A Resolution of the South Miami Community Redevelopment Agency
(SMCRA) providing for termination, without cause, of the Executive Director,
authorizing certain payments to the Executive Director, and the transfer of the
Executive Director's duties to the City Manager.
WHEREAS, on June 1, 2000, Miami -Dade County entered into an Interlocal Agreement
with the City establishing a Community Redevelopment Agency (South Miami Community
Redevelopment Agency or SMCRA) in which the County delegated certain of its relevant
delegable authorities to the City, and the City subsequently delegated certain of its relevant
authorities to the SMCRA; and
WHEREAS, the authority of the current SMCRA will be at an end on May 31, 2020
pursuant to Miami Dade Resolution No. 466-05 of May 3, 2005, its scheduled termination date,
and pursuant to several actions by the South Miami City Commission not to extend the existence
of the SMCRA past its proscribed termination date; and
WHEREAS, the current Executive Director has been an exemplary director and is
expected to look for new employment subsequent to the termination of his employment on March
3, 2020; and
WHEREAS, the SMCRA desires to provide the current Executive Director severance
payments as provided in his employment Agreement for termination without cause. Additionally,
he will be able to keep and own the mobile phone he was authorized to use during his duties as
Executive Director.
WHEREAS, the SMCRA desires to have the City Manager for the City of South Miami
fulfill the duties and responsibilities of SMCRA Executive Director until its termination on May
31, 2020.
NOW, THEREFORE, BE IT RESOLVED BY THE CHAIRMAN AND MEMBERS
OF THE SOUTH MIAMI COMMUNITY REDEVELOPMENT AGENCY THAT:
Section 1. The foregoing recitals are hereby ratified and confirmed as being true and
correct and are hereby made a specific part of this Resolution upon adoption hereof.
Section 2. The employment of the Executive Director of the South Miami Community
Redevelopment Agency, Mr. Evan Fancher, is hereby terminated without cause and the City
Manager for the City of South Miami is appointed as the Executive Director for the remaining
term of the SMCRA and he shall be authorized to continue to execute any remaining functions and
actions necessary for a full and efficient transfer of the SMCRA's responsibilities, assets and
obligations to the City. Mr. Fancher shall be entitled two months' severance pay until May 3, 2020
as provided in his employment Agreement for termination without cause as well as any leave and
all paid holidays that would have accrued as of May 3, 2020, other than sick leave. The SMCRA
shall pay Mr. Fancher the value of all of his sick leave that has accrued as of March 3, 2020.

Additionally, he shall receive payment of the value of his health insurance, short-term disability
insurance, long-term disability insurance and life insurance through June 3, 2020 and he will be
able to keep and own the mobile phone that he was authorized to use during his duties as Executive
Director.
Section 3. Corrections. Conforming language or technical scrivener -type corrections
may be made by the SMCRA General Counsel, for any conforming amendments to be incorporated
into the final resolution for signature.
Section 4. Severability. If any section clause, sentence, or phrase of this resolution is for
any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall
not affect the validity of the remaining portions of this resolution.
Section 5. Effective Date. This resolution shall become effective immediately upon
adoption by the South Miami Community Redevelopment Agency.
