Res No 057-21-15677RESOLUTION NO. 057-21-15677 A Resolution relating to budget; authorizing a transfer of $78,000 from the Federal Forfeiture Fund Computer Equipment account to the Federal Forfeiture Fund Contractual Services account for the Phase I Conceptual design costs for the new City of South Miami Police Headquarters and Emergency Operation Center (EOC). WHEREAS, On January 19, 2021, the City Commission adopted Resolution No. 008-21- 15628, authorizing the City's Administration to allocate $2,000,000 ($1,500,000 from General Fund and $500,000 from Federal Forfeiture Fund) for the Design and Construction of the City's New Police Station using the residual amount of fund balance amount for each respective fund, and, WHEREAS, it is requested that the budget for Contractual Services be increased by $78,000 from account No. 615.1910.521.5205 Federal Forfeiture Computer Equipment; and, WHEREAS, the funds from the Federal Forfeiture Contractual Services account line item will be used to pay for $89,854 in Phase I conceptual design costs for a new City of South Miami Police Headquarters; and, WHEREAS, the Mayor and City Commission desire to transfer sufficient funds from account No. 615.1910.521.5205 Computer Equipment, with a current balance of $84,000, to account No. 615.1910.521.3450, Contractual Services, with a current balance of $97,831.19. NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT; Section 1. The foregoing recitals are hereby ratified and confirmed as being true and they are incorporated into this resolution by reference as if set forth in full herein. Section 2. The City Manager is hereby authorized to transfer sufficient funds in the amount of $78,000 from account No. 615.1910.521.5205 Computer Equipment, with a current balance of $84,000, to account No. 615.1910.521.3450, Contractual Services, with a current balance of $97,831.19. Section 3. Corrections. Conforming language or technical scrivener -type corrections may be made by the City Attorney for any conforming amendments to be incorporated into the final resolution for signature. Section 4. Severability. If any section clause, sentence, or phrase of this resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding will not affect the validity of the remaining portions of this resolution. WHEREAS, for the past few years, the City of South Miami has researched options for replacing the current Police Station. After many months of research and contemplation, the City's staff believes construction of a new police department with an EOC is warranted at the Cis Old Inspection Site (5890 SW 69th Street) which remains vacant.; and WHEREAS, the City's Administration is requesting Mayor and Commission's approval to allocate $2,000,000 ($1,500,000 from General Fund and $500,000 from Federal Forfeiture Fund) for the Design and Construction of the City's New Police Station using the residual amount of fund balance amount for each respective fund. This amount would be subject to a purpose constraint that represents an intended use established by the City's designated elected body; and WHEREAS, the Federal Forfeiture rules provide for costs associated with the purchase, lease, construction, expansion, improvement, or operation of law enforcement, public safety, or detention facilities used or managed by the recipient agency as allowable; and WHEREAS, it is important to note, should any need occur, or the project not come to fruition, the City Manager has the authority to reassign the monies, as needed; and WHEREAS, with the Commission's approval, the City may apply for grants and use the monies as match and to show grantor agencies that the City is dedicated in constructing a New Police Station.
