Res No 159-19-15431RESOLUTION NO. 15 9 -1 9 -15 4 31 A Resolution approving and authorizing the City Manager to execute an Amendment to the 2018- 2021 Collective Bargaining Agreement (Lieutenants and Captains) between the Miami Dade County Police Benevolent Association ("PBA") and the City of South Miami and to the 2018-2021 Collective Bargaining Agreement (Police Officers and. Sergeants) between the Florida State Lodge Fraternal Order of Police, Inc. ("FOP") and the City of South Miami. WHEREAS, the Mayor and City Commission of the City of South Miami seek to provide the highest levels of law enforcement protection and services for the citizens, residents, businesses and visitors of the City of South Miami; and WHEREAS, the Collective Bargaining Agreements with the Miami -Dade County Police Benevolent Association (PBA), the union representing the Lieutenants and Captains of the South Miami Police Department, and the Florida State Lodge Fraternal Order of Police, Inc. (FOP), the union representing the Officers and Sergeants, of the South Miami Police Department, are an integral component of this effort; and WHEREAS, the City Administration and the PBA and FOP have successfully concluded negotiations for an amendment to the 2018-2021 Collective Bargaining Agreement, which achieves these objectives; and WHEREAS, the members of the PBA and FOP have ratified the proposed amended agreement. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: Section 1: The Mayor & City Commission approves the Amendment to the respective Collective Bargaining Agreements for 2018-2021 between the Miami -Dade County Police Benevolent Association and the City of South Miami, and the Florida State Lodge Fraternal Order of Police, Inc. and authorizes the City Manager to execute the agreements. A copy of the Agreement is attached hereto and made a part hereof by reference. Section 2. Severability. If any section clause, sentence, or phrase of this resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this resolution. ("FOP") and the City of South Miami. Background: The PBA and FOP were made aware that the minimum benefits required for Police Officers under Chapter 185 of the Florida Statutes were not being met under the South Miami Pension Plan. Chapter 185 establishes a uniform retirement system for the benefit of Police Officers, the Municipal Police Officers' Retirement Trust Fund, and sets minimum benefits and standards for the operation and funding of municipal police officers retirement trust funds and plans. The Unions requested a meeting to reopen their respective Collective Bargaining Agreements for the sole purpose of amending the Retirement Benefits Section to include two supplemental benefits afforded to them via Chapter 185. Amendment The Amendment, once approved, will be codified in Section 16-Pensions, of the City of South Miami Code of Ordinances and reads as follows: The Noormal Rretirement Ddate (the earliest date a bargaining unit employee may retire with full unreduced pension benefits) for a participant shall he ^eR is the date that the participant has completed 25 years of credited police service, regardless of age, or attainment of age fifty-five 55 sixty 69 and completion of ten 10 years of credited police service. A participant is qualified to take early retirement if the participant is at least 50 years of age and has completed 10 years of credited police service (hereinafter referred to as "Qualified Early Retirement Participant"). The Qualified Early Retirement Date under the plan is the date that a Qualified Early Retirement Participant gives to the Personnel Division, or the employee's immediate supervisor, as the employee's date of resignation from employment with the City. Retirement benefits will be actuarially reduced for any Qualified Early Retirement 2 Participant who resigns earlier than his or her Normal Retirement Date (hereinafter referred to as "Early Retirement Reduction"). The Early Retirement Reduction must take into account the participant's age on the date of resignation and the early retirement Payments. In no event shall the Early Retirement Reduction exceed an average of 3 percent per year for the period of time between the Qualified Early Retirement Date and the Normal Retirement Date. The above benefits will be paid using the Chapter 185 Funds. Furthermore, the Chapter 185 Fund has a reserve for unused State funds of $379,052 as of September 30, 2018. The Union agrees to pay this amount, from the reserve for unused State funds, to the City of South Miami Police Officers' Retirement Plan, at a minimum, immediately upon execution of the Ordinance establishing the two above new police pension benefits, with the main intention of reducing the annual required contribution amount from the Chapter 185 Fund to the City of South Miami Police Officers' Retirement Plan. Financial Impact The requested Amendment is at no -cost to the City.
