Res No 005-21-15625RESOLUTION NO.005-21-15625 A Resolution of the City of South Miami, Florida, initiating and requesting annexation of property legally described as the SW '/4 portion of Section 36, Township 54 South, Range 40 East, in Miami -Dade County, Florida, and more particularly described herein; requesting approval of the annexation and appropriate City boundary change from the Board of County Commissioners and authorizing the Mayor, City Manager, City Clerk and City Attorney to take all actions necessary. WHEREAS, pursuant to Section 6.04 of the Miami -Dade County Home Rule Charter and Section 20-3 of Miami -Dade County Code, the City of South Miami wishes to initiate a proposed boundary change after public hearing, upon mailed notice to all owners of property within the area and all property owners within 600 feet of the proposed boundaries and notice provided by publication; and WHEREAS, on this date, the City Commission conducted a public hearing that was properly noticed in accordance with the requirements of Section 20-3 of the Code of Miami -Dade County; and WHEREAS, the City Commission has determined that the annexation of the area legally described as the SW V4 portion of Section 36, Township 54 South, Range 40 East, in Miami -Dade County, Florida and further described in Exhibit "A" is necessary, appropriate, and in the best interests of the City and its citizens. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, AS FOLLOWS: Section 1: The foregoing recitals are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption thereof. Section 2: The City Commission hereby approves the enlargement of the City's boundaries to the areas legally described as the SW '/4 portion of Section 36, Township 54 South, Range 40 East, in Miami -Dade County, Florida, and as is more fully described in Exhibit "A", and authorizes the initiation of municipal boundary change procedures pursuant to Section 6.04 of the Miami -Dade County Home Rule Charter and Section 20-3 of the Miami -Dade County Code. Section 3: The City Commission hereby requests that the Board of County Commissioners of Miami -Dade County, Florida, adopt an appropriate ordinance approving the request of the City for the annexation of the lands legally described as the SW %4 portion of Section 36, Township 54 South, Range 40 East in Miami -Dade County, Florida, and as described in Exhibit "A" and authorizing the appropriate boundary change. Section 4: The Mayor, City Manager, City Clerk and City Attorney are hereby authorized and directed to perform all actions as may be deemed necessary or desirable to initiate Page 1 of 2 Res. No. 005-21-15625 and continue the boundary change procedure in accordance with Section 20-3 of the Code of Miami -Dade County and submit the annexation proposed herein to the Board of County Commissioners of Miami -Dade County for their consideration. Section 5: The Clerk is hereby authorized and directed to transmit three (3) certified copies of this Resolution, together with proof of compliance with the notice procedures and all accompanying documentation as set forth in Section 20-3 of the Code of Miami -Dade County to the appropriate person(s). Section 6. Corrections. Conforming language or technical scrivener -type corrections may be made by the City Attorney for any conforming amendments to be incorporated into the final resolution for signature. Section 7. Severability. If any section clause, sentence, or phrase of this resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding will not affect the validity of the remaining portions of this resolution. BACKGROUND: Together with some of the residents, City staff have been exploring the possibility of annexing the area between SW 62nd Avenue and SW 67 Avenue and SW 8011h Street and the Snapper Creek Canal. The first step in annexation, the analysis of the area and the costs of providing city services, has been completed and documented in the attached Annexation Application Report. After the public hearing on January 5th, the Commission will decide whether an annexation application should be submitted to Miami -Dade County. Final decisions on annexations rests with the County Board of Commissioners after an extensive review process. ANALYSIS: The Report details the costs of providing services to and anticipated revenues from the annexation area. The net financial gain to the City is approximately $199,000. PLANNING BOARD RECOMMENDATION: Not applicable. STAFF RECOMMENDATION: Staff recommends approval of the resolution. The area in question, consisting of multiple properties, is bordered by SW 80th Street on the north; SW 62nd Avenue on the east; the Snapper Creek Canal on the south; and SW 67th Avenue on the west, as shown in the report. Existing development within the proposed annexation area (which is practically built out) consists both of residential and commercial uses, complementing and enhancing South Miami's envisioned character, as described in the City's 2018 Comprehensive Plan. The adjacency and character of the area would allow the City to grow in a manner fully consistent and compatible with its planning policies, while retaining its small-town scale. For these reasons, the City sees this annexation as a natural extension of the City's boundaries to the southwest. Statement of Rationale for Boundary Changes The City of South Miami is a small municipality of approximately 2.3 square miles in land area. The City does not have a history of geographical expansion, even after subsequent size reductions during the 1930s led to the current irregular boundaries in the north section of the community. The proposed annexation area is very modest -equivalent to approximately 0.18 square miles, or 115 gross acres of land— and directly adjoins the City of South Miami at its current southwestern municipal boundary (refer to Map #1). The existing and potential development within the proposed annexation area consists both of residential and commercial uses, complementing and enhancing South Miami's envisioned character, as described in the City's 2018 Comprehensive Plan. It would allow the City to grow in a manner fully consistent with its planning policies, while retaining its small-town scale. The proposed annexation fulfills Comprehensive Plan FLU Goal 1 to "maintain and improve the City's neighborhoods, and the quality of life of existing and future residents" as well as FLU Goal 6 to "support the economic viability of the City through an adequate tax base and development that allows for the efficient provision of City services." Under Goal 6, the Comprehensive Plan further states: FLU OBJECTIVE 6.1 Increase the City's tax base through appropriate development Continue to increase the City's tax base and fiscal health through new development and redevelopment, increased property values, annexations, impact fees, grants, and other strategies as appropriate. As the Florida Planning and Zoning Association has pointed out, "annexation is a means for fitting the city line to the area that has become the city or is becoming the city..." Many property owners in the annexation area likely frequent Downtown South Miami as their business district; City parks such as the adjoining Fuchs Park and the nearby Van Smith Park, South Miami Dog Park and Dante Fascell Park (all of which are within easy walking and biking distance) likely serve as their own parks. The area is served by the same Fire Rescue station located within the City. Therefore, this annexation would allow for a seamless expansion of South Miami's boundaries. In addition, the City of South Miami has determined that the proposed annexation will reinforce the City's already solid fiscal resilience by expanding the residential and commercial components of its tax base into a contiguous area of similar development character. For 2020, the City is estimated to have a positive overall taxable value change of approximately 4.3% over the estimated 2019 taxable value. The estimated tax value per gross acre within the current City boundary is approximately $1.4. million. The estimated tax value per acre within the proposed annexation area is above $1.5 million per acre. The City can offer improved, predictable level of service to property owners within the area. _. Land Use Plan and Zoning The following table, based on the Inventory of Existing Land Uses provided by the Miami -Dade County Department of Regulatory and Economic Resources, details the major categories of land use found within the proposed annexation area by number of acres and percentage of total. See Figure 2 for a map of existing land uses. As shown, the proposed annexation area encompasses 115.0 acres (or approximately 0.18 square miles) and is largely developed. In addition, more than 50 percent of the area is developed residential. In addition, the area includes two retail centers and a public storage complex. There are no public parks and recreation facilities within the area; the acreage of land identified as parks and recreation in the table above is an amenity that belongs to the multifamily residential complex. _. In areas where existing platting is characterized by parcels larger than 10,000 square feet, zoning regulations should be consistent with surrounding parcel sizes. Sites large enough to be subdivided into parcels of 10,000 square feet or larger could be zoned accordingly, but only if such zoning would be compatible with surrounding development. • Duplex Residential: The Duplex Residential category is intended to provide for two residential dwelling units per parcel of land. Each dwelling unit should have its own direct access from the out-of-doors. Two-family structures should be developed at densities that do not exceed two dwelling units per 10,000 square feet. • Townhouse Residential: The Townhouse Residential category is intended to limit development to townhouse type dwelling units on parcels of land not less than 10,000 square feet in area. Each dwelling unit should have its own direct access from the out- of-doors, Townhouse dwelling units should be developed at densities that do not exceed one dwelling unit per 7,260 square feet of site area. Individual parcels which meet the minimum site size of 10,000 square feet in area could be developed for use as single-family residential dwelling units. • Multi -Family Residential: The Multiple -Family Residential land use category is intended to provide for residential densities of up to a maximum of 24 dwelling units per net acre. Multiple -family residential development shall be designed in order to create environmentally sensitive and well landscaped settings with pedestrian and multi -modal, transit -oriented amenities. A SAf 41 G PA $out &idmi Proposed Annexation be encouraged to produce unique, flexible, multi -level projects, such as mixed -use developments, including retail and office uses on ground floor levels. • Commercial Retail and Office: The Commercial Retail and Office land use category is intended to provide for retail and retail service office use and office services that are characteristic of commercial development. Adopted zoning regulations shall reinforce the "no widenings" policy as set forth in the Transportation Element by encouraging the containment of development along existing State and County high -design roadway facilities. The City recognizes the sanctity of the residential neighborhoods and desires to protect them from potentially adverse uses. Consequently, no amendments to the Future Land Use Map shall be made which develops or expands a Commercial Retail and Office district into an area designated for residential development. • Mixed -Use Commercial/Residential: The Mixed -Use Commercial/Residential land use category is intended to provide for different levels of retail uses, office uses, retail and office services, and residential dwelling units with an emphasis on mixed -use development that is characteristic of traditional downtowns. Permitted heights and intensities shall be set forth in the Land Development Code. Regulations regarding the permitted height, density and intensity in zoning districts for areas designated as Mixed - Use Commercial/Residential shall provide incentives for transit -oriented development and mixed -use development. Zoning regulations shall reinforce "no widenings" policy set forth in the Transportation Element by encouraging use of the MetroRail system. The City adopts a F.A.R. of 1.6 for this land use category which is the existing F.A.R. in the Land Development Code for the corresponding zoning district. In addition, the City adopts a maximum residential density of 24 dwelling units per acre for this district. In order to ensure a mix of uses, the City requires that a minimum of two of the above uses must be developed within this category. For residential projects, at a minimum, at least one floor must allow retail or office. For retail projects, at a minimum, at least one floor must contain residential or office. For office projects, at a minimum, at least one floor must contain residential or retail. • Transit -Oriented Development District (TODD): The Transit -Oriented Development District is intended to provide for the development of office uses, office services, office - related retail, retail, retail services, and residential uses in multi- story and mixed -use projects that are characteristic of transit -oriented developments. Permitted heights and intensities shall be set forth in the Land Development Code, including design standards. Zoning regulations shall encourage development within the TODD in conjunction with limiting new development within the Special Flood Hazard Area and other environmentally sensitive areas. The City shall pursue incentive programs for redevelopment including higher densities, flexible building heights and design standards to ensure that responsible, effective and aesthetically pleasing projects result. Refer to the Miami -Dade County Zoning Code, Chapter 33, Articles XIII XIV XV, XX, and XXXI11f11, respectively, for relevant descriptions of these zoning categories and their corresponding regulations. This district is appropriate in areas designated "Single -Family Residential" on the City's adopted Comprehensive Plan. • "RS-3" Low -Density Single -Family Residential District: The purpose of this district is to provide for low -density single-family residential development located in a moderately spacious setting which emphasizes the preservation of open space. This district is appropriate in areas designated "Single -Family Residential" on the City's adopted Comprehensive Plan. • RT-6" Townhouse Residential District: The purpose of this district is to provide suitable sites for the development of well planned, environmentally compatible, low -density townhouse or duplex projects on sites of at least ten thousand (10,000) square feet, which are located in such a manner as to serve as effective transitional land use elements between single-family and more intensive multi -family residential or commercial areas. This district is appropriate in areas designated "Townhouse Residential" or "Duplex Residential" on the City's adopted Comprehensive Plan. • "GR" General Retail District: The purpose of this district is to delineate areas which permit a broad range of retail uses. Uses that are strongly oriented toward the motoring public are discouraged in this district. The TODD is intended to provide for the development of office retail, residential uses, and related services in multi -story and mixed -use projects that are characteristic of transit -oriented developments. Regulations provide for the continuation of existing light industrial uses, but encourages redevelopment through land assembly, flexible building heights, design standards, and performance -oriented incentives. Police: The South Miami Police Department (SMPD) is a full -service law enforcement agency with 50 sworn positions and nine civilian staff. The city is divided up into six (6) patrol zones. Each staff member is responsible for overseeing an area and for reaching out to the community through citizen contacts. The Department is headquartered in a building connected to City Hall at 6130 Sunset Drive. Upon completion of the annexation process and municipal boundary change the City would provide immediate coverage to the area without degradation of police service. If the annexation is successful an increase of 4 officers will be contemplated. B. Fire Protection: Fire Rescue Services for the annexation area and for the City of South Miami are provided by Miami -Dade County Station 14, which is located at 5860 S.W. 70th Street within South Miami boundaries. Units on site are Rescue, Engine, and Battalion 8. There will be no change in this service if the annexation occurs. C. Water Supply and Distribution: The Miami -Dade County Water and Sewer Department (MDWASD) currently services the proposed annexation area through its water supply and distribution system. Since MDWASD is also responsible for water supply, treatment and transmission to the City of South Miami, there will be no change if the annexation occurs. The City is served in its entirety by public water lines, although a few individual areas have yet to connect to the system. City of South Miami maintains a 20-Year Water Supply Facilities Work Plan in compliance with Chapter 163, Part II, F.S. D. Facilities for Collection and Treatment of Sewage: MDWASD has jurisdiction over the proposed annexation area, but apart from the commercial sites and approximately a dozen scattered residential properties, most of the lots throughout the area appear to be served by onsite sewage treatment and disposal systems (OSTDS, aka septic tanks). About two-thirds of the City of South Miami (mostly the City's residential areas) are served by OSTDS as well. These systems work well given the current soil conditions in South Miami. Nevertheless, the City has prepared a Sanitary Sewer Master Plan to evaluate areas within the City limits that are currently not serviced by a public sanitary sewer system and to make recommendations for improvements and upgrades to the County facilities in order to serve these areas properly in the face of sea level rise due to climate change. The Central District Wastewater Treatment Plant which serves South Miami has an annual average permitted capacity of 143 mgd, with adequate treatment capacity for a ten-year planning period. The County has the capacity to accommodate increased use. E. Garbage and Refuse Collection and Disposal: The City of South Miami operates solid waste pickup throughout the City. There is no commercial pickup provided by the City. The Public Works Department's Solid Waste Division trucks transport all refuse collections to a transfer station located at 2900 S.W. 72nd Avenue and operated by the Miami -Dade Public Works Department. The capacity of this transfer station is adequate to meet South Miami's future needs, including with the potential annexation. The City of South Miami will extend its collection area. F. Street Lighting: Florida Power and Light provides electricity and lighting to the proposed annexation area and will continue to do so. Any future municipal streets will become City roads under the purview of the City's Public Works and Engineering Department. H. Park and Recreation Facilities and Services: The proposed annexation area is currently served by Miami -Dade County's Parks, Recreation and Open Spaces Department. The County facilities closest to the annexation area are Matheson Hammock, approximately 1-1/2 miles away to the east and the Kendall Dog Park, less than a mile to the west. Tropical Park and A.D. Barnes Park are located to the northwest, less than 3 miles away. Like City of South Miami residents and those employed within municipal boundaries, people living and working within the annexation area will be able to continue enjoying these County parks, as well as other County, State and National parks in the region. Inc. �a A S EUuili COMPANY Sourkiami Proposed Annexation Building Inspection: The City's Building Department enforces the State of Florida Building Code within the boundaries of the City of South Miami and collaborates with other City Departments in the enforcement of local codes. The Department also certifies buildings upon completion and at pre -stated periods afterwards. The Building Department will be responsible for the same functions within the annexation area, if the annexation is successful. J. Zoning Administration: The City's Planning and Zoning Department is responsible for the oversight of all inquiries pertaining to the City's adopted land use and zoning provisions, including but not limited to, property plat and zoning information, Comprehensive Plan amendments, variance requests, site plan reviews, issuance of sign permits, tree removal permits and land development regulations. The Planning and Zoning Department will be responsible for zoning administration in the annexation area if the annexation is successful. K. Local Planning Services: See above. The City's Planning and Zoning Department will be responsible for local planning services. L. Code Enforcement The City's Code Enforcement Office enforces the codes and regulations that control zoning, building, business tax licenses, abandoned vehicles, residential and commercial property maintenance, and minimum housing standards. The Code Enforcement Office will undertake these responsibilities within the annexed area. M. Special Services Not Listed Above: The City may be responsible for certain special services which are not development related. N. General Government The City of South Miami follows a Commission -City Manager form of government. The City Manager serves as the Chief Executive Officer of the City and is responsible for the administration of all City affairs. These duties include responsibility for all City departments and operations. The current number of employees is approximately 156 employees, of which 120 are full time and 36 part time. This work force may be adjusted as the City expands functions or responsibilities. The Mayor and City Commission is the five member elected legislative and governing body of the city responsible for establishing policies, managing growth and land use, adopting an annual budget and tax rate, setting storm water utility rates, and other fees and charges for city services, adopting local laws and ordinances and hiring and overseeing the City Manager, City Attorney and City Clerk. Timetable for Supplying Services A. Police: Immediate. The South Miami Police Department will be able to reasonably undertake policing in the annexed area. The area will be either added into an existing patrol zone or made into a new patrol zone. B. Fire Protection: No Change. Miami -Dade County Fire Rescue will continue to provide service to the annexed area from Station 14 located at 5860 S.W. 70th Street. C. Water Supply and Distribution: No Change. Miami -Dade County Water and Sewer Department already supplies potable water through its water supply and distribution system. D. Facilities for Collection and Treatment of Sewage: No Change. Miami -Dade County Water and Sewer Department does not currently service the annexation area through its wastewater collection and treatment system. E. Garbage and Refuse Collection and Disposal: Immediate. The annexation area will become part of the Solid Waste Division garbage and trash removal service system, added into the City's collection schedule. F. Street Lighting: Immediate/No Change. The City will maintain roadways designated municipal streets within the annexed area, while the County shall continue to maintain responsibility for section line roadways. H. This fund is used to account for all financial resources except those required to be accounted for in another fund. A. Police: The City will fund this service through its General Fund via tax collections. B. Fire Protection: Fire and Rescue services will continue to be provided by Miami -Dade County Fire Rescue Department. Services are financed through Fire Rescue Taxing District revenues and financing proceeds. There is no cost to the City of South Miami for this service. C. Water Supply and Distribution: The area is close to build -out and currently served by MDWASD. Potential costs associated with any new development or redevelopment (water main extensions and connections) will be paid by the developing entity. Water usage charges will provide the revenues for the continued operation and maintenance of the water supply and distribution system. D. Facilities for Collection and Treatment of Sewage: The area is primarily served by OSTDS (septic tanks). Improvements and upgrades associated with new development would be paid by the developing entity. E. Garbage and Refuse Collection and Disposal: The City will fund this service through its General Fund via tax collections. The City also receives revenues from residents who have trash in excess of the allowable amount per cubic yard and annual charge for those having an extra garbage container. Revenues are also generated by franchise fees from private haulers (garbage collection) operating within the City limits. F. Street Lighting: Street lighting is financed through FP&L or Special Taxing Districts created by new development. G. Street Construction and Maintenance: The costs of new street construction, if any, will be funded by the associated new development. Maintenance will be funded through the City's General Fund. H. Park and Recreation Facilities and Services: The General Fund supports parks and recreation operating activities. As stated previously, no new parks are required to service the annexation area. Tax Load on Annexation Area The gross revenue calculations are based on the 2020 Taxable Real Estate and Personal Property Rolls. Property tax revenue is calculated using the following formula provided by Miami -Dade County, which applies the adopted millage rates and certified roll figures at 95 percent: Revenue = Taxable Property X Millage X 0.95/1000 The current Miami -Dade County millage rate is 1.9283 which yields estimated revenue of $324,728. The estimated cost of providing services to the annexation area (i.e., expenditures) is based on costs the City expects it will incur, including police protection, solid waste pickup and disposal, paying for street lighting, etc. The City of South Miami FY2020-2021 Budget process has been completed. The City's millage cap of 4.3000 (same as FY2019-2020) was set at the July 7th, 2020 City Commission meeting. That's about to change. The restaurant signed a new lease Thursday with its longtime managing partner now as the owner, and he plans to reopen Jan. 15. "The vaccine is out, people are starting to feel more comfortable, so 1 think it's better timing," said owner Chris Klaic, who had worked at the restaurant for 25 years. For awhile Christy's future was uncertain. The building in which the res- taurant resides was sold earlier this year, but Klaic bought the name from founder Charles Hauser and spoke to the new land- lords about signing a new lease. He was a week away from signing, he said, when restaurant dining rooms were ordered closed a second time in July to fight the spread of the comnavirus. Klaic held off on signing the deal. "Thank goodness didn't do it," he said. Klato spent the next several months waiting for the COVID-19 numbersta lower, while also looking for backup locations. The staff will spend the next few weeks painting and making minor repairs, with the goal of reopening the second week of 2021. And when it does reopen, Chrisry's will have the same longtime general manager, Indiana Parade, and menu, prepared by the same chef, Haitian -Amer - heart Morales Francois, who has run the kitchen since 1994.
