WHEREAS, the applicant is responsible for submitting payment for the following services

WHEREAS, event staff and customers are expected to follow all Miami Dade County
Emergency Orders, City of South Miami rules and codes, and CDC recommended guidelines
regarding COVID-19, including maintaining social and physical distancing as well as wearing facial
coverings at all times even while dining, and even if seated and in the process of being served,
with the exception that the covering can be removed briefly when in the actual act of putting
food or a beverage into one's own mouth while seated (Dining). Specifically, a facia covering
must be worn at all other times, including when the person is talking to the waiter or to anyone
else at the same table; and
WHEREAS, upon approval of this event, the applicant must provide the City with the
required Certificate of Liability Insurance that complies with the City's standard insurance
requirements, including naming the City of South Miami as an additional insured prior to the
event.

NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSIONERS OF THE
CITY OF SOUTH MIAMI, FLORIDA:
Section 1. The foregoing recitals are hereby ratified and confirmed as being true
andthey are incorporated into this resolution by reference as if set forth in full herein.
Section 2. The City Manager is hereby authorized to permit Deli Lane to extend its
business and services onto 59th Avenue from 72"d Street to 73`d Street on Saturday, November
28, 2020 from 7:00 p.m. to 11:00 p.m.
Section 3. The City Manager is hereby authorized to waive certain special event fees in
the amount of $743.
Section 4. Corrections. Conforming language or technical scrivener -type corrections may
be made by the City Attorney for any conforming amendments to be incorporated into the final
resolution for signature.
Section 5. Severability. If any section clause, sentence, or phrase of this resolution is for
any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall
not affect the validity of the remaining portions of this resolution.
Section 6. Effective Date. This resolution shall become effective immediately upon
adoption.

BACKGROUND: Deli Lane Cafe ("the applicant"), located at 7230 SW 59th Avenue, has
submitted a Special Event Application to host its Evening Gratitude event.
The applicant is requesting to extend its business and provide services
onto 59th Avenue from 72nd Street to 73`d Street on Saturday, November
28, 2020 from 7:00 p.m. to 11:00 p.m. The applicant is anticipating
roughly two -hundred (200) persons.
The Evening of Gratitude event is a celebratation in appreciation of the
South Miami community and will feature live music, food, and beverages
catered and sold by the applicant. This event will be advertised via social
media and by in-house staff.
Both sitting and standing tables will be available at 10 feet apart, no more
than 6 persons per table. Customers will be assigned to a table in order to
enter. Once customers are assigned to a table, they will not be permitted
to roam or gather in other areas. The applicant has stated that additional
staff have been hired to enforce rules accordingly.
Hand sanitizing stations will be available at each table and all counter
spaces. The entertainment band will be roped off and will maintain a
twenty (20) foot distance from attendees/customers at all times.
Two (2) police officers will be present and multiple vehicles will be on site
to block traffic at intersections. All event staff and customers are
expected to follow all Miami Dade County Emergency Orders, City of
South Miami rules and codes, and CDC recommended guidelines
regarding COVID-19, including maintaining social and physical distancing
as well as wearing facial coverings at all times except while eating or
drinking.

INDEMINIFATION AGREEMENT
THIS AGREEMENT ("Agreement') is entered into by and between
("Applicant"), and the City of South Miami ("City") on the date on which the last of the Parties executes this
Agreement.
RECITALS
WHEREAS,the Applicant has submitted a Special Event Permit Application to the City for (event title)

and the City's Special Event Regulations, the Applicant must execute an indemnification and hold harmless

Now, THEREFORE, in consideration of the matters recited above, the mutual covenants set forth herein, and other
good consideration the receipt and sufficiency of which is hereby acknowledged, the Parties hereby agree as
follows:
1. The above recitals are true and correct.
2. Applicant agrees to indemnify, defend and hold the City, its officers, affiliates, employees, successors and
assigns ( collectively "Indemnitees") harmless from and against any and all such claims, suits, actions,
damages, or causes of action arising as result of the Special Event, or of the condition of the site on which
the Special Event is held including any personal injury or loss of life, or damage to or loss of property, and
from and against any costs, attorney's fees, expenses or liabilities included in and about the defense or
settlement of any clams, and the investigation thereof, except to the extent caused by indemnitees
negligence of willful misconduct.
3. No Street shall be closed without approval from the City Commission.
4. Traffic shall be maintained in accordance with Florida Department of Transportation (FDOT), Miami -Dade
County standards and any additional requirements by the City of South Miami Public Works Department
and Police Department.
S. Event areas shall be restored to equal or better condition than they were before the event started.
6. Any damage to private property shall be restored to its original condition or better and as accepted by the
Owner caused by applicant or any of its agents, servants or employees, invitees and onlookers.
7. If all restoration work is not performed within 30 days of work completion, the City of South Miami Public
Works Department may restore the event area and charge the applicant for the cost of restoration and
additional incidental fees.
S. Applicant must pay all fees prior to the date of their event(s).
9. Applicants s notify the City of South Miami Special Event Coordinator at least forty-eight (48) hours
prior to 96rt of their event of any cancellations to be considered for any refunds.
