ERPB Mins 09-1-2009 Pg 1 of 4 f t Mr. Rivera questioned if the number of Live Oaks being removed would increase or decrease the total number of trees. The applicant responded that it would be a reduction in the amount of trees. Mrs. Morales-Fernandez questioned if the seven Live Oaks being relocated are included in the total number of Live Oaks being relocated. The applicant replied that the Live Oaks are in addition to the sixteen. Mrs. Morales-Fernandez questioned why the Live Oaks along the property line are going to be removed. The applicant responded that the trees are under power lines and when cut they looked as if they are "hat racked" and it does not look appealing. Mr. Bedell questioned how close was the fence in relation to the property line. The applicant replied that the fence is four feet inside the property line. The applicant provided the Board with a current photograph of the Live Oaks that will be removed since they are under the power line. Mr. Bedell commented that when Florida Power and Light comes to trim the trees they do not look so pleasant and FPL only comes once or twice a year to trim the trees under the power line. He recommended trees that do not grow as tall as the present ones, to be planted in that area. Mr. Trautman questioned if the Live Oaks are located on the west side of the property and does FP&L trim trees that are located on the west side of a property. The applicant responded yes. Mr. Bedell responded that FPL does trim trees which are under a power line. Motion: Mr. Bedell moved and Mrs. Mark seconded to approve the application as presented. The applicant responded that the material is a green FinLink material that will cover the wood fence which is surrounded by a chain link fence. Mr. Trautman questioned if the purpose of the generator is as an emergency back up. The applicant replied yes. Therefore, the applicant is requesting approval from the ERPB for the installation of landscaping for the new single family residence. Staff Analysis: The applicant has submitted plans for review by the ERPB that include the Boundary & Tree Survey, Existing Tree Disposition Plan, Aerial of the property in question, Planting Plan, and Irrigation Plan. Property Survey As per the attached Boundary & Tree Survey prepared by Blanco Surveyors Inc. on April 8, 2008 and revised August 4, 2008, the vacant property presently shows the following existing trees: • 2 Pine trees • 28 Live Oak trees • 7 Royal Poinciana trees • 5 Mango trees • 1 Palm tree Tree Removal: The applicant has previously submitted a tree removal permit to the Planning and Zoning Department for the removal and relocation of several trees. As per the Existing Trees — Disposition Chart on sheet no. The sixteen (16) Live Oak trees and two (2) Pine trees that are scheduled for removal are located along the western perimeter of the property, beneath power lines. Also shown on sheet no. L-1.1 is the relocation of the following trees: • 7 Live Oak trees The relocation of the above listed trees are subject to the regulations listed in Section 20-4.5(K)(1) of the Land Development Code. A performance bond is being required as a condition for the relocation and removal of the above listed trees. The amount of which, will be determined by the City's Certified Arborist. Pursuant to Section 20-4.5(I)(4)(d)(i) of the Land Development Code, The Planning Director may require the posting of a performance bond to guarantee compliance with all conditions, limitations, and restrictions of the tree removal permit, including, but not limited to, planting of all required replacement trees. It should be noted that the plans submitted with the tree removal permit do not match the proposed plans that were submitted for review by the ERPB. Therefore, before the tree removal permit can be issued, it must be updated with new plans that will be reviewed by the City's Arborist. Proposed Planting: To compensate for the removal of the above listed trees, the applicant is proposing the planting of the following trees among other species of vegetation: • 7 Gumbo Limbo trees • 15 Pigeon Plum trees • 2 Bridalveil trees • 6 Geiger trees • 4 McArthur Palm trees • 1 Cattley Guava trees Pursuant to Section 20-4.5(D)(5)(b) of the Land Development Code, The minimum number of trees required under Section 20-4.5 for landscape plan submittals shall be as follows: MWL Y:\ERPB\ERPB Agendas\2009 ERPB AGENDAS\September 1,2009\ERPB-09-057.doc 6835 SW 67th Street ERPB-09-057 presented on September 1, 2009 Landscape Installation Page 3 of 4 Zoning Districts No. of Trees Required per (and proposed districts) Net Acre or Lot RS-1 9 trees per acre of net lot area The size of the property is 48,970 square feet, which equals 1.12 acres. 1.12Acres X 9Trees =10.08Trees � 11Trees 1 lAcre Based on the calculation listed above, the property will require the planting of eleven (11) trees in order to satisfy Section 20-4.5(D)(5)(b) of the Land Development Code. The applicant is proposing the planting of thirty-five (35) trees, all of which have a minimum height of at least ten (10) feet. It is important to note that as per the Mitigation Notes shown on sheet L-2.0, the following information is shown: 1_. The removal of the five (5) Royal Poinciana trees will be mitigated by six (6) Geiger trees. 2. The removal of eighteen (18) Live Oak trees under the power lines will be mitigated with seven (7) Gumbo Limbo trees and fifteen (15) Pigeon Plum trees. 3. Removal of three (3) Mango trees will not require mitigation 4. The owner is to place a performance bond as required by the City of South Miami for the trees that will be relocated. The second mitigation note should be revised to reflect the correct amount and type of trees being removed from that area. The proposed mitigation is subject to approval by the City of South Miami. After review of the plans provided, it has been determined that they are in compliance with Section 20-4.5 of the Land Development Code. Recommendation: Approval with the following conditions: 1. Meet requirements as set forth in the Adopted Stormwater Ordinance No. 06-07- 1907; 2. Meet the Public Works Department comment that driveway curb cuts are not to exceed twenty feet, as per Miami-Dade County Public Works manual; 3. Update and complete the tree removal permit currently on file with the Planning and Zoning Department; 4. Item #2 of the Mitigation Notes on sheet L-2.0 must be revised to reflect the correct amount and type of trees being removed; 5. The installation of a permanent generator will require a separate permit; 6. Shading must be provided for all mechanical units; and 7. Any comments and/or suggestions from the Board. Mr. Trautman questioned if the item was being reviewed for final approval. Mrs. Cabrera-Hernandez responded yes. Mr. Jude questioned if final approval could be given without the landscaping plans. Mrs. Cabrera- Hernandez replied that the report was separated to allow the applicant more time to complete the ERPB Mins Excerpt 07-21-2009 Pg 1 of 3 landscape plan. Mr. Trautman questioned if the separation of a report has been done before. Mrs. Cabrera-Hernandez responded that not typically, but yes. The applicant commented that the reason why the landscaping is not completed is because the landscape architect has been waiting for the arborist comments. He further commented that the landscaping has not changed from what was previously approved. Mr. Bedell questioned if during the preliminary review the landscape plans were attached. The applicant responded yes and could be viewed in the minutes for February 17, 2009. Mr. Lightfoot commented that the Landscape Tree Removal Permit has been completed and the applicant could pass by after the meeting to receive the comments. The applicant commented that as of this moment there is a row of Oak trees that are going to be preserved at the edge of the property and will include more plantings. Mr. Trautman questioned if the applicant could give a description on the sustainable design principles. The applicant replied that the main paver is designed for percolation, glass that will help with the sun penetration and high energy efficiency units to recycle energy. He commented that they are looking for more resources to have to contribute to an energy efficient house. Mr. Trautman commented that during the introduction it was stated by a letter that solar panels would be placed on the house. The applicant replied that the solar panels were removed due to issues with the parapet and cost. Mr. Trautman suggested rethinking the use of solar panels since there are tax credits and rebates for anyone who installs them. Tax incentives are given to lower energy bill. The applicant commented that they are still looking into more energy saving resources. Mr. Chandler questioned the air conditioning seer level and the notes of the glass low "e" safety impact glass. Mr. Chandler questioned if the AC was a high quality unit. Mr. Trautman commented that it should be seen in the mechanical plans; in M-3, in the split AC unit section. Mr. Trautman suggested that the applicant make sure that the previously mentioned glazing is a double glazing. The pavers that are chosen include a reflective index above twenty- nine. When the landscaping is looked at,the main thing objective will be to bring the heat level of the house down. Mr. Jude commented that the landscaping will be looked at quite seriously and understands the challenges that the applicant has had with having the arborist come out to his location. Motion: Mr. Trautman_moved and Mr. Balli seconded to approve the application with the conditions that the landscaping will be submitted at a later date. The Board will review the landscaping in great measure and will be used to mitigate the environmental impact on the house.
