to further define these commitments. Planning Board Recommendation: Following a public hearing on July 13, 2021, the Planning Board voted unanimously to recommend approval of the application with Staff's conditions. RECOMMENDATION: Staff recommends approval of the Special Exception for a Large -Scale Development with the following conditions: General Conditions l .
