An Ordinance relating to the year 2020 General Election of the Mayor
and City Commissioners for Groups, II and III; scheduling the day,
place and time of the election; providing for qualification of
candidates; providing for close of election books; approving the sample
ballot; providing for notification.
WHEREAS, Article V, Section 2A, of the City of South Miami Charter provides
that the City Commission of the City of South Miami shall schedule a general election for
February of each even year, and that the Mayor shall be elected for a term of two (2)
years and commissioners shall be elected for terms of four (4) years at the general
election; and
WHEREAS, Article V, Section 2D, of the City of South Miami Charter provides
that no person may appear on the Ballot for Election as Mayor or City Commissioner if,
by the end of his or her current term of office, the person will have served (or, but for
resignation would have served) in office as the Mayor or as a City Commissioner for a
total of nine years or more; and
WHEREAS, the Charter requires the City Commission of the City of South
Miami to schedule the day, place and time of the general election by ordinance; and
WHEREAS, state law requires election books to close twenty-nine (29) days prior
to the election.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. The 2020 General Election will be held on Tuesday, February 11,
2020. On that date, a mayor will be elected to serve a term of two (2) years, and two (2)
Commissioners, one from Group II and one from Group III, will be elected to serve a
term of four (4) years. Early voting shall occur on Saturday, February 8, 2020, from 9:00
a.m. through 5:00 p.m.
Section 2. The qualifying period (not less than 60 days before the election) for
this election shall open Monday, December 2, 2019 and close Thursday, December 12,
2019 (excluding weekend), from 9:00 a.m. through 5:00 p.m. sharp each day. Candidates
shall qualify at the office of the City Clerk, 6130 Sunset Drive, South Miami, Florida.
' City Charter, Article V, Section 1, Qualifications. B. Candidates: The City Clerk shall certify that a candidate for
election to the Office of the Mayor or Commissioner, no less 60 days prior to a duly schedule election has: (1)

pay....... (3) Taken the following prescribed sworn oath: ****

Section 3. Voting shall be conducted at City Hall in the City Commission
Chamber, 6130 Sunset Drive, South Miami, Florida. The polls shall open precisely at
7:00 a.m. and close precisely at 7:00 p.m.
Section 4. The sample ballot for the 2020 general election is annexed to this
ordinance.
Section 5. The voter registration book for this election shall close on Monday,
January 13, 2020 (29 days before the election; s.97.O55(1)(a)).
Section 6. The City Clerk shall publish notice of such general election once a
week for four consecutive weeks next preceding the general election in a newspaper of
general circulation in South Miami.2 The notice shall contain the date, time, and place of
the general election and identify each of the Commission Groups under which a
candidate may qualify for election.
Section 7. If any section, clause, sentence, or phrase of this ordinance is for any
reason held invalid or unconstitutional by a court of competent jurisdiction, the holding
shall not affect the validity of the remaining portions of this ordinance.
Section 8. All ordinances or parts of ordinances in conflict with the provisions
of this ordinance are repealed.
Section 9. This ordinance shall take effect immediately upon enactment.

2 Charter, Article Vl, Section 3. Whenever publication is required herein, such publication shall be made
by posting, at a conspicuous place in the City Hall, for the requisite period and, if the publication is of an
ordinance, said ordinance shall, at least ten (10) days prior to adoption, be noticed once in a newspaper of
general circulation in the City of South Miami. The notice of proposed enactment shall state the date, time
and place of the meeting, title or titles of the proposed ordinance, and the place or places within the City
of South Miami where such proposed ordinance may be inspected by the public. Said notice shall also
advise that interested parties may appear at the meeting and be heard with respect to the proposed
ordinance.
