RESOLUTION NO.045-21-15665 A Resolution authorizing the City Manager to permit Urban Oasis Project, Inc. to continue hosting a Farmers' Market at City Hall for one (1) year, beginning April 24, 2021 through April 2-3, 2022 and to waive all special events fees. WHEREAS, Urban Oasis Project, Inc. ("the applicant"), a 501(c)(3) organization, has requested to continue hosting a Farmers' Market on the east parking lot of City Hall every Saturday for one (1) year, beginning Saturday, April 24, 2021 through Saturday, April 23, 2022 from 9:00 a.m. to 2:00 p.m.; and WHEREAS, pursuant to Resolution No.130-20-15570, the applicant was approved to host its Farmers' Market for six (6) months ending on Saturday, April 10, 2021. WHEREAS, the applicant is requesting a waiver for the following city services in the amount of $50,482.50; and CITY SERVICES AMOUNT PARKING METERS ($75 X 8 METERS X 53 DAYS) $31,800 POLICE DEPARTMENT-1 OFF -DUTY OFFICER ($352.50 PER DAY X 53 DAYS) $18,682.50 TOTAL AMOUNT REQUESTED TO BE WAIVED $50,482.50 WHEREAS, all vendors and customers are expected to follow all CDC recommended guidelines, Miami -Dade County Emergency Orders and City rules and regulations regarding COVID-19, including physical and social distancing and wearing a facial covering; and WHEREAS, upon approval of this event, the applicant must provide the City with the required Certificate of Liability Insurance that complies with the City's standard insurance requirements, including naming the City of South Miami as an additional insured prior to the event. NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSIONERS OF THE CITY OF SOUTH MIAMI, FLORIDA: Section 1. The foregoing recitals are hereby ratified and confirmed as being true and they are incorporated into this resolution by reference as if set forth in full herein. Section 2. The City Manager is hereby authorized to permit Urban Oasis Project, Inc. to host its Farmers' Market on the east parking lot of City Hall every Saturday for one (1) year, beginning Saturday, April 24, 2021 through Saturday, April 23, 2022 from 9:00 a.m. to 2:00 p.m. and will pay a fee of $160.00 a week. Section 3. The City Manager is hereby authorized to waive parking meters and off -duty Pagel of 2 Res. No. 045-21-15665 police service fees in the amount of $50,482.50 dollars. Section 4. Corrections. Conforming language or technical scrivener -type corrections may be made by the City Attorney for any conforming amendments to be incorporated into the final resolution for signature. Section S. Severability. If any section clause, sentence, or phrase of this resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this resolution. BACKGROUND: Urban Oasis Project, Inc. ("the applicant"), a 501(c)(3) organization, has requested to continue hosting a Farmers' Market on the east parking lot of City Hall every Saturday for one (1) year, beginning Saturday, April 24, 2021 through Saturday, April 23, 2022 from 9:00 a.m. to 2:00 p.m. Pursuant to Resolution No. 130-20-15570, the applicant was approved to host its Farmers' Market for six (6) months ending on Saturday, April 10, 2021. As per the applicant, since November 2020, the Farmers' Market has grown a strong South Miami clientele averaging approximately one - hundred and twenty (120) customers per week. Additionally, they have expanded vendor participation from an average of five (5) to twelve (12) vendors per week. The applicant will not exceed a total of fifteen (15) vendors under 10'x10' tents located along the parking spaces and sidewalk. The applicant intends to help stimulate the economy by prioritizing local farmers, agricultural producers, food artisans and South Miami based vendors. No flea market type goods or commercial resellers will be permitted. All vendors will accept Supplemental Nutrition Assistance Program (SNAP) benefits. All vendors and customers are expected to follow all CDC recommended guidelines, Miami -Dade County Emergency Orders and City rules and regulations regarding COVID-19, including physical and social distancing and wearing a facial covering. If all restoration work is not performed within 30 days of work completion, the City of South Miami Public Works Department may restore the event area and charge the applicant for the cost of restoration and additional incidental fees. 8. We estimate an average of 120 customers each week come to the market. We have grown from an average of 5 vendors per week to our current 12 vendor average.
