An Ordinance related to the fee schedule; amending Ordinance 12-18-2301 related to the tennis
fee schedule at Dante Fascell Park, community pool schedule at Murray Park Aquatic Center,
and football and cheerleading program fee schedule to revise descriptive language and fees, to
add new fees, and to delete some fees.
WHEREAS, the Mayor and Commission adopted the City's "Schedule of Fees and Fines," which
includes descriptive language related to community pool fees at Murray Park Aquatic Center and tennis
fees at Dante Fascell Park. The adopted fee schedule also entails program fees for the City's Grey Ghost
Football and Cheerleading programs; and
WHEREAS, it has come to staffs attention that the defined age class is inconsistent for active
senior citizens who participate in tennis (55+) at Dante Fascell Park and public open swim (60+) at Murray
Park Aquatic Center from active senior members who register for a membership at the fitness center
(65+) or enroll in the Silver Sneakers program (65+) at the Gibson -Bethel Community Center; and
WHEREAS, after further review and consideration, the Mayor and City Commission desire to
adopt a homogeneous age class where applicable for all senior citizens that participate in the City's
recreation programs and activities, including tennis related activities at Dante Fascell Park and public
open swim at Murray Park Aquatic Center, and raise the age to 65; and
WHEREAS, in 2016, the City's Parks and Recreation Department assessed its youth tackle football
and cheerleading programs. Three (3) years later, department staff conducted a benchmark study and
discovered that the average rate for resident and non-resident program fees are approximately $156 and
$170, respectively, per participant; and
WHEREAS, there were more non-resident participants (103) compared to resident football
participants (82) during the 2018 youth tackle football season; and
WHEREAS, the City's fiscal budget impact has increased drastically for both programs over the
past three years (FY-16) with cheerleading showing the highest increase at 279% and football at 55%
increase; and
WHEREAS, based on the information written in the attached memo, City staff is proposing a new
fee schedule for both football and cheerleading starting at $80 for residents and $160 for non-residents.
City staff believes the proposed fee structure is reasonable for residents and will help offset operating
costs associated with both programs.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY
OF SOUTH MIAMI, FLORIDA THAT:
Section 1: The Schedule of Fees and Fines, as approved in Ordinance 12-18-2301, is hereby
amended as follows:

Section 2: The most recently adopted Schedule of Fees Ordinance 12-18-2301, hereto
attached, shall remain in full force and in effect and shall include the new amended language and
fees as outlined in the whereas clauses. Any such fees may be waived or reduced by the Mayor and
City Commission by way of Resolution.

Section 3: Severability. If any section clause, sentence, or phrase of this resolution is for any
reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not
affect the validity of the remaining portions of this resolution.
Section 4: Ordinances in Conflict. All ordinances or parts of ordinances and all sections and
parts of sections of ordinances in direct conflict herewith are hereby repealed.
Section 5: Effective Date. This ordinance shall become effective upon enactment.

Community Pool - Daily Fees: Senior (age 65+)
Under the proposed plan, the defined senior age class will be 65 or older
across the board. Seniors must show ID to prove eligibility for discounted
program where applicable. The Parks and Recreation Department reserves
the right to request additional documentation to prove eligibility.
In 2016, the City's Parks and Recreation Department conducted an
assessment of its youth tackle football and cheerleading programs. Three (3)
years later, department staff conducted a benchmark study and discovered

There were a total of 185 youth football participants during the 2018 football
season. More non-residents (103) participated in the football program than
residents (82). Cheerleading participants only accounted for six (6) non-
residents and twenty-nine (29) residents.
The City's fiscal budget impact has increased drastically for both programs
over the past three years (FY46) with cheerleading showing the highest
increase at 279% and football at 55% increase.
The City is currently charging residents $75 dollars and non-residents $90
dollars per participant for football and cheerleading. City staff is proposing a
new fee schedule for both football and cheerleading starting at $80 for
residents and $160 for non-residents. City staff believes the proposed fee
structure is reasonable for residents, prevents overcrowding participation
from non-residents, and will help offset operating costs associated with both
programs. Both current and proposed fee schedules are outlined below.
