An Ordinance amending the City of South Miami Code of Ordinances, Chapter
8A, Section 8A-4.1. titled "Prohibited commission actions" to allow the Mayor
or Mayor's designee to issue proclamations without the need for approval by
written resolution.
WHEREAS, it is traditional for mayors to issue proclamations without the need for
approval of the governing body; and
WHEREAS, the City desires to amend Section 8A-4.1., of the Code of Ordinances to
allow the Mayor or the Mayor's designee to issue proclamations without the need for approval of
the Commission by written resolution.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. Chapter 8A Titled "CODE OF ETHICS", Section 8A-4.1. titled "Prohibited
commission actions", of the Code of Ordinances, City of South Miami, Florida, is hereby amended
and shall read as follows:
Sec. 8A-4.1. - Prohibited commission actions.
1. Every person included in the terms defined in [subsection 8A-1](b)(1) "commission
members" is prohibited from acting as a representative of the commission without the
consent by written resolution of the majority of the City Commission other than for the
following instances:
a. For the purpose of presiding over ceremonial functions or civic functions as an
invited guest; or
b. Mayor or Mayor's designee may issue proclamations or keys to the Citv without
the need for a written resolution approving the proclamation, provided the
proclamation or issuance of a key is done solely on behalf of the Mayor or the
Mayor's designee. If the proclamation, or a key to the City, is to be issued on behalf
of the entire City Commission, a copy must be delivered to each member of the
City Commission electronically at least 24 hours before the proclamation is to be
issued and the proclamation will not be issued if, within said 24 hour period, a
Commission member requests that the Clerk add a resolution to the first available
City Commission meeting for approval of the proclamation
Section 2. Codification. The provisions of this ordinance shall become and be made a
part of the Code of Ordinances of the City of South Miami as amended.
Section 3. Severability. If any section, clause, sentence, or phrase of this ordinance is for
any reason held invalid or unconstitutional by a court of competent jurisdiction, this holding shall
not affect the validity of the remaining portions of this ordinance.

Section 4. Ordinances in Conflict. All ordinances or parts of ordinances and all sections
and parts of sections of ordinances in direct conflict herewith are hereby repealed.
Section 5. Effective Date. This ordinance shall become effective upon enactment.
