A Resolution authorizing the City Manager to execute a Renewal to the Department Funded
Agreement (DFA) with the Florida Department of Transportation (FDOT) for turf landscape
maintenance funding in the amount of $3,980.
WHEREAS, the Mayor and City Commission desire to accept the Department Funded Contract Renewal
Agreement (DFA) with the Florida Department of Transportation (FDOT) for turf and maintenance funding in the
amount of $3,980 which will be utilized for South Dixie Highway / US#1 (State Road 5) from SW 80th Street to SW
57th Avenue; and
WHEREAS, the parties are authorized to enter into this agreement pursuant to Section 339.08(e) and
339.12, Florida Statutes (F.S.); and
WHEREAS, South Dixie Highway / US#1 (State Road 5) is an FDOT Roadway and the Department has
programmed funding under Financial Project Number 403394-5-78-01 and has agreed to reimbursement funds to
the City for maintenance; and
WHEREAS, this renewal is for a term of one (1) year beginning on the effective date of this agreement,
which shall be the date reflected on the written notice to proceed; and
WHEREAS, this agreement allows the City to continue to provide turf and landscape maintenance services
along South Dixie Highway / US#1 (State Road 5) from SW 80th Street to SW 57th Avenue with compensation; and
WHEREAS, the Mayor and City Commission desire to authorize the City Manager to execute a Department
Funded Contract Renewal Agreement (DFA) with the Florida Department of Transportation (FDOT) for turf
landscape maintenance funding in the amount of $3,980. This Department reimbursement amount is based on a
standard formula for maintenance within the FDOT ROW. A copy of the Agreement is attached.
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSIONERS OF THE CITY OF SOUTH
MIAM1, FLORIDA:
Section 1. The foregoing recitals are hereby ratified and confirmed as being true and they are incorporated
into this resolution by reference as if set forth in full herein.
Section 2. The City Manager is authorized to execute a Department Funded Contract Renewal Agreement
(DFA) with the Florida Department of Transportation (FDOT) for turf landscape maintenance funding in the amount
of $3,980. This Department reimbursement amount is based on a standard formula for maintenance within the
FDOT ROW. A copy of the Agreement is attached.
Section 3. Corrections. Conforming language or technical scrivener -type corrections may be made by the
City Attorney for any conforming amendments to be incorporated into the final resolution for signature.
Section 4: Severability. If any section, clause, sentence, or phrase of this resolution is for any reason held
invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the
remaining portions of this resolution.
Section 5: Effective Date: This resolution shall become effective immediately upon adoption.

SUBJECT: A Resolution authorizing the City Manager to execute a Renewal to the Department
Funded Agreement (DFA) with the Florida Department of Transportation (FDOT) for turf
landscape maintenance funding in the amount of $3,980.
BACKGROUND: The Mayor and City Commission desire to renew the Department Funded Agreement
(DFA) with the Florida Department of Transportation (FDOT) for turf and maintenance
funding in the amount of $3,980 which will be utilized for South Dixie Highway / US#1
(State Road 5) from SW 80th Street to SW 57th Avenue. The renewal is for a term of
one (1) year beginning on the effective date of this agreement, which shall be the date
reflected on the written notice to proceed. Any such renewal shall be subject to the
same terms and conditions set forth the Agreement and shall be contingent upon both
satisfactory performance evaluation by FDOT and the availability of funds. The
agreement may be extended if mutually agreed in writing by both parties, for a period
not to exceed six (6) months and shall be subject to the same term and conditions set
forth in the agreement.
The Department agrees to compensate the City up to the maximum participating
eligible annual amount of $3,980 for completion of the services in the Agreement. This
reimbursement amount is based on a standard formula for maintenance within the
FDOT ROW.
South Dixie Highway / US#1 is an FDOT Roadway, and this agreement is a
reimbursement of funds to the City for maintenance.
AMOUNT: $3,980. The Department has programmed funding under Financial Project Number
403394-5-78-01 Contract No. ASE63.

landscape within the right of way on the State Roads described in "Exhibit A" of the orlalnal contract: and
WHEREAS, said Agreement has a renewal option which provides for a renewal if mutually agreed to by both parties
and subject to the same terms and conditions of the original Agreement;
NOW, THEREFORE, this Agreement witnesseth that for and in consideration of the mutual benefits to flow each
to the other, the parties agree to a renewal of said original Agreement for a period beginning the 2 day of October, 2021 and
ending the 1 day of October, 2022 at a cost of $3.980.00.
All terms and conditions of said original Agreement shall remain in force and effect for this renewal.

The Department and the City of South Miami have executed a contract for the Department
Funded Agreement (DFA) noted above for a period of one (1) year starting October 2, 2021
