RESOLUTION NO.018-20-15458 A Resolution confirming and ratifying the results of the canvassing of the February 11, 2020 General and Special Election which was held for the purpose of electing a Mayor and Commissioners for Groups II and III, and one charter amendment and declaring the results of said election. WHEREAS, Article V, Section 53, of the City Charter provides that: "[a]t 8:00 P.M. on the day following any City election in the City of South Miami, the Commission shall meet in special session for the sole purpose of receiving the certified report of the Canvassing Committee and thereupon the installing officer, selected by the duly elected incoming Mayor, shall install the newly elected Mayor and Commission members after they shall have taken the prescribed oath of office. WHEREAS, the Honorable County Court Judge, Victoria Ferrer, serving as the City's Canvassing Committee Chair, and the Honorable County Court Judge Betsy Alvarez -Zane, serving as substitute member, both being appointed by the Chief Administrative judge for the Eleventh Circuit Court, in and for Miami -Dade County, Florida, pursuant to Section 102.141(1), Florida Statutes, and City Clerk, Nkenga A. Payne, serving as a Canvassing Committee member pursuant to Article V, Section 5.B. of the City Charter, have examined the election results of the General and Special Election of the City of South Miami, Florida, held on February 11, 2020, as certified by the Supervisor of Elections and have publicly record the results of the election and proceed to tabulate the absentee ballots and certify the results; and WHEREAS, the total votes cast in said election as certified by the Canvassing Committee for each candidate are as follows: MA FOR'S RACE Bruce B. Baldwin Horace G. Feliu Mark Lago Sally B. Philips Lina Sierra COMMISSIONER GROUP II Cindy Frantz Levy Kelly Josh Liebman COMMISSIONER GROUP III Bob Welsh Received 75 votes Received 495 votes Received 483 votes Received 739 votes Received 3 80 votes Received 311 votes Received 609 votes Received 1,136 votes Received 1,552 votes WHEREAS, the summary of the charter amendment question and the results of the votes cast in said election for and against the amendment as certified by the Canvassing Committee are as follows: Pagel of 3 Resolution No. 018-20-15458 To better enable the auditor to identify areas for improvement within the City's operations, and at the recommendation of the citizens comprising the Audit Committee, shall Article IV, Section 4, Subsection E of the Charter be amended to allow the City's independent auditor to serve for more than three consecutive years by increasing the maximum allowable term to six -years? Affirmative:1,144 Negative: 906 NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT; Section 1. The foregoing recitals are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof. Section 2. Dr. Sally B. Philips has been elected Mayor for a term ending February 8, 2022; Mr. Josh Liebman has been re-elected to the office of City Commissioner for Group II for a term ending February 13, 2024; Mr. Bob Welsh has been re-elected to the office of City Commissioner for Group III for a term ending February 13, 2024; and Article IV, Section 4, Subsection E of the City Charter has been amended to increase the maximum allowable term of the City's independent auditor from three to six years. Section 3. Mr. Bob Welsh, having received the greatest number of votes, as between the winner of the election for Commissioner Group II and Commissioner Group III, and in accordance with Article II, Section 2 of the City Charter, has been elected Vice Mayor for a term ending February 8, 2022. Section 4. Corrections. Conforming language or technical scrivener -type corrections may be made by the City Attorney for any conforming amendments to be incorporated into the final resolution for signature. Section 5. Severability. If any section clause, sentence, or phrase of this resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this resolution. Section 6. Effective Date. This resolution shall become effective immediately upon adoption. PASSED AND ADOPTED this 12°i day of February, 2020.
