A Resolution of the Mayor and City Commission of the City of South Miami
confirming the City Manager's Declaration of a State of Emergency due to
COVID-19/novel Coronavirus.
WHEREAS, Section 252.38(3)(a), Florida Statutes gives authority to political subdivision
(defined by the statue as including municipalities) to declare and enact a State of Local Emergency
for a period of up to seven (7) days including unlimited extensions of additional seven (7) day
periods, thereby waiving the procedures and formalities otherwise required of the political
subdivision by law; and
WHEREAS, on March 1, 2020, the Governor of Florida issued Executive Order Number
20-51 directing the State Health Officer and Surgeon General to declare a Public Health
Emergency due to the discovery of COVID-19/novel Coronavirus in Florida; and
WHEREAS, on March 9, 2020, The Governor of Florida issued Executive Order Number
20-52, declaring a State of Emergency for the State of Florida related to COVID-19/novel
Coronavirus; and
WHEREAS, COVID-19/novel Coronavirus poses a health risk to City of South Miami
residents, particularly elderly residents; and
WHEREAS, responding to the threat posed by COVID-19/novel Coronavirus may require
extraordinary and immediate actions by City of South Miami in order to protect the public health,
safe and welfare; and
WHEREAS, pursuant to its municipal home rule powers to prepare for and respond to
weather and other emergencies, the Mayor and City Commission of the City of South Miami
enacted Ordinance no. 11-93-1539, entitled "Emergency Management; and
WHEREAS, the Emergency Management ordinance provides for the City Manager or
designee to declare a public health emergency pursuant to sections 14-1 and 14-5 of the Code of
Ordinances of South Miami; and
WHEREAS, it is prudent for the City Manager to declare a public health emergency and
to organize all available City resources to prepare for, respond to and recover from all threats to
the security, safety and health of the people of South Miami.
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSIONERS OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. The foregoing recitals are hereby ratified and confirmed as being true and they
are incorporated into this resolution by reference as if set forth in full herein.

Section 2. The City Commission hereby confirms that a state of emergency is in existence
as declared by the City Manager.
Section 3. The City Manager is authorized to exercise all necessary and appropriate
extensions and powers under Chapter 14 of the City of South Miami Code of Ordinances to
accomplish emergency management during the duration of this emergency. The City Manager
shall report to the Commission at its next scheduled meeting and provide a preliminary assessment
of the danger to public health due to COVID-19/novel Coronavirus, and advise the Commission
as to all action taken in response to the emergency, the effectiveness of the emergency management
structure, the estimated cost of the response, further actions which may be required, contracts
which must be reviewed and ratified by the Commission and any emergency budget appropriations
that may be required.
Section 4. Corrections. Conforming language or technical scrivener -type corrections
may be made by the City Attorney for any conforming amendments to be incorporated into the
final resolution for signature.
Section 5. Severability. If any section clause, sentence, or phrase of this resolution is for
any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall
not affect the validity of the remaining portions of this resolution.
Section 6. Effective Date. This resolution shall become effective immediately upon
adoption.
