Ord No 05-20-2359i Ordinance No. 0 5 -2 0 -2 3 5 9 An Ordinance related to the fee schedule; amending Ordinance 12-18-2301 to revise the Planning and Zoning Department fees and the Building Permit fees. WHEREAS, on December 3, 2019, the City Commission adopted Ordinance No. 39-19-2352 which amended City Code Section 7-3.2 Parks impact fees to establish a fee of $2.42 per square foot of gross floor area; and WHEREAS, the Commission has also expressed a desire to revise the Variance application fee by creating a sliding scale; and WHEREAS, the proposed changes are illustrated in the attached "Proposed Revisions to the Building Permit Fees Schedule" and the "Proposed Revisions to the Planning and Zoning Department Fee Schedule"; and WHEREAS, the Mayor and City Commission desire to revise the adopted Fee Schedule as presented. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: Section 1. The Schedule of Fees and Fines, as approved in Ordinance 12-18-2301, is hereby amended to revise the Building Permit Fees as set forth in the attached "Proposed Revisions to the Building Permit Fees Schedule ". Section 2. The Schedule of Fees and Fines, as approved in Ordinance 12-18-2301, is hereby further amended to revise the Variance fees of the Planning and Zoning Department as set forth in the attached "Proposed Revisions to the Planning and Zoning Department Fee Schedule". Section 3. Any such fees may be waived or reduced by the Mayor and City Commission by resolution. Section 4. Severability. If any section, clause, sentence, or phrase of this ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, this holding shall not affect the validity of the remaining portions of this ordinance. Section 5. Ordinances in Conflict. All ordinances or parts of ordinances and all sections and parts of sections of ordinances in direct conflict herewith are hereby repealed. BACKGROUND: The City Commission recently adopted a revised parks impact fee of $2.42 per square foot of gross floor area for new residential construction. The attached ordinance makes the corresponding change to the City's Schedule of Fees. The ordinance also presents a revision to the application fees for variances. Currently, a flat fee of $3,000 is charged for the first request, and an additional $1,125 is charged for each additional request. Commissioner Liebman requested staff present a fee schedule based on a sliding scale, depending on the size of the request. The attached ordinance presents that tiered approach, with fees separated as follows: requests to reduce the standard by ten percent or less; by more than ten percent but less than twenty percent; and by more than twenty percent. In addition, a fourth category is suggested that would be applied when the regulation being deviated from is not quantifiable. The existing fee for variance extensions will be maintained at $500. RECOMMENDATION: Staff recommends approval of the proposed ordinance.
