Res No 083-20-15523Resolution No. 083-20-15S23 A Resolution of the Mayor and City Commission of the City of South Miami, Florida, authorizing and instructing the City Manager to waive the City's requirement that restaurants In South Miami's Downtown District obtain permits to erect banners, until either Miami -Dade County allows for indoor seating or until September 300; 2020 whichever comes first. WHEREAS, closures associated with the COVID-19 pandemic have resulted in financial stress for several businesses, particularly restaurants in South Miami's Downtown District; and WHEREAS, on July 7*, Miami -Dade County Mayor, Carlos Gimenez issued Amendment No. 2 to Miami -Dade County Emergency Order No. 26-20, ordering that commencing on Thursday, July 9, 2020, all restaurants, cafeterias, and other food service establishments with seating for more than eight people be limited to offering outdoor on -premises service only; and WHEREAS, the City's Land Development Code requires a permit from the City's Planning and Zoning Department for signage Including banners (Article 20-12.15 B); and WHEREAS several restaurants have recently erected banners, without a permit, advertising they are open for business; and WHEREAS, in an effort to lessen the financial burden on restaurants during these unprecedented times, the City Commission desires to temporarily waive the permitting and fee requirements associated with banners. NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSIONERS OF THE CITY OF SOUTH MIAMI, FLORIDA: Section 1. The foregoing recitals are hereby ratified and confirmed as being true and they are Incorporated into this resolution by reference as If set forth in full herein. Section 2. The City Manager is authorized and instructed to allow restaurant's in the Hometown District Overlay Zone and the Downtown SoMi District, as part of the manager's Covid19 executive order, to erect banners advertising that they are open for permissible activities and to waive the City's fee for the erection of banners until December 31, 2020. Section 3. Corrections. Conforming language or technical scrivener -type corrections may be made by the City Attorney for any conforming amendments to be incorporated into the final resolution for signature. Section 4. Severability. If any section clause, sentence, or phrase of this resolution is for Page l of 2 Res. do. 083-20-15523 any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this resolution. Section S. Effective Date. This resolution shall become effective immediately upon adoption. PASSED AND ADOPTED this 215t day of July. 2020.
