Ord No 09-20-2363ORDINANCE NO. 09-20-2363 An Ordinance relating to the City's Schedule of Fee and Fines; amending ordinance 05-20-2359 to revise the Parking Division Schedule of Fees. WHEREAS, the Mayor and City Commission desires to adopt a revised Parking Division Schedule of Fees, allowing funding which will cover the cost of services provided and to be consistent with neighboring municipalities; and, WHEREAS, the proposed changes are set forth in the attached Schedule of Fees and Fines; and, WHEREAS, the Mayor and City Commission desire to revise the adopted Fee Schedule as presented. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, THAT: Section 1. The foregoing recitals are hereby ratified and incorporated by reference as if fully set forth herein and as the legislative intent of this Ordinance. Section 2. The Schedule of Fines and Fees, as approved in Ordinance 05-20-2359, is hereby amended to revise the Parking Division Fees as set forth in the attached "Proposed Revisions to the Parking Division Fee Schedule". Section 3. Any such fees may be waived or reduced by the Mayor and City Commission by way of resolution. Section 4. Corrections. Conforming language or technical scrivener -type corrections may be made by the City Attorney for any conforming amendments to be incorporated into the final ordinance. Section 5. Ordinances in Conflict. All ordinances or parts of ordinances and all sections and parts of sections of ordinances in direct conflict herewith are hereby repealed. Section 6. Severability. If any section, clause, sentence, or phrase of this ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, this holding shall not affect the validity of the remaining portions of this ordinance. Section 7. Effective Date. This ordinance shall become effective upon enactment. PASSED AND ENACTED this 31 day of March 2020. Background: The Mayor and City Commission desires to adopt a revised Parking Division Schedule of Fees for occasions when certain parking spaces are rented for an entire day, for instance when events occur and the roadway needs to be clear of non-event vehicles. Such a change provides funding which will cover the cost of services provided and to be consistent with neighboring municipalities. Rate Description City of South Miami City of Coral Gables City of Miami City of Miami Beach Parking Meter Rental Fee $25 $18 (Outride of Miracle Mile Area) $30 $37 (For Construction) $26 (For Special Events) Per Meter Per Day $24 (In Miracle Mile Area) $11(For Film/Production) Valet Parking Fee $25 $15 $20 $33 Per Meter Per Day The proposed Ordinance increases the amount of two parking fee categories as the income from these locations is typically substantially higher than the simple rate currently being charged for daily use. The current rate is based on one vehicle parking in one space for the entire period. The improved and recommended rate allows forthe more realistic event that several vehicles pay for and occupy a particular spot several times a day, thereby increasingthe revenue per day per parkingspace. The proposal accounts for such turnover and its probable consequential increase in revenue to the City.
