Res No 133-19-15405RESOLUTION NO.: 133-19-15405 A Resolution authorizing the City Manager to expend an amount not to exceed $770,000, for Miami Dade County to cover solid waste disposal payments for disposal of solid waste. WHEREAS, the City entered into a 10-year Franchise agreement with Miami -Dade County on January 12, 2015 for collection and disposal of solid waste in accordance with Article IV, Section 41) of the City Charter; and WHEREAS, the County solid waste disposal facility charges a disposal fee of $63.38 per ton, and a transfer fee of $13.85 per ton through September 30, 2020; and WHEREAS, the City forecasts the expenditure of up to $770,000 to Miami Dade County for the procurement of solid waste disposal services for the fiscal year 2019/2020; and WHEREAS, the expenditure shall be charged to the Public Works Solid Waste Account, No. 001.1720.534.4340 which has an account balance of $770,000 before this request. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT: Section 1. The City Manager is authorized to expend an amount not to exceed $770,000 for Miami Dade County to cover the disposal invoicing for usage of Miami Dade County Facilities for disposal of solid waste for the fiscal year 2019/2020. Section 2: Severability. If any section clause, sentence, or phrase of this resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this resolution. Section 3. Effective Date: This resolution shall be effective immediately upon the time of its adoption. PASSED AND ADOPTED this 15T" day of October, 2019. BACKGROUND: The City Charter requires that all contracts for goods and services in excess of $5000 shall be approved by the City Commission. The City forecast the expenditure up to $770,000 to Miami Dade County Solid Waste Management for the use of disposal of solid waste through the utilization of the County Resource Recovery facility. The agreement provides continued use by the City of the County Solid Waste Management System to satisfy concurrency requirements of the Local Government Comprehensive Planning and Land Development Regulation Act only as it applies to Solid Waste Disposal capacity for the Solid Waste which the City collects for disposal and which Is committed to the County for disposal In the County Solid Waste Management System in accordance with the Agreement. The disposal fee shall be $63.38 per ton delivered to a County Resources Recovery facility for fiscal year 2019-2020 and a transfer fee of $13.85 per ton delivered to the County Solid Waste Management System transfer facility for fiscal year 2019-2020. Pursuant to the Waste Disposal Inter -Local Agreement, I would like to take this opportunity to inform you of the changes to the contract disposal fee and the transfer fee for the 2019-20 Fiscal Year. On September 19, 2019, the Board of County Commissioners approved an increase, by the Bureau of Labor Statistics Consumer Price Index (CPI) of 1.13 percent, to the contract disposal fee from $62.67 to $63.38 and transfer fee from $13.69 to $13.85.
