An Ordinance amending the City of South Miami Code of Ordinances, Chapter
2, Article II, Section 2.8 to clarify the check signing authority of City officers
and the Finance Director.
WHEREAS, currently all City checks must have two signatures; and
WHEREAS, section 2-8(f) of the City's Code of Ordinances states:
(f) In the absence of the director of finance or the city manager, the city clerk shall
sign or countersign all checks.
WHEREAS, the Mayor and City Commission desire to amend Chapter 2, Article II,
Section. 2.8. titled "Finance Department" of the City's Code of Ordinances to clarify that all
checks must be signed by the two individuals who hold the office of City Manager and the
position of Finance Director and that the City Clerk only has signing authority if one of those
two individuals are unable to sign the check.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. Chapter 2, Article II, Section. 2.8(f), titled "Finance Department", of the City
of South Miami's Code of Ordinances, is hereby amended and shall read as follows:
Sec. 2-8. - Finance department.
The finance department shall be under the supervision of the director of finance and shall
have the following duties:

City Manager. However, if one of them is unable to sign the check, the City Clerk may
sign the check in that person's stead. In any event, all City checks must be signed by two
of the three individuals authorized by this subsection.
Section 2. Codification. The provisions of this ordinance shall become and be made a
part of the Code of Ordinances of the City of South Miami as amended.
Section 3. Severability. If any section, clause, sentence, or phrase of this ordinance is
for any reason held invalid or unconstitutional by a court of competent jurisdiction, this holding
shall not affect the validity of the remaining portions of this ordinance.
Section 4. Ordinances in Conflict. All ordinances or parts of ordinances and all
sections and parts of sections of ordinances in direct conflict herewith are hereby repealed.

Section 5. Effective Date. This ordinance shall become effective upon enactment.
