APPLICANT'S REQUEST: The applicant has filed a tree removal permit for the removal of the
following trees as shown on the attached Landscape Plan,sheet L-1.1:
• 16 Live Oak Trees
• 5 Royal Poinciana Trees
• 3 Mango Trees
• 2 Dade County Pine Trees
The Applicant has also filed a tree removal permit for the relocation of the following additional trees:
• 7 Live Oak Trees
The permit is approved with the following conditions:
Tree Specifications
All replacements must be Native Hardwoods, Florida Fancy Number I with a minimum height
of 18'-0"unless otherwise stated
I. As per the approval granted by the Environmental Review & Preservation Board on August
18, 2009,the trees listed above are approved for removal. However, as per the City's certified
arborist, Doug Baker,the two (2)Dade County Pines trees are a highly protected species and
are not recommended for removal. Therefore, the following conditions have been placed on
the removal portion of this permit.
1. The removal of the two(2)Dade County Pine trees are not approved for removal.
2. The replacement mitigation must be followed as shown on the attached Landscape Plan,
sheets L-2.0 —L-2.1 which was approved by the Environmental Review & Preservation
Board on August 18,2009.
3. After such time, a final inspection must be held prior to the Certificate of Occupancy
being issued for the new construction residence.

II. As per the approval granted by the Environmental Review & Preservation Board on August
18, 2009, the seven (7) Live Oak trees are approved for relocation. The arborist has placed
the following conditions on the tree removal permit:
A. The relocation of the seven(7)Live Oak trees must comply with the-regulations as set forth in
the Tree Removal Permit Relocation Standards Section 20-4.5(K) of the City of South Miami
Land Development Code,which states:
1. Trees other than palms:
a. Tree roots shall be severed in such a manner as to provide a root ball which is
sufficient to ensure survival of the tree when relocated. A sufficiently-sized planting
hole shall be provided at the relocation site to ensure successful re-growth;
b. After root severing, adequate time shall be allowed prior to replanting to ensure
survival of the tree(s). After root severing and prior to relocation, tree(s) shall be
watered a minimum of twice weekly; and, after relocation, said tree(s) shall be
watered a minimum of twice weekly until the tree(s)are established,
c. During removal and transportation of the tree, the root ball and vegetative portions
of the tree shall be protected from damage from wind or injury; and,
d. Any tree that dies or becomes nonviable within one (1) year of relocation shall be
replaced according to the standards set forth in Section 20-4.5(J)(2) & (3) of the
Land Development Code.
2. Preservation credit for relocated trees. Permittees who successfully relocate trees shall
receive full credit for the relocated trees and the tree replacement requirements herein
shall not apply to such relocated trees. All relocated trees shall meet the standards set
forth above.
B. In the event that any of the trees die or become nonviable within one(1)year of relocation,the
replacement tree shall follow the guidelines listed above for replacement trees.
C. Failure to plant, preserve, or maintain each individual tree shall be considered a separate
violation of the Land Development Code.
III. Pursuant to the Tree Removal Permit — Submittals Section 20-4.5(I)(4)(d) of the City of South
Miami Land Development Code,
1. A performance bond to guarantee compliance with all conditions, limitations, and
restrictions of the tree removal permit, including, but not limited to, planting of all
required replacement trees.
2. The bond shall be equivalent to one hundred fifteen percent(115%) of the estimated cost
of the permitted activity and may be in the form of a letter of credit, surety, cash, or
certificate of deposit.
3. All performance bonds shall remain in force for a minimum of either one (1)year after
the actual completion date of the permitted activity (to ensure that any replanted trees
which perish are replaced), or until viability of all replanted trees has been achieved,
which ever occurs last.
4. At the discretion of the Planning Director,performance bonds may be partially released
in phases based upon partial completion ofplanting or other permit requirements.

The intent of this bond calculation sheet is to provide the calculations in regards to the requirements of
the performance bond.
Pursuant to the Tree Removal Permit—Submittals Section 20-4.5(I)(4)(d) of the City of South Miami
Land Development Code,
i. A performance bond to guarantee compliance with all conditions, limitations, and
restrictions of the tree removal permit, including, but not limited to, planting of all
required replacement trees.
U. The bond shall be equivalent to one hundred fifteen percent(11 S%) of the estimated cost of
the permitted activity and may be in the form of a letter of credit, surety, cash, or
certificate of deposit.
iii. All performance bonds shall remain in force for a minimum of either one (1)year after the
actual completion date of the permitted activity (to ensure that any replanted trees which
perish are replaced), or until viability of all replanted trees has been achieved, which ever
occurs last.
iv. At the discretion of the Planning Director,performance bonds may be partially released in
phases based upon partial completion ofplanting or other permit requirements.

The calculations are as follows:
1. The estimated price for relocating one(1)Live Oak tree is$350.00 per tree.
2. The applicant wants to relocate seven(7)Live Oak trees,therefore the price for these trees is:
$350.00 x 7 =$2,450.00
3. Pursuant to Section 20-4.5(I)(4)(d)(ii) of the Land Development Code, The bond shall be
equivalent to one hundred fifteen percent (115%) of the estimated cost of the permitted
activity and may be in the form of a letter of credit, surety, cash, or certificate of deposit.
Therefore:
$2,450.00 x 115% =$2,817.50

Mr. Rivera questioned if the number of Live Oaks being removed would increase or decrease the
total number of trees. The applicant responded that it would be a reduction in the amount of
trees.
Mrs. Morales-Fernandez questioned if the seven Live Oaks being relocated are included in the
total number of Live Oaks being relocated. The applicant replied that the Live Oaks are in
addition to the sixteen. Mrs. Morales-Fernandez questioned why the Live Oaks along the
property line are going to be removed. The applicant responded that the trees are under power
lines and when cut they looked as if they are "hat racked" and it does not look appealing.
Mr. Bedell questioned how close was the fence in relation to the property line. The applicant
replied that the fence is four feet inside the property line.
The applicant provided the Board with a current photograph of the Live Oaks that will be
removed since they are under the power line.
Mr. Bedell commented that when Florida Power and Light comes to trim the trees they do not
look so pleasant and FPL only comes once or twice a year to trim the trees under the power line.
He recommended trees that do not grow as tall as the present ones, to be planted in that area.
Mr. Trautman questioned if the Live Oaks are located on the west side of the property and does
FP&L trim trees that are located on the west side of a property. The applicant responded yes. Mr.
Bedell responded that FPL does trim trees which are under a power line.
Motion: Mr. Bedell moved and Mrs. Mark seconded to approve the application as presented.
Vote: 6 Approved 0 Opposed
V. APPROVAL OF MINUTES: Mr. Bedell moved to approve the minutes of August 18, 2009
without corrections. Mr. Trautman seconded.

APPLICANT'S REQUEST: The applicant has filed a tree removal permit for the removal of four
(4)Mango trees. The applicant h also filed a tree removal permit for the relocation of six (6) Royal
Poinciana trees and eight(8)Live k trees.
The permit is approved with the followin conditions:
All replacements must be Native Hardw ds, Florida Fancy Number I with a minimum height
of 12'-0 to 14'-Vunless otherwise stated.
1. The four (4) Mango trees are approved for oval. The proposed landscape plan for the new
development mitigates the canopy replacement or these trees. Therefore, no replacements will
be required.
11. The relocation of the six (6) Royal Poinciana trees a d eight (8) Live Oak trees must comply
with the regulations as set forth in the Tree Removal rmit Relocation Standards Section 20-
4.5(K)of the City of South Miami Land Development Co which states:
1. Trees other than palms:
a. Tree roots shall be severed in such a manner as provide a root ball which is
sufficient to ensure survival of the tree when relocat . A sufficiently-sized planting
hole shall be provided at the relocation site to ensures cessful re-growth;
b. After root severing, adequate time shall be allowed pr r to replanting to ensure
survival of the tree(s). After root severing and prior to r ocation, tree(s) shall be
watered a minimum of twice weekly; and, after relocatio said tree(s) shall be
watered a minimum of twice weekly until the tree(s) are establi ed;
c. During removal and transportation of the tree, the root ball an vegetative portions
of the tree shall be protected from damage from wind or injury; an
d. Any tree that dies or becomes nonviable within one (1) year of re cation shall be
replaced according to the standards set forth in Section 20-4.5(J) & (3) of the
Land Development Code.
2. Preservation credit for relocated trees. Permittees who successfully relocate ees shall
receive full credit for the relocated trees and the tree replacement requiremen herein
shall not apply to such relocated trees. All relocated trees shall meet the standa s set
forth above.
III. In the event that any of the trees die or become nonviable within one (1) year of relocation, the
replacement tree shall follow the guidelines listed above for replacement trees.

IV. Failure to plant, preserve, or maintain each individual tree shall be considered a separate
violation of the Land Development Code.
V. The trees are not to be removed until the ERPB has issued its final approval for the site plan.
