An Ordinance amending the City of South Miami Code of Ordinances, Chapter
17 titled "Streets and Sidewalks", Article I, Sec. 17-10.1. titled "Guidelines for
naming City property and roadways".
WHEREAS, currently, Section 17-10.1 allows for the naming of public property to
posthumously honor a person and it allows for the City Commission to waive that requirement;
and
WHEREAS, a resolution was submitted by a sitting commissioner. to name a sidewalk
after a person who was believed to have been arrested over 15 times; and
WHEREAS, Jose Canseco, who admitted to steroid use during his time as a Major
League Baseball player and has been charged multiple times with battery, had a street named
after him in Miami-Dade County. In 2009, County Commissioner Joe Martinez asked to have
Canseco's name removed; and
WHEREAS, there is a significant expense associated with each street naming and
sufficient checks should be conducted to ensure that the person who is being honored is an up-
standing citizen who is worthy of recognition; and
WHEREAS, background checks should be required for street namings and should be
included in the backup for street naming resolutions to honor a living person.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. Chapter 17 titled "Streets and Sidewalks", Article I titled "In General",
Sec. 17-10.1. titled "Guidelines for naming city property and roadways", of the City of South
Miami's Code of Ordinances is hereby amended and shall read as follows:
Sec. 17-10.1. -Guidelines for naming city property and roadways.
(a) No naming of a public street or piece of public property shall be approved unless
the person being honored is done so posthumously.
(b) The attachment of any organizational name or likeness to any piece of public
property within the city shall not be entertained unless a contribution in money
and/or other goods and considerations totaling at least ten (10) percent of the
value of that property has been made to the city.
(c) These requirements may be waived by a four-fifths (4/5) vote of the city
commission only after a background check has been conducted and made part of
the backup information for all such resolutions.
Section 2. Codification. The provisions of this ordinance shall become and be made
a part of the Code of Ordinances of the City of South Miami as amended.

Section 3. Severability. If any section, clause, sentence, or phrase of this ordinance
is for any reason held invalid or unconstitutional by a court of competent jurisdiction, this
holding shall not affect the validity of the remaining portions of this ordinance.
Section 4. Ordinances in Conflict. All ordinances or parts of ordinances and all
sections and parts of sections of ordinances in direct conflict herewith are hereby repealed.
Section 5. Effective Date. This ordinance shall become effective upon enactment.
