A Resolution relating to the review and approval of a Unity of Title request to
unify the properties located at 5835 Commerce Lane (folio 094025-028-1330)
and 5839 Commerce Lane (folio 09-4025-028-1320).
WHEREAS, Jonathan Stoner, the owner of the property located at 5835 Commerce
Lane (folio 09-4025-028-1330) and representative of 5839-41 Commerce LLC, the owner of
the property looted at 5839 Commerce Lane (folio 09-4025-028-1320), submitted a request for
Unity of Title to combine the two (2) properties together; and
WHEREAS, the property is developed with a building that is located on both parcels
which, under the current code, would require a Unity of Title be recorded prior to the issuance
of a building permit; and
WHEREAS, the applicant currently does not have any redevelopment projects that are
under review by the City; and
WHEREAS, the applicant owns an automobile repair business in the portion of the
existing one-story commercial building that is located at 5835 Commerce Lane; and
WHEREAS, pursuant to Section 20-3.3(D) of the Land Development Code, a Special
Use approval is required prior to the operation of an "Automobile Repair/Body Shop" use; and
WHEREAS, because a portion of the building is located at 5839 Commerce Lane, a
Special Use permit would be required for the operation of an "Automobile Repair/Body Shop"
use in that portion of the building; and
WHEREAS, the applicant is requesting the Unity of Title so that the "Automobile
Repair/Body Shop" use can be used throughout the entire commercial building; and
WHEREAS, the Planning & Zoning Department reviewed the Unity of Title request
and finds it in compliance with the requirements of Section 20-5.16 of the Land Development
Code; and
WHEREAS, the Unity of Title must be approved by the City Commission and approved
by the City Attorney as to form and content and shall then be recorded in the public records of
Miami -Dade County prior to the issuance of any building permits.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MUM, FLORIDA:

A Resolution relating to the review and approval of a Unity of Title request to unify the
properties located at 5835 Commerce Lane (folio 09-4025-028-1330) and 5839 Commerce Lane

BACKGROUND:
Mr. Jonathan Stoner, the owner of the property located at 5835 Commerce Lane and the
representative of 5839-41 Commerce LLC, the owner of the property located at 5839 Commerce
Lane, is requesting approval from the City Commission for a Unity of Title. The property is
developed with a one-story commercial building that sits on both of the properties. Mr. Stoner
currently has no plans to redevelop the site and has not submitted any building permits to the
City for review. Per the attached letter of intent that was provided by Mr. Stoner, he is requesting
the approval so that he can continue the operation of his automobile repair business.
ANALYSIS:
Pursuant to Section 20-5.16(A) of the Land Development Code (LDC), a Unity of Title shall be
required in the following cases:
1. Whenever the building site consists of more than one lot or parcel and the main
building is located on one lot or parcel and auxiliary or accessory use buildings are
located on the remaining lot or parcel comprising the building site.
2. Whenever the building site consists of more than one lot or parcel and the main
building is located on one or more of the lots or parcels and the remaining lots or
parcels encompassing the building site are required to meet the minimum zoning
requirements.
3. Whenever a unity of title is required by a provision within this Code or is specifically
required by an ordinance or resolution passed and adopted by the city commission.

Presently, the applicant has a license to operate an "Automobile Repair/Body Shop" out of the
portion of the building located at 5835 Commerce Lane. Pursuant to Section 20-3.3(D) of the LDC,
special use approval is required for an "Automobile Repair/Body Shop" use. Because a portion of
the building is located on a separate property, the applicant would be required to file a Special
Use application if he wanted to use the entire building for his business. Because of that, the
applicant is requesting the Unity of Title so that he can continue operating his automobile repair
business out of the entirety of the existing building. There are no development projects planned
that would require a Unity of Title. Typically, the City would not review a Unity of Title in this
situation. However, at the request of the applicant, the Unity of Title has been submitted for
review.
PLANNING BOARD RECOMMENDATION:
Not applicable. Unity of title applications are not reviewed by the Planning Board.
RECOMMENDATION:
Staff recommends that the Unity of Title request for the properties listed below be approved.

4. Release, This Unity of Title shall not be released except upon approval by resolution

Attorney, executed by the City Manager and attested to by the City Clerk. The release of the Unity of
Title is contingmt upon the cessation of the current conditions, as well as the cessation of any fu im
condition, that require the execution and recording of a Unity of Title and provided there is no
further reason to maintain the Unity of Title on the public records in order to comply with the
City's Land Development Code.
S. Term This Unity of Title is to run with the land and shall be binding on all persons
claiming an interest in the Property for a period of thirty (30) years from the date that this Unity
of Title is recorded and after which time its term shall be extended automatically for successive
periods of ten (10) years each, unless it is released. The City shall have the right to re-record this
Unity of Title from time to time, at the City's own expense, in the City's sole discretion.
6. Enforcement. The City, in its sole discretion, may take action against any person who
violates, or attempts to violate, any of the terms of this document and the City shall have the
right to injunctive relief for specific performance, in addition to any other remedies available at
law, in equity or both.
7. Authorization for the City to Withhold Permits and Inspections. In the event the
teems of this Unity of Title are not being complied with, in addition to any other remedies
available, the City is authorized to withhold the issuance of any further permits and refuse to
make any inspections or grant any approvals, until such time as the Property is in compliance
with this Unity of Title.
8. Election of Remedies. All rights, remedies and privileges granted herein shall be
deemed to be cumulative and the exercise of any one or more shall neither be deemed to
constitute an election of remedies, nor shall it preclude the party exercising the same from
exercising such other additional rights, remedies or privileges.
