A Resolution deferring the second reading of the proposed amendments to
the Future Land Use Map of the City of South Miami's Comprehensive Plan
and the Official Zoning Map concerning the Miami Dade County property
identified by folio numbers 09-4025-063-0010 and 09-4025-063-0020.
WHEREAS, on December 3, 2019, the City Commission held the first reading of
ordinances amending the Future Land Use Map and the Official Zoning Map for the Miami -
Dade County property identified by folio numbers 09-4025-063-0010 and 09-4025-063-
0020; and
WHEREAS, the advertisement of the public hearing inadvertently omitted information
required by the Land Development Code; and
WHEREAS, staff requests the second reading of the items be deferred until the January
7, 2020 City Commission meeting; and
WHEREAS, Section 20-5.5 (E) (4) authorizes the City Commission to defer an item and
it provides that "[a] request for deferral made by the city manager, planning director, planning
board, city manager or city commission and shall not be subject to the requirements set forth
above in subsections 20-5.6(E)(1)(2)(3).
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSIONERS OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. The application of Miami -Dade County and the second reading of the
following ordinances are hereby deferred to January 7, 2020:
An Ordinance amending the Future Land Use Map (FLUM) of the City's
Comprehensive Plan; re -designating the future land use of certain parcels of land
within the City of South Miami from Multiple Family Residential (MFR) to Transit
Oriented Development District (TODD).
And
An Ordinance amending the City of South Miami Official Zoning Map to
rezone certain parcels from Low -Density Multi -Family Residential (RM-18)
to Transit Oriented Development District Mixed -use 5 (TODD MU-5)
Section 2. Severability. If any section clause, sentence, or phrase of this resolution is for
any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall
not affect the validity of the remaining portions of this resolution.
Section 3. Effective Date. This resolution shall become effective immediately upon
adoption.
