Ord No 22-20-2376ORDINANCE NO.22-20-2376 An Ordinance establishing a moratorium on the payment of outdoor seating fees for both new and existing outdoor seating applications until a date certain. WHEREAS, pursuant to Section 20-3.3(E)(3) of the Land Development Code, The fee for outdoor seating/dining permit shall be charged annually, and paid at the same time as the applicant/permittee pays its business tax receipt, for each outdoor seat located on public rights -of -wary or on any private property contiguous with a public right -of -wary and/or any stand- alone table top with no seating which is provided in conjunction with the sale of, or intended to be used for, or in the course of, the consumption of beverages or food If the applicant has an existing restaurant, the initial fee shall be prorated based on the time remaining before the applicant's business tax receipt expires The permit fees to be charged shall be set forth in the City's Schedule of Fees and Fines. The permit fee shall be added to the annual business tax receipt and the payment of all outstanding violation fees for the main business. No outdoor seating/diningpermit shall be issued while the applicant/permittee is delinquent in the payment of any money owed to the City. WHEREAS, pursuant to the Schedule of Fees and Fines, the City charges the following outdoor seating fees: • SeatinyMinina on Public Right -of -Way Each outdoor seat, annual: $65 Each stand-alone tabletop without seating used for consumption of beverages or food, annually: $520 • Seating/Dining on Private Proaerty Annual permit for all outdoor dining/seating : $250 WHEREAS, because of the COVID-19 pandemic, restaurant establishments in the City have been directly affected by the Stay at Home executive order issued by both the Governor of Florida and the Mayor of Miami -Dade County; and NHEREAS, the Mayor and City Commission for the City of South Miami wishes to provide aid to those establishments that currently have outdoor seating areas for patrons. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIANII, FLORIDA: Section 1. The City Commission hereby issues a moratorium on the payment of outdoor seating fees associated with new and existing outdoor seating applications and the City Manager 1 Ordinance No. 22-20-2376 is instructed to discontinue the collection of any outdoor seating application fees during the moratorium. Section 2. The moratorium will expire on September 30, 2021. Section 3. Corrections. Conforming language or technical scrivener -type corrections may be made by the City Attorney for any conforming amendments to be incorporated into the final ordinance for signature. Section 4. Severability. If any section, clause, sentence, or phrase of this ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, this holding shall not affect the validity of the remaining portions of this ordinance. BACKGROUND: In response to the Covid-19 pandemic, both the Governor of Florida and the Mayor of Miami - Dade County enacted executive orders mandating a Stay at Home Order for both the residents and businesses in South Miami in March of 2020. This included the closure of all restaurant dining rooms and outdoor seating areas and limited the sale of food to take out and delivery only. As part of his plan to reopen Miami -Dade County, the Mayor allowed for the limited use of restaurant dining rooms and outdoor seating areas in the latter part of May 2020. In an effort to to provide aid to those businesses in the City that maintain outdoor seating areas, the City wishes to waive the outdoor seating fees for both existing establishments with approved outdoor seating applications as well as establishments with new outdoor seating applications for a predetermined amount of time.
