City Commission Agenda Item Report Meeting Date: September 15, 2020 Submitted by: Thomas Pepe Submitting Department: City Attorney Item Type: Resolution Agenda Section: Subject: A Resolution of the Mayor and City Commissioners of the City of South Miami expressing concerns about the M-CORES process. 3/5 (Commissioner Harris) Suggested Action: Attachments: Reso opposing M-CORES Highway (1).doc 1 Page 1 of 3 RESOLUTION NO. _________________1 2 A Resolution of the Mayor and City Commissioners of the City of South 3 Miami expressing concerns about the M-CORES process.4 5 WHEREAS, on May 17, 2019, Governor Ron DeSanctis signed Senate Bill (SB) 70686 (2019) into law to create the Multi-use Corridors of Regional Economic Significance (M-7 CORES) Program within the Florida Department of Transportation (FDOT), with the stated 8 purpose of advancing construction of regional corridors that will accommodate multiple modes 9 of transportation and multiple types of infrastructure to accommodate population growth; and10 11 WHEREAS,the M-CORES Program proposes to extend certain transportation corridors 12 within the State as tolled facilities and approved turnpike projects as part of the FDOT turnpike 13 system in order to fulfill its stated purpose, which corridors include the Suncoast Connector; and14 15 WHEREAS, the Suncoast Connector is a corridor serving purposes described during16 FDOT's 1-75 Relief Planning Process; and17 18 WHEREAS, SB 7068 and section 338.223, Florida Statutes, lay out numerous19 requirements, such as need, economic feasibility and economic impacts, applicable to planning20 for and evaluating the M-CORES corridors; and21 22 WHEREAS, SB 7068 and section 338.223, Florida Statutes, clearly state the23 requirement for the M-CORES process to address environmental impacts and feasibility; and24 25 WHEREAS,the M-CORES task forces will present a final recommendation report to the26 Governor, House and Senate by November 15, 2020 and construction is set to begin in 2022; and27 28 WHEREAS,FDOT's mission is to provide a safe transportation system that ensures the29 mobility of people and goods, enhances economic prosperity, and preserves the quality of our30 environment and communities; and31 32 WHEREAS,since the SB 7068 was signed, the COVID-19 pandemic has changed33 priorities for Florida; and34 35 WHEREAS, the City of South Miami believes the priority for Florida should be 36 responding to the public health needs of COVI D-19; and37 38 WHEREAS,the City of South Miami believes the resources allocated for the M-CORES 39 toll roads should be reallocated to directly serve the needs of the public brought on by COVID-40 19 and the maintenance of existing roads and bridges.41 42 NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY 43 COMMISSIONERS OF THE CITY OF SOUTH MIAMI, FLORIDA:44 45 2 Page 2 of 3 Section 1.The foregoing recitals are hereby ratified and confirmed as being true and they 1 are incorporated into this resolution by reference as if set forth in full herein.2 3 Section 2.The Mayor and City Commissioners of the City of South Miami hereby 4 express concerns about the M-CORES process and find:5 6 (1) The M-CORES process does not address need, economic feasibility and economic 7 impacts of the three corridors as required by SB 7068 and s. 338.223(1 )(a); and8 (2) Any transportation capacity, operational or safety deficiencies within the region's 9 transportation system should first be met by improvements to existing transportation 10 corridors. New transportation corridors should only be considered as alternatives once 11 significant improvements have been planned and programmed to existing corridors; and12 (3) Any new significant transportation capacity needs between North Florida and Tampa 13 should be met through the provision of passenger and freight rail transportation, with 14 upgrades to the existing rail network to support additional capacity and speed; and15 (4) The funding allocated to M-CORES would be more appropriately reallocated to aid 16 in the response to the COVID-19 pandemic; and17 18 Section 3.The Mayor and City Commissioners of the City of South Miami hereby 19 support adoption and enactment of a "No Build" option by the Governor and the FDOT for the 20 Suncoast Connector Corridor.21 22 Section 4. Instructions to the City Clerk.The City Clerk is instructed to forward a 23 copy of this resolution to:24 25 Governor Ronald Dion DeSantis, 26 State Senate President.; 27 State Speaker of the House; 28 all municipalities in Miami-Dade County, 29 the members of the governing bodies of all 67 counties and their respective league of 30 cities.31 the Florida Cabinet, 32 the Florida League of Cities33 Miami-DadeCounty League of Cities 34 All members of the Miami-Dade Legislative Delegation35 All members of the Miami-Dade County Board of County Commissioners36 Miami-Dade County Manager37 Miami-Dade County Mayor38 39 Section 5.Corrections. Conforming language or technical scrivener-type corrections 40 may be made by the City Attorney for any conforming amendments to be incorporated into the 41 final resolution for signature.42 43 Section 6. Severability.If any section clause, sentence, or phrase of this resolution is for 44 any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall 45 not affect the validity of the remaining portions of this resolution.46 3 Page 3 of 3 1 Section 7.
