Res No 145-20-15585RESOLUTION NO. �45-20-15585 A Resolution pursuant to Land Development Code Section 20-5.6(D) allowing Fellowship Church to file a zoning application for amendments to the Future land Use Map and the Zoning Map for the property generally located northwest of the intersection of SW 72Bd Street and SW 67* Avenue. WHEREAS, Fellowship Church ("Applicant") had previously submitted zoning applications for amendments to the Future Land Use Map and the Zoning Map concerning property generally located northwest of the Intersection of SW 72M Street and SW 670 Avenue; and WHEREAS, the applications requested the Duplex Residential designation on the Future Land Use Map and the RT 9 zoning district on the Zoning Map; and WHEREAS, the applications were advertised, and the property posted for public hearings and second readings of the ordinances on February 4, 2020; and WHEREAS, on February 4, 2020, prior to the scheduled public hearing, the Applicant formally withdrew the applications; and WHEREAS, pursuant to Section 20-5.6(D) of the Land Development Code, "...if withdrawn after advertisement for a public hearing or posting of the property, the same or substantially similar applications governing the same property shall not be resubmitted for a period of at least one (1) year except at the request of a majority of the commission it can be heard after a period of six (6) months after the date established for the prior hearing"; and WHEREAS, the Applicant is preparing a new concept plan that includes single-family homes along the northern property abutting existing single-family homes and the remainder of the site developed with two-family structures; and WHEREAS, the proposed application will request single-family zoning and land use for the northern portion of the site and RT 9 zoning and Townhouse Residential land use for the remainder of the property; and WHEREAS, with the proposed revision to the application and plan are dissimilar from the application and plan that was withdrawn in February; and NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSIONERS OF THE CITY OF SOUTH MIAMI, FLORIDA: Section 1. The foregoing recitals are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution upon adoption hereof. Section 2. Fellowship Church is hereby expressly authorized to submit an application for the property generally located northwest of the SW 72'd Street and SW 61P Avenue for a Future Land Use Map amendment to Single -Family Residential and Townhouse Residential and a Zoning Map amendment to a single-family zoning district and RT 9. Conforming language or technical scrivener -type corrections may be made by the City Attorney for any conforming amendments to be incorporated into the final resolution for signature. Section 4. Severability. If any section, clause, sentence, or phrase of this resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this resolution. Section 5. Effective Date. This resolution shall become effective immediately upon adoption. PASSED AND ADOPTED this 201h day of October, 2020.
