A Resolution authorizing the City Manager to waive police service fees for Urban

WHEREAS, On Tuesday, October 6, 2020, the City Commission passed and adopted
Resolution No.130-20-15570, which authorized the City Manager to permit Urban Oasis Project,
Inc. (the "applicant") to host a Farmers' Market on the east parking lot of City Hall every Saturday
for six (6) months, beginning Saturday.. November 7, 2020 through Saturday, April 10, 2021 from
9:00 a.m. to 2:00 p.m.; and
WHEREAS, Resolution No. 130-20-15570, in addition, requires that the applicant pay for
city police services associated with the event in the amount of $8,107.50 (1 Off -Duty Police
Officers w/ Vehicle: $352.50 per day X 23 Days); and
WHEREAS, the applicant is requesting a fee waiver for police services for every Saturday,
beginning Saturday,. November 21, 2020 through Saturday, April 10, 2021 in the amount of
$7,402.50 (1 Off -Duty Police Officers w/ Vehicle: $352.50 per day X 21 Days); and
WHEREAS.. According to Sec. 1513-6. — Use of city property for organized activity, (2)
Permits and cost reimbursement: All persons presenting a special event using public property
or public streets or who use the public rights -of -way, parks and recreational facilities within the
city when such use requires city services and resources to be expended must complete a permit
application and shall reimburse the city for all city revenue losses and city expenditures
associated with the approved uses; and
WHEREAS, (11) the City Commission may waive the fees and costs required by this
section.
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSIONERS OF THE
CITY OF SOUTH MIAMI, FLORIDA:
Section 1. The foregoing recitals are hereby ratified and confirmed as being true and
they are incorporated into this resolution by reference as if set forth in full herein.
Section 2. The City Manager is hereby authorized to waive police service fees in the
amount of $7,402.50 for Urban Oasis Project, Inc. to host a Farmers' Market on City Hall property,
beginning Saturday, November 21, 2020 through Saturday, April 10, 2021.
Section 3. Corrections. Conforming language or technical scrivener -type corrections may
be made by the City Attorney for any conforming amendments to be incorporated into the final
resolution for signature.

Section 4. Severability. If any section clause, sentence, or phrase of this resolution is for
any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall
not affect the validity of the remaining portions of this resolution.

adoption.

BACKGROUND: On Tuesday, October 6, 2020, the City Commission passed and adopted

Market on the east parking lot of City Hall every Saturday for six (6)
months, beginning Saturday, November 7, 2020 through Saturday, April
10, 2021 from 9:00 a.m. to 2:00 p.m.
Resolution No. 130-20-15570, in addition, requires that the applicant pay
for city police services associated with the event in the amount of
$8,107.50.
The applicant is requesting a waiver for police services in the amount of
$7,402.50 for every Saturday, beginning Saturday, November 21, 2020
through Saturday, April 10, 2021.
According to Sec. 15B-6. — Use of city property for organized activity:
(2) Permits and cost reimbursement: All persons presenting a special
event using public property or public streets or who use the public rights -
of -way, parks and recreational facilities within the city when such use
requires city services and resources to be expended must complete a
permit application and shall reimburse the city for all city revenue losses
and city expenditures associated with the approved uses.
(4) All persons presenting approved special events using public property
or public streets within the city must agree in writing to pay the actual
amount of city revenue losses and final city expenditures associated with
the approved special event, which may include, but not be limited to:
road closure costs, barricades, public works staff, lost parking revenue,
police services and clean up services.

To Whom it may concern:
I'd like to submit a request that the requirement for an off -duty police officer be waived for the South
Miami Farmers Market, held on the south bound portion of 61"Ave, which is considered by the general
public to be a parking lot and not a road. We would request that the fees or the requirement for an off duty
officer be waived from Nov 21' 2020 going forward. The expense would be a very difficult financial
burden for the farmers market.

BACKGROUND: Urban Oasis Project, Inc. ("the applicant"), a 501(c)(3) organization, has
requested to host a Farmers' Market on the east parking lot of City Hall
every Saturday for six (6) months, beginning Saturday, November 7, 2020
through Saturday, April 10, 2021 from 9:00 a.m. to 2:00 p.m.
The applicant had held the Farmers' Market in South Miami
approximately seven (7) years ago. Since then the applicant has been
hosting the Farmers' Market at Tropical Park. The applicant's mission is to
bring fresh, affordable local foods back to the families in South Miami.
The applicant will have a total of fifteen (15) vendors under 10' x 10'
tents located along the parking spaces and sidewalk. The applicant
intends to help stimulate the economy by prioritizing local farmers,
agricultural producers, food artisans and South Miami based vendors. No
flea market type goods or commercial resellers will be permitted. All
vendors will accept Supplemental Nutrition Assistance Program (SNAP)
benefits.
All vendors and customers are expected to follow all CDC recommended
guidelines regarding COVID-19 including social and physical distancing, as
well as wearing facial coverings at all times. The applicant will be spacing
each vendor 10 feet apart to accommodate proper social and physical
distancing between vendors and customers.
The applicant is requesting to waive certain special event fees in order to
focus its revenue towards advertising and promotion to the community.
The applicant has submitted the necessary Notification/Petition form,
which requires them to obtain signatures of approval from a majority of
the business affected by the parking lot closure. Upon approval of this

good consideration the receipt and sufficiency of which is hereby acknowledged, the Parties hereby agree as follows:

2. 4plicant agrees to indemnify, defend and hold the City, its officers, affiliates, employees, successors and
assigns ( collectively "Indemnitees") harmless from and against any and all such claims, suits, actions,
damages. or causes of action arising as result of the Special Event, or of the condition of the site on which
the Special Event is held including any personal injury or loss of life, or damage to or loss of property, and
from and against any costs, attorney's fees, expenses or liabilities included in and about the defense or
settlement of any clams, and the investigation thereof, except to the extent caused by indemnitees
negligence of willful misconduct.
3. No Street shall be closed without approval from the City Commission.
4. Traffic shall be maintained in accordance with Florida Department of Transportation (FDOT), Miami -Dade
County standards and any additional requirements by the City of South Miami Public Works Department
and Police Department.
S. Event areas shall be restored to equal or better condition than they were before the event started.
6. Any damage to private property shall be restored to its original condition or better and as accepted by the
Owner caused by applicant or any of its agents, servants or employees, invitees and onlookers.
7. If all restoration work is not performed within 30 days of work completion, the City of South Miami Public
Worts Department may restore the event area and charge the applicant for the cost of restoration and
additional Incidental fees.
8. Applicant must pay all fees prior to the date of their event(s).
9. Applicants shall notify the City of South Miami Special Event Coordinator at least forty-eight (48) hours prior
to start of their event of any cancellations to be considered for any refunds.

Urban Oasis Project is a non-profit entity in Miami Date County that is excited to bring one of our
signature farmers markets to the city of South Miami, where it has roots back to the farmers market
held at city hall 7 years ago. We have continued operating in Tropical Park over the last few years,
so we will be able to bring a dedicated clientele and vendor group.
Urban Oasis Project has a mission to make fresh local food accessible and affordable to all. To this
end, we accept SNAP benefits and also double their value for use on FL fruits and veggies. We also
make sure that produce is labeled as to its place of origin, with a very strong preference for local
produce. Farmers and agricultural producers will have first priority for vendor spots, followed by
food artisans using local produce and related vendors, and a preference for vendors local to South
Miami.
We would like to request a fee waiver for the firstyear of operation so that we can focus all
revenues towards advertising and promotion of these programs to the local and greater Miami
community. Thank you for your support and we look forward to this new relationship with the City

Sec.15B-6. - Use of city property for organized activity.
Purpose. The City of South Miami must ensure that public property and public street locations within
the city are used properly and are regulated to ensure the safety of pedestrians, vehicles and general
public and to secure reimbursement to the city for the cost of such activities. Special events and the use
of city's rights -of -way, parks and recreational facilities that require city services and resources to be
expended including but not limited to administrative, security, clean up, banner hanging, street blocking,
covering of parking meters.
(1) Deirnitions:
City means the city manager or the manager's designee, or the City of South Miami, depending
on the context in which the word is used.
Person means any individual, firm, legal entity joint adventure, organization, syndicate, or other
group or combination acting as a unit, association, estate, trust, business trust, trustee, executor,
administrator, receiver, or other fiduciary, and includes the plural as well as the singular.
Presenter as used in this section shall include the person who organizes the activity.
(2) Permits and cost reimbursement: All persons presenting a special event using public property
or public streets or who use the public rights -of -way, parks and recreational facilities within the
city when such use requires city services and resources to be expended must complete a
permit application and shall reimburse the city for all city revenue losses and city expenditures
associated with the approved uses. Approval of all special events and use of city's rights -of -
way, parks and recreational facilities, shall be in compliance with this section, after
administrative review of all complete special event permit applications. All special event permit
applications must be received, at a minimum, thirty (30) days prior to the proposed special
event, unless specifically waived by the city manager.
(3) All persons presenting an approved special event, which closes a public street, must provide,
in advance, a petition, approving of the road closure, signed by a majority of the businesses or
homeowners facing the street affected by the approved special event road closure, unless this
requirement is previously waived by resolution of the city commission.
(4) All persons presenting approved special events using public property or public streets within
the city must agree in writing to pay the actual amount of city revenue losses and final city
expenditures associated with the approved special event, which may include, but not be limited
to: road closure costs, barricades, public works staff, lost parking revenue, police services and
clean up services. If a city right-of-way, park or recreational facility is being used that requires
city services and resources to be expended, the organizer shall be responsible for paying a city
park rental fee in accordance with the city's park rental fee schedule, a security deposit, and
any fees associated with producing the permit.
(5) All persons presenting approved special events using public property or public streets within
the.city which have been allocated monetary grants in the city budget, shall be required to pay
for the required reimbursement from the designated monetary grant unless otherwise prohibited
by the grant.
(6) Compliance with all laws. The person presenting the special event or using city's rights -of -way,
parks and/or recreational facilities shall comply with section 20-4.3(N) [of the Land Development
Code] relating to banners over the right-of-way. Additionally, the presenters of the special event
or who organizes an activity using city's rights -of -way, parks and/or recreational facilities shall
comply with all city policies and state and federal laws relating to Americans with Disabilities
Act, including ensuring sufficient and appropriate bathroom facilities, proper location of displays
and exhibits, and parking requirements; and ensuring compliance with the Florida Division of
Hotels and Restaurants, Department of Business and Professional Regulation requirements
relating to food establishments and public food service for temporary event vending.
Additionally, each special event presenter shall obtain a South Miami Public Works Permit
application for work within the right-of-way, and pay any fees associated with producing the

permit. All special event presenters and all persons who organize an activity using city's rights-
of-wav, parks and/or recreational facilities shall also pay, if applicable, a clean-up deposit as
well as any additional costs associated with police or other department off -duty employment to
the city prior to the permit being issued. If the presenters or organizers meet the terms for a
refund of the clean-up deposit, the city shall issue a refund of same after inspection of the area
used to insure compliance with this section.
(7) Policies, procedures and insurance. The city shall establish policies and procedures for the
implementation of special events and for the use of the city's rights -of -way, parks and/or
recreational facilities, which policies and procedures shall include: a permit application requiring
the disclosure of the name of the person(s) presenting the event, the address, telephone
number of the presenter, the names of principals and officers of any presenter who is a legal
entity, the delivery of an insurance policy and endorsements that comply with the city's standard
insurance requirements then in effect, including the naming of the City of South Miami as an
additional named insured and providing ten (10) days advanced notification to the city before
the policy can be cancelled or modified, the delivery of an indemnification agreement that
complies with the city's standard indemnification requirements then in effect for the event or
activity as well as other certificates, documents and information that the city manager deems
appropriate for all applicants. Each policy shall provide coverage for the event or activity,
including set up and dismantling of the event. Organizer shall ensure that the policy limits in
accordance with the insurance policies of the city as set forth in the city manager's
administrative procedures. The city shall not be held liable or responsible for any claims which
may results from acts, errors or, omissions of the presenter, its contractors or its subcontractors,
suppliers or laborers. In reviewing, approving or rejecting any submissions or acts of the
organizer, the city in no way assumes responsibility or liability for the acts, errors or omissions
of presenters, or their contractor or subcontractors.
(8) Failure to adhere to the provisions of this section shall result in the issuance of the daily
running civil infraction fine of five hundred dollars ($500.00) per day, plus any and all actual
costs incurred by the city until such time as the person complies with this section. Appeal of any
civil infraction shall be to the special master or magistrate pursuant to section 2-25 or as
otherwise provided in the City's Code of Ordinances.
(9) Each application shall be accompanied by the permit fee as delineated in the city's fee
schedule.
(10) The city manager may issue a sound permit asset forth in section 15-97.
(11) The city commission may waive the fees and costs required by this section.
(12) Revocation of permit. The city manager or designee shall have the authority to revoke a
permit upon a finding of violation of any federal, state, county or city law, rule or regulation or
finding that any of the facts contained in the permit application are false in any manner. The city
police department shall have the authority to order termination of the event and to evict the
participants in the event that the permit is revoked or should the continuance of such event
contribute to public disorder or endanger life or property.
(13) Display of permits. All persons required to have a permit for reservation of a park or park
facility shall produce and exhibit said permit upon request of the city manager or designee or
any city law enforcement officer who shall desire to inspect the same for the purpose of
enforcing compliance with any ordinance, resolution, or rule. Failure to produce and exhibit such
a permit shall be grounds for the removal of such participants, or event, including any
associated equipment.
