A Resolution of the South Miami Community Redevelopment Agency
requesting the Florida Department of Elections to amend the language on the
voter registration forms to reflect the passage of Amendment 4.
WHEREAS, 10.4% of Florida's voting age population could not vote because of
felony convictionsl; and
WHEREAS, Florida Voters passed amendment 4 by a 65-35% margin; and
WHEREAS, according to Orlando, Florida's Spectrum News 13, j the Orange
County Elections General Counsel explained that once a person fills out voter registration
paperwork, the paperwork is sent to the state, and the FDLE or other governmental
agencies runs a check on a person's criminal history, including whether all of jthe terms of
their sentence have been met. If the person is flagged as not meeting the requirements, they
are still given the opportunity to bring proof of their completed sentence; and
WHEREAS, Amendment 4 Official Sponsor Desmond Meade said that anyone
experiencing issues can contact the Florida Rights Restoration Coalition or the ACLU; and
WHEREAS, on the most current Voter Registration Form available from the
Department of Elections states in the upper left corner, "If you have been co victed of a
felony, or if a court has found you mentally incapacitated as to your right o vote, you
cannot vote until your right to vote is restored".
NOW, THEREFORE, BE IT RESOLVED BY THE CHAIRMAN AND MEMBERS
OF THE SOUTH MIAMI COMMUNITY REDEVELOPMENT AGENCY Y THAT:
Section 1. The Board of the South Miami Community Redevelopment Agency of the City
of South Miami respectfully requests that the Florida Department of Elections amend the language
on voter registration forms to reflect the passage of Amendment 4.
Section 2. An electronic copy of this resolution shall be sent to every elected official in
Miami Dade County and to the Florida Department of Elections.
Section 3. Severability. If any section clause, sentence, or phrase of this resolution is for
any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall
not affect the validity of the remaining portions of this resolution.
Section 4. Effective Date. This resolution shall become effective: immediately upon
adoption by vote of the Agency.
