An Ordinance amending the City of South Miami Official Zoning Map to 2

WHEREAS,Miami-Dade County Public Housing and Community Development Department and 6
the South Miami Community Redevelopment Agencyhave requested an amendment to the Official Zoning 7
Map to change the designation of the properties at 5949 and 5941 SW 68th Street from Low-Density Multi-8
Family Residential (RM-18) to Transit Oriented Development District Mixed-Use (TODD MU-5); and9
WHEREAS,Miami-Dade County Public Housing and Community Development Department and 10
the South Miami Community Redevelopment Agency have contemporaneously requested an amendment 11
to the Comprehensive Plan Future Land Use Map (FLUM) from Multiple Family Residential to Transit 12
Oriented Development District; and13
WHEREAS, this amendment is consistent with the Goals, Objectives and Policies of the City’s 14
Comprehensive Plan, and is in compliance with Section 20-5.7 of the City’s Land Development Code; and15
WHEREAS, this zoning map amendment is being considered in tandem with the above mentioned 16
FLUM amendment and the proposed zoning map amendment is attached as Exhibit H to the FLUM 17
exhibits; and18
WHEREAS, the Planning Board held a public hearing on the ordinance on November 18, 201919
and voted unanimously to recommend approval. 20
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION 21
OF THE CITY OF SOUTH MIAMI, FLORIDA:22
Section 1. The foregoing recitals are hereby ratified and incorporated by reference as if fully set 23
forth herein and as the legislative intent of this Ordinance.24
Section 2. The official Zoning Map of the City of South Miami is hereby amended as shown in the 25
document titled “Exhibit H” of the FLUM amendment, all of which is attached hereto and made a part of 26
this Ordinance.27
Section 3. The City Commission incorporates by reference the supporting analysis provided in 28
“Exhibit I” of the FLUM amendment.29
Section 4. Severability. If any section, clause, sentence, or phrase of this ordinance is for any 30
reason held invalid or unconstitutional by a court of competent jurisdiction, this holding shall not affect the 31
validity of the remaining portions of this ordinance.32

Section 5. Ordinances in Conflict. All ordinances or parts of ordinances and all sections and parts 33
of sections of ordinances in direct conflict herewith are hereby repealed.34
Section 6. Effective Date. The Zoning Map amendment adopted by this Ordinance will become 35
effective with concurrent amendments to the City of South Miami Comprehensive Plan Future Land Use 36
Map (changing the designation of the parcels addressed in this Ordinance from Multiple-Family Residential 37
to Transit Oriented Development District); if these amendments to the FLUM are approved, then this 38
Ordinance will become effective on the same date as the effective date of that FLUM amendment.39

A Resolution authorizing the City Manager to enter into a 3 year agreement with NetMotion to provide soft-
ware and support for the Police Department and provide connectivity solutions for mobile ~omputer systems.
