Res No 103-20-15543RESOLUTION NO. 103-20-iSS43 A Resolution authorizing the City Manager to purchase Property Insurance including Property and Crime, Boiler and Machinery, General Liability, Law Enforcement Liability, Auto Liability, Public Officials Liability, Employment Practices Liability, Cyber Liability, and Worker's Compensation Insurance from Public Risk Management of Florida (PRM) for Fiscal Year 2020-2021. WHEREAS, the insurance marketplace for Municipalities is limited; and WHEREAS, City staff through World Risk Management, Florida Municipal Insurance Trust, and through its Agent of Record, Brown & Brown, solicited and received Independent insurance quotes for Property Insurance Including Boiler and Machinery, General Liability Insurance, Automobile Liability and Damage Insurance, Inland Marine Insurance, Crime/Fidelity Insurance, Law Enforcement Liability Insurance and Worker's Compensation Insurance; and WHEREAS, the City received a competitive quote from PRM in the amount of $559,632; and WHEREAS, the City Staff recommends that the City elect coverage with PRM for all above Insurances for 2020-2021 Fiscal Year based upon the current proposal; and WHEREAS, the premium amount shall be charged to departmental line items in their respective account numbers. NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT: Section 1. The foregoing recitals are hereby ratified and confirmed as being true and they are incorporated into this resolution by reference as if set forth in full herein. Section 2. The City Manager is authorized to purchase the insurance policy for PRM for Property Insurance including Boiler and Machinery, General Liability Insurance, Automobile Liability and Damage Insurance, Inland Marine Insurance, Crime/Fidelity Insurance, Law Enforcement Liability Insurance and Worker's Compensation Insurances for the 2020-2021 Fiscal Year. Section 3. Corrections. Conforming language or technical scrivener -type corrections may be made by the City Attorney for any conforming amendments to be incorporated into the final resolution for signature. Section 4. Severability. If any section clause, sentence, or phrase of this resolution is for any reason held Invalid or unconstitutional by a court of competent jurisdiction, the holding shall Resolution No. 103-20-15543 not affect the validity of the remaining portions of this resolution. Background: City staff solicited and received through World Risk Management, a proposal from Public Risk Management of Florida (PRM), and through its agent of record, Brown & Brown, received a renewal proposal for from PGIT. Staff also solicited a proposal from Florida Municipal Insurance Trust (FMIT) but was advised FMIT could not be competitive at this time. The proposal offered by PRM was not only lower than the proposal offered by PGIT, but it includes better coverages with lower deductibles. The following table is the breakdown of the coverages and costs offered by PRM: PRM Summary of Proposed Premiums: Property & Crime $155,805 Boiler and Machinery $ 1,786 GL/LEL/AL/E&O/Excess Liability $239,205 Workers' Compensation $108,785 OTAL $559,58 The PRM proposal offers a 6.25% decrease from the City's current plant with PGIT and ACE/CHUBB and a 25.8% decrease from the renewal offered by PGIT and ACE/CHUBB for the 2020-2021 FY. The City can rest assured that we have the knowledge, expertise, and relationships to deliver on the needs and expectations of the City. 2. Broadest Coverage Available in Florida — PRM's size and structure allow them to provide members the broadest coverage available at the most cost-effective price. The coverage enhancements available through PRM are considerable and are briefly highlighted below: • The PRM offering provides standard limits of $2 Mil for Auto, General, and Public Officials Liability; • PRM does not charge for mid-term additions of vehicles and equipment. Additionally, there is no charge for additions to real property up to $25 Mil in value; • PRM provides $25 Mil in Increased Cost of Construction/Ordinance & Law ensuring ample coverage whereas the City's current program only offers a $500,000 limit, leaving the City with significant exposure and out of pocket expenses in the event of a loss. • PRM's property sublimity are significantly higher than the competing pools in Florida which will result in higher payouts to the City and significantly lower out-of-pocket costs; • The PRM offering provides a reduced deductible structure significantly reducing the City's out-of- pocket expenses. Program Stability & Dynamic - The financial position of Public Risk Management of Florida [PRM) public entity insurance association is categorized as notably stable and secure. Formed in 1987, PRM has consistently provided a quality and constant alternative to the general insurance marketplace. PRM is not a rapid growth association and has retained a tremendous percentage of long-term clients; currently including 62 members that comprise of counties, cities and special districts in Florida. The pool does not retain any risk on catastrophic property coverage (wind or flood) and cedes all the risk to A.M. Best "A - Rated" or better carriers. PRM's premium -to -surplus ratio exceeds pooling industry standards. Additionally, PRM is the only association of its kind that is Membership Driven, whereby members have a voice as it relates to the direction of the association overall. Entities that purchase all lines of insurance from PRM are automatically granted a seat on the Board of Directors, which is comprised of representatives of each association member. Board members set policy which is then carried out by the Executive Board and the PRM Executive Director. This voice allows our members to have overall control on the direction of the association which can include, but is not limited to, requests for improved services, expanded coverages or even deeper surplus credits. PRM holds quarterly board meetings, which all board members are encouraged to attend, for updates and to exercise their right to vote. 4. Pricing/Cost Savings —The offering through PRM is materially competitive across all lines of coverage. The PRM quote offers compellingly better coverage at a lower cost than the expiring PGIT program. The offering through PRM will save the City approximately $37,000 Year One off the expiring premium. As the PRM offering is providing a two-year rate guarantee, those savings are compounded to over $70,000, providing significant savings to the City over the next two years.
