A resolution authorizing the City of South Miami Community
Redevelopment Agency (SMCRA) to negotiate and enter into an
agreement with Biscayne Engineering to survey and replat certain
parcels (09-4025-000-0850, 09-4025-000-0852, 09-4025-065-0090) and
remove plat restrictions, and authorizing expenditures of up to $30,000.
WHEREAS, Florida Statute 163.345 states "Any county or municipality, to the
greatest extent it determines to be feasible in carrying out the provisions of this part, shall
afford maximum opportunity, consistent with the sound needs of the county or
municipality as a whole, to the rehabilitation or redevelopment of the community
redevelopment area by private enterprise;" and
WHEREAS, in 2008 and 2010 respectively, CRA Resolutions 49-08-361 and 09-10-
423 authorized the purchase of the Marshall Williamson properties for the purpose of
constructing multi -family affordable housing; and
WHEREAS, a plat restriction was discovered on the Marshall Williamson properties
commonly referred to as the Mango Lots; and
WHEREAS, the plat restriction stipulates that the lot cannot be built upon; and
WHEREAS, the only way to remove the plat restriction is to get the lots re -platted
without the restriction which requires approvals by the City Commission and the Plat
Committee of the County by both entities twice; and
WHEREAS, the Agency approved $35,000 to complete the removal of the plat
restriction through the budget process and has received four quotes to complete the
work, with the lowest bidder being Biscayne Engineering at $19,910.00; and
WHEREAS, 20-4.2 of the City Code requires an opinion of title and the Agency will
need to pay City and County fees which cannot be determined at this time; and
WHEREAS, removing the plat restriction will allow the Agency to proceed with
soliciting proposals from qualified developers to own or hold a long-term lease on the
property for the purpose of constructing affordable townhouses on the property; and
WHEREAS, the current zoning allows up to 8.7 dwelling units per acre and the
agency has been in discussions with City staff and residents about building at least 12
units on the property; and
WHEREAS, the SMCRA Board has shown a willingness to move aggressively
towards expanding the pool of affordable housing.
NOW THEREFORE BE IT RESOLVED BY THE COMMUNITY REDEVELOPMENT
AGENCY OF THE CITY OF SOUTH MIAMI, FLORIDA THAT:
Section 1. The South Miami Community Redevelopment Agency authorizes the
SMCRA Executive Director to negotiate and enter into an agreement with Biscayne
Resolution CRA No. 14-19-1102
Engineering to re -plat the land commonly referred to as the Marshall Williamson Lots, or
the Mango Lots (09-4025-000-0850, 09-4025-000-0852, 09-4025-065-0090) into one folio
, except that a separate plat and folio shall be designated for the Northeast corner of the
property immediately North of the Marshall Williamson homestead, and remove the plat
restrictions; and authorizing an expenditure of up to $30,000 charged to Account No. 610-
1110-554-34-60 (Redevelopment Services & Land Acquisition, Mango Lot Re -platting).
Section 2. This resolution shall take effect immediately upon adoption.

BACKGROUND: The SMCRA Board has expressed a desire to move quickly on selecting a
developer to build townhomes at the Marshall Williamson properties that
are currently owned by the SMCRA, commonly referred to as the Mango
Lots.
While pursuing the development of the properties, staff discovered a plat
restriction from 1975, when the property was platted, that prevented a
small tract of land from being used as a building site. The SMCRA attorney
provided staff with the definition of a building site (taken from the county
code) which indicates that we would be unable to design our way out of
this problem.
Staff met with the county's platting director who laid out a process for
removing the restriction. It was determined that this would also be a good
opportunity to combine the three folios in question into one (thus avoiding
a need to execute a unity of title). The process by which to remove the
restriction and combine the plats is as follows:
• The CRA hires a surveyor with an expertise in re -platting with
instructions to replat without the language and combine all three
current plats into one plat
• The new plat goes to the city commission for approval
• The new plat goes to the county's plat committee for tentative
approval
• The new plat is again heard before the city commission for approval
• The new plat goes back to the County's plat committee for final
approval and recording

Following this information, staff created a scope and solicited proposals
from qualified survey and engineering firms. The lowest bidder, Biscayne
Engineering, responded with a bid of $19,910. In addition, staff was

impressed that they raised the issue of opinion of title which was not
included in the original scope. After the issue was raised, staff re -visited all
other proposers and inquired with them as to opinion of title work, they
each had not factored it into their submittal.
This resolution would authorize the SMCRA Director to negotiate and enter
into an agreement with Biscayne Engineering to achieve the desired effect
of removing the restriction and combining the folios. In addition, Biscayne
Engineering will handle the opinion of title issue. The resolution would also
allow for the relevant City and County fees to be paid without having to
come back to the SMCRA Board to authorize each expense.
Up to $30,000 will be taken from the Redevelopment Services and Land
Acquisition Account with the designated line item for the Mango Lot Re -
platting 610-1110-554-34-60.

$5,975 — TENTATIVE PLAT
We will perform the necessary surveying fieldwork to prepare a Tentative Plat drawing pursuant to the
requirements Chapter 177 and 472 of the Florida Statutes and Chapter 28 of the Code of Miami -Dade
County. The Client must provide an Opinion of Title or other evidence of title such as an Owner's Policy or
Title Commitment with copies of all special exception documents, which covers the subject property. As
per the client's request, we will provide a boundary T-Plat showing improvements only within the first 25
feet and no improvements will be shown throughout the rest of the site. Upon completion of the fieldwork,
we will prepare the Tentative Plat drawing for submittal to the City of South Miami and Miami -Dade
County. All tentative plats must be approved by the City of South Miami and Miami -Dade County. Miami -
Dade County approvals are issued for a period of 9 months. Additionally, one-year concurrency
reservations are maintained for the subject property if the tentative plat is kept active. The client shall be
solely responsible for maintaining the tentative plat approval active and valid concurrency reservations for
the subject property.
$7,750 — FINAL PLAT
We shall prepare a Final Plat for filing, approval and recording from the approved Tentative Plat pursuant
to the most current requirements of Chapter 177 of the Florida Statutes and Chapter 28 of the Code of
Miami -Dade County. The Client must provide an updated Opinion of Title with copies of all special
exception documents to prepare the Final Plat. The Client shall be responsible for the processing of all
Final Plat requirements, coordinating with his other professionals and obtaining approvals from any
government agencies and public utilities, as may be required, for approval of the Final Plat by the City of
Miami Gardens Council and Miami -Dade County Board of County Commissioners.
$9,500 — PLATTING PROCESSING FEE
As required by Chapter 177 of the Florida Statutes and Chapter 28 of the code of Metropolitan Miami -Dade
County, we are required to set in the property all P.R.M., and P.C.P. as shown on the Final Plat of the subject
property prior to the recording of the said Final Plat. Upon approval of the subject Final Plat by the Board of
County Commissioners, we shall undertake the necessary survey fieldwork to mark and set the P.R.M.'s as
required. Lot comers are required to be set, and a bond will be collected by Dade County to assure the
completion of this requirement.

Included — FINAL PLAT MODIFICATIONS
We shall prepare modifications to the Final Plat Mylar drawings after the final review Miami -Dade County

acknowledgements, plat restrictions, etc.
NOTE: There shall be NO ADDITIONAL WORK PERFORMED by this firm WITHOUT written approval from your
firm.

Processing expense, items noted with IS) denotes surveying services.
• Any and all processing fees to any governmental agency are to be paid by developer and/or owner. Fees
shown above are approximate and will be verified prior to submittals.

• Fees listed above DO NOT include any Plat related processing, Engineering Services nor any preparation of
any applications and/or exhibits for any Public Hearings that might be invoked by the County. These fees will

The above costs represent a typical scenario and may be increased by problems encountered in the field. Our
consulting services will include the addressing of field problems as they are encountered, to obtain the most cost
effective solutions and said problems shall be discussed with client before commencing additional work.
Royal Point Land Surveyors, Inc. will invoice in accordance with the Payment Schedule stated on the above page
and professional fees. Unless stated the terms are 30 days. It is understood that this agreement is between Royal
Point Land Surveyors and the addressee and payment is not contingent on payment from a third party unless other
written agreements or guarantees are agreed to by both parties and attached hereto.
If Royal Point Land Surveyors, Inc. incurs any expense, including but not limited to, attorney's fees and court costs,
in connection with actions or proceedings brought or joined by Royal Point Land Surveyors, Inc. to enforce any
provision, duty or obligation of the addressee shall compensate Royal Point Land Surveyors, Inc for: attorneys
fees, damages, losses, costs or expenses of enforcement.
No waiver shall be construed as a modification or amendment to these payment terms unless expressly stated in
writing by Royal Point Land Surveyors, Inc.

A. Locate sufficient property corners and centerline control so that a determination can be made
as to the location, on the ground, of proposed Permanent Reference Monuments (P.R.M.$).
Said monuments will later be set as part of the Final Plat process, as required by City of South
Miami and Miami -Dade County Platting regulations, as well as the Statutes of the State of
Florida.
B. Tree Survey
Locate all trees on -site and within the public right-of-way adjoining the subject
property (See Attachment "A"). Said trees will then be identified as to size,
height, common name and scientific name to the best of our knowledge. For
clusters or tree lines, only the outside perimeter will be located.
NOTE:
• If a tree table certified by a licensed Arborist or Landscape Architect is
required by City of South Miami or Miami -Dade County, Biscayne
Engineering may contact a licensed Arbodst or Landscape Architect on
your behalf for a separate cost.
C. T000araohic Survev (Horizontal) tasks
• Update the visible above ground improvements (buildings, structures, asphalt,
sidewalks, visible above ground utilities, tree locations, etc. within the subject
property.
• Update the visible, above ground appurtenances to underground utilities
(manholes, catch basins, hydrants, utility poles, etc.) within the limits of subject
property.
D. Topographic Survey (Vertical) Tasks:
• Obtain the finished floor elevation of buildings wthin the limits of the subject

• Obtain ground elevations on a 50 foot (+/-) grid, within the subject property, and
• within the adjoining right-of-way to the centerline of adjacent roads.
• Obtain rim and invert (bottom) elevations of all sanitary sewer and storm sewer
structures within the subject property, and within the adjoining right-of-way to the
centerline of adjacent roads.
Task 2: Tentative Plat
Prepare one (1) Tentative Plat of the site to be platted, for submittal to City of South Miami and
Miami -Dade County for Platting review and approval. Tentative Plat will comply with the
requirements of City of South Miami Code,,Chapter 20 and Miami -Dade County Code, Chapter 28.
Task 3: Final Plat
Prepare one (1) Final Plat for submittal to the City of South Miami and Miami -Dade County. Plat
will comply with the City of South Miami, Chapter 20; and Chapter 28 of the Miami -Dade County
Code; as well as Chapter 177, Florida Statutes. This task includes field work for the setting of
Permanent Reference Monuments (P.R.M.'s); the setting of Permanent Control Points (P.C.P.'s);
as well as the State Plane Coordinate Form required by Miami -Dade County. The Certified Corner
Record (C.C.R.) will be submitted, if required.
• Final -Plat Mylar must be signed by all owners, dedicators, and mortgage holders. BE
may assist with the coordination to obtain all the necessary signatures and
acknowledgements.
Task 4: Materials
BE will provide all copy materials required by the City of South Miami and Miami -Dade County in
accordance with our Standard Hourly Rate Schedule. Client should expect the following costs for
reproduction (at a minimum):
• Per Platting project: 20 sets of Tentative Plat (each set may consist of multiple
sheets)
• Per Platting project:10 sets of Final Plat (each set may consist of multiple sheets)
• Per Platting project:1 set of Mylars of Final Plat (the set may consist of multiple
sheets)
All delivery costs associated to this proposal will be charged under Task 4: Materials. The
purchase of extra materials (nails, washer, paint, etc.) is covered under this task as well.
NOTE:
• If re -submittals are required due to expirations of the application or changes to the
Plat brought forth by the client, additional sets will be needed, which will incur
additional reproduction costs.
Task 5: Coordination
Expediting, coordinating and collecting all necessary documentation with the County and City
departments, applicants, project attorney, and utility companies. This includes the filling out of Plat -
Applications, reasonable team coordination meetings, and required plat -committee -meetings. Also
includes any unforeseen meetings with any additional agencies/reviewers/legal-representatives
that may require a review of the herein described Platting work, leading to the ultimate approval of
the herein described Platting project by the regulatory agencies.
This task includes the procurement of the "No Objection Letters" to the Platting process. Said
letters need to be secured from: FP&L, AT&T, TECO Gas, Comcast, Sprint/Nextel, Hotwire and
FDOT (if applicable). As well, letters need to be secured from the following Miami -Dade County

Agencies: Public Schools, Transit Authority, Health Department, Water and Sewage Department,
and Department of Regulatory and Economic Resources.

SPECIFIC CONDITIONS:
This proposal excludes any items not listed in Section 1 (Scope of Services). The following Items are
specifically excluded and are the responsibility of the client or client's attomey (BE will provide assistance,
as necessary, as part of Task 6, Coordination):
• County and Municipal review fees.
• Concurrency payments to the review -agencies, and the processing thereof.
• Taxes, impact fees, concurrency fees, recording fees, governmental processing fees,
governmental application fees, attorney's fees or fees charged by utility companies, if any.
• Resolving County Punch List Items that are not Survey related. (Planning and Zoning services,
• Cash Bonds.
• Matters dealing with Non -conforming and encroaching structures, etc.
• The following Engineering tasks are not a part of this proposal. However BE's Civil
Engineering Department will be able to provide a separate proposal for:
➢ Traffic Engineering Services
➢ Demolition Plans for'utility or non -conforming structure removals, if any.
➢ Design Plans for subdivision improvements required by local govemment(s).
➢ Environmental plans and/or Permits, Bond Estimates, Cash Bonds.
➢ The City and County may require engineering drawings, detailing the removal of the
existing "connection" across proposed tract lines within the proposed Plats.
Sketches and descriptions for peripheral matters, such as easement dedications that may be
required by the review agencies, if applicable. (BE will provide proposals for the separate
items as needed.)
Out of pocket expenses such as, additional printing for client use, computer diskettes, CD-
ROM discs, etc. In the event that the client requests services beyond the scope of this
proposal, they shall be performed in accordance with BE's current standard hourly rate sheet.
During the Platting process, the review -agencies may require Updates of the Boundary
Survey/Tentative Plat. Said updates are not part of this proposal.
Underground Utilities
Biscayne Engineering will show the underground utilities (such as water and sewer) in the
right-of-way through as-builts provided by Miami -Dade County Water and Sewer Department
(WASD). The extensive mapping of underground utilities (such as electrical lines, gas lines,
etc.) in the right-of-way and/or inside the property is not a standard requirement for platting, by
the regulatory agencies. In the event that underground utility is required by the City or County,
we will contact a professional underground utility company as a separate cost, to locate the
underground utility markings on -site and within the public right-of-way adjoining the subject
property.
NOTE:
The Liability to Biscayne Engineering Company, Inc. for all work performed shall be limited under any and
all circumstances to a dollar amount equal to the actual cost of the professional services provided. If
additional coverage is required, the client must inform Biscayne Engineering Company, Inc. in writing prior
to the commencement of any work.

in writing by Delta Mapping and Surveying, Inc. Should at any time during the project
the Client find it necessary to discontinue the services described above, or if the parties
mutually decide to terminate this contract, the Client will compensate Delta Mapping and
Surveying, Inc. on a hourly basis for the percentage of work completed plus reimbursable
expenses. Lump sum fees and fixed for a period of three months from the date of this
proposal. If the work has not been initiated within this three month -period, Delta
Mapping and Surveying, Inc. reserves the right to terminate or renegotiate this proposal.
By acceptance of this proposal the signing person represents and warrants to the

Dear Mr. Fancher.
Based on the City of South Miami Community Redevelopment Agency Public Meeting held on June 10, 2019, it is our
understanding the City will pursue a re -plat with two purposes. One purpose is to create two separate tracts. One
tract will be created from a portion of the parcel identified as 09-4025-000-0850 by Miami -Dade Countys Property
Appraiser Websile. In accordance with the City, said portion will be used for a pads. The remaining portions of parcel
094025400.0850 along with parcels 09-4025-000-0852 and 094025-065.OD90 will form another tract. The City is to
provide the tract configurations and their desired tract sizes. Another purpose of this re -plat will be the removal of the
plat restriction TRACTS 'K' AND °L" AS SHOWN ON THE ATTACHED PLAT ARE NOT TO BE USED AS
BUILDING SITES' far Tract K of "UNIVERSITY GARDENS SUBDIVISION NO.4", as recorded in Plat Book 103 Page
47 Public Records of Miami -Dade County, Florida (parcel 091402M65.0090).
In response to your recent request for platting services on the above -mentioned property, please accept the following
proposal for your review and consideration.
I. Scope of Services:
Task 1: Boundary Survey of the subleet property (see Attachment "A")
Biscayne Engineering will prepare a Boundary Survey in 24°x36' format and include the following
tasks:
A. Locate sufficient property corners and centerline control so that a determination can be made
as to the location, on the ground, of proposed Permanent Reference Monuments (P.R.M.$).
Said monuments will later be set as pad of the Final Plat process, as required by City of South
Miami and Miami -Dade County Platting regulations, as well as the Statutes of the State of
Florida.
B. Tree Survey
• Locate all trees on -site and within the public right-of-way adjoining the subject
property (See Attachment "A'). Tree Matrix, previously prepared by City of South
Miami's Certified Arborist will be incorporated into Biscayne Engineering's
survey. City to provide said matrix, which includes canopy measurements,
height, diameter, scientific name, etc. Biscayne Engineering will not prepare a
Tree Matrix. It is not included in this proposal.
C. Topographic Survey (Horizontal) tasks
• Update the visible above ground improvements (buildings, structures, asphalt,
sidewalks, visible above ground utilities, tree locations, etc, within the subject
property.
• Update the visible, above ground appurtenances to underground utilities

D. Tomraphic Survey (Vertical) Tasks:
• Obtain the finished floor elevation of buildings within the limits of the subject
property.
• Obtain ground elevations on a 50 foot (+1-) grid, within the subject property, and

Miami -Dade County for Platting review and approval. Tentative Plat will comply with the
requirements of City of South Miami Code, Chapter 20 and Miami -Dade County Code, Chapter 28.
All Opinion of Title and subsequent signed and notarized originals required for the
Tentative Plat process will be provided by the City of South Miami. These items are
not included in this proposal.
Task 3: Final Plat
Prepare one (1) Final Plat for submittal to the City of South Miami and Miami -Dade County. Plat
will comply with the City of South Miami, Chapter 20; and Chapter 28 of the Miami -Dade County
Code; as well as Chapter 177, Florida Statutes. This task includes field worts for the setting of
Permanent Reference Monuments (P.R.M.'s); the setting of Permanent Control Points (P.C.P.'s);
as well as the State Plane Coordinate Form required by Miami -Dade County. The Certified Corner
Record (C.C.R.) will be submitted, if required.
All Opinion of Title and subsequent signed and notarized originals required for the
Final Plat process will be provided by the City of South Miami. These items are not
included in this proposal.
Final Plat Mylar must be signed by all owners, dedicators, and mortgage holders. BE
may assist with the coordination to obtain all the necessary signatures and
acknowledgements.
Task 4: Materials
BE will provide all copy materials required by the City of South Miami and Miami -Dade County in
accordance with our Standard Hourly Rate Schedule. Client should expect the following costs for
reproduction (at a minimum):
Per Platting project: 20 sets of Tentative Plat (each set may consist of multiple
sheets)
Per Platting project: 10 sets of Final Plat (each set may consist of multiple sheets)
Per Platting project:1 set of Mylars of Final Plat (the set may consist of multiple
sheets)
All delivery costs associated to this proposal will be charged under Task 4: Materials. The
purchase of extra materials (nails, washer, paint, etc.) is covered under this task as well.
NOTE:
If re -submittals are required due to expirations of the application or changes to the
Plat brought forth by the client, additional sets will be needed, which will incur
additional reproduction costs.

Task 5: Coordination
Expediting, coordinating and collecting all necessary documentation with the County and City
departments, applicants, project attorney, and utility companies. This includes the filling out of Plat -
Applications, reasonable team coordination meetings, and required plat -committee -meetings. Also
includes any unforeseen meetings with any additional agencieslreviewersAegal-representatives
that may require a review of the herein described Platting work, leading to the ultimate approval of
the herein described Platting project by the regulatory agencies.
This task includes the procurement of the "No Objection Letters" to the Platting process. Said
letters need to be secured from: FP&L, AT&T, TECO Gas, Comcast, Sprint/Nextel, Hotwire and
FDOT (if applicable). As well, letters need to be secured from the following Miami -Dade County
Agencies: Public Schools, Transit Authority, Health Department, Water and Sewage Department,
and Department of Regulatory and Economic Resources.
NOTE:
This work will be performed on an hourly basis, using BFs 2018 Standard Hourly Rate
Schedule (See Attached), not to exceed 3 000.00.
Task 6: Update Boundary Survey of the subiect property
Biscayne Engineering will update the Boundary Survey outlined in Task 1 Boundary Survey in
24"x36" format to demonstrate the property after the re -platting process as requested by client.

If Client decides to discontinue the platting process before the Final Plat is recorded, Client will be
billed for all work performed and expenses incurred to the date that BE receives written notice to
stop said process.

SPECIFIC CONDITIONS:
This proposal excludes any items not listed in Section 1 (Scope of Services). The following Items are
specifically excluded and are the responsibility of the client or client's attorney (BE will provide assistance,
as necessary, as part of Task 6, Coordination):
• County and Municipal review fees.
• Concurrency payments to the review -agencies, and the processing thereof.
• Taxes, impact fees, concurrency fees, recording fees, governmental processing fees,
governmental application fees, attorney's fees or fees charged by utility companies, if any.
• Resolving County Punch List Items that are not Survey related. (Planning and Zoning services,
• Cash Bonds.
• Matters dealing with Non -conforming and encroaching structures, etc.
• The following Engineering tasks are not a part of this proposal. However BE's Civil
Engineering Department will be able to provide a separate proposal for:
Traffic Engineering Services
➢ Demolition Plans for utility or non-oonforming structure removals, if any.
➢ Design Plans for subdivision improvements required by local govemment(s).
Environmental plans and/or Permits, Bond Estimates, Cash Bonds,

Sketches and descriptions for peripheral matters, such as easement dedications that may be
required by the review agencies, if applicable. (BE will provide proposals for the separate
items as needed.)
Out of pocket expenses such as, additional printing for client use, computer diskettes, CD-
ROM discs, etc. In the event that the client requests services beyond the scope of this
proposal, they shall be performed in accordance with BE's current standard hourly rate sheet.
During the Platting process, the review -agencies may require Updates of the Boundary
Survey/Tentative Plat. Said updates are not part of this proposal.
Underground Utilities
Biscayne Engineering will show the underground utilities (such as water and sewer) in the
right-of-way through as-builts provided by Miami -Dade County Water and Sewer Department
(WASD). The extensive mapping of underground utilities (such as electrical lines, gas lines,
etc.) in the right-of-way and/or inside the property is not a standard requirement for platting, by
the regulatory agencies. In the event that underground utility is required by the City or County,
we will contact a professional underground utility company as a separate cost, to locate the
underground utility markings on -site and within the public right-of-way adjoining the subject
property.
NOTE.
The Liability to Biscayne Engineering Company, Inc. for all work performed shall be limited under any and
all circumstances to a dollar amount equal to the actual cost of the professional services provided. if
additional coverage is required, the client must inform Biscayne Engineering Company, Inc. in writing prior
to the commencement of any work.
