Res No 097-20-15537RESOLUTION NO.097-20-15537 A Resolution of the Mayor and City Commission of the City of South Miami, Florida authorizing and encouraging the City Manager to suspend enforcement of the City's sign code as it relates to signs that are necessary for the new normal mode of conducting business during the Covid-19 pandemic state of emergency. WHEREAS, businesses are struggling to cope with the new normal mode of doing business during the Covid-19 pandemic; and WHEREAS, the City's sign code prohibits many of the signs that businesses need to erect to give Covid-19 related instructions, including where to go to do a vehicle pick-up for take out orders, etc; and WHEREAS, the Mayor and City Commission desires to request a suspension of those sign codes that would prevent businesses from giving Covid-19 related instructions to customers. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: Section 1. The foregoing recitals are hereby ratified and incorporated by reference as if fully set forth herein. Section 2. The City Manager is hereby authorized and encouraged to suspend the enforcement of the City's sign code that relates to signs that are necessary for the new normal mode of conducting business during the Covid-19 pandemic state of emergency. Section 3. Corrections. Conforming language or technical scrivener -type corrections may be made by the City Attorney for any conforming amendments to be incorporated into the final resolution. Section 4. Severability. If any section, clause, sentence, or phrase of this resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, this holding shall not affect the validity of the remaining portions of this resolution. Section 5. Effective Date. This resolution shall become effective upon adoption. PASSED AND ADOPTED this 4th day of Aueust 2020.
