A Resolution instructing the City Attorney to draft a ballot question for the
Tuesday, February 11, 2020, City General Elections, to amend the City
Charter, Article IV, SECTION 4, Subsection E relating to Audits, to increase
the maximum term of the contract between the City and the City Auditor.
WHEREAS, currently the City Charter requires that the term of the City Auditor's contract
is limited to three (3) years; and
WHEREAS, it has been the experience of the City's Finance Department and the City
Manager that a three (3) year term for a City auditor's contract is too short a period of time due to
the lengthy process of finding qualified auditors interested in performing City audits including the
creation of a Request for Qualifications, the creation of an auditor selection committee, the vetting
of the potential auditors, and the negotiating of the auditor's contract. In addition, there is a greater
chance that the overall contract price will be lower; and
WHEREAS, the City Commission desires to have a ballot question submitted to the City's
electorate to amend the City Charter, Article IV, SECTION 4, subsection E, to determine whether
a majority of the electorate desires to increase the maximum term of the City Auditor's contract
from three (3) years to six (6) years.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. The City Attorney is hereby instructed to draft a ballot question for the
February 11, 2020, City General Election asking the City's electorate whether they approve of an
amendment to the City Charter, Article IV, SECTION 4, subsection E, to increase the maximum
term of the contract between the City and the City Auditor from three (3) years to six (6) years.
Section 2. Severability. If any section clause, sentence, or phrase of this resolution is
for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding
shall not affect the validity of the remaining portions of this resolution.
Section 3. Effective Date: This resolution shall become effective immediately upon
adoption by vote of the City Commission.
