A Resolution pursuant to new ARTICLE XII Downtown SoMi District Regulations and ARTICLE V
Procedures and Applications and other applicable provisions of the City of South Miami Land
Development Code approving a request by FRIT Shops at Sunset Place Fee Owner, LLC for Site
Plan approval for a Mixed -Use Project consisting of Retail, Office, Residential and Hotel
components on The Shops at Sunset Place property as legally described herein.
WHEREAS, FRIT Shops at Sunset Place Fee Owner LLC has submitted an Application requesting
approval of a site plan in conjunction with the redevelopment of The Shops at Sunset Place located at
5701 SW 72"d Street; and,
WHEREAS, the mixed -use project consists of: 440,148 sq. ft. of shopping center -(which includes
the 4,000-seat movie theater); 32,840 sq. ft. of office; 40 dwelling units totaling 40,500 sq. ft.; 414 rental
apartments in two (2) buildings; 182-room hotel; two additional levels of parking added to the existing
parking structure; 216 additional parking spaces located underground; and, additional landscaping and
reconfigured public spaces and plazas; and,
WHEREAS, The Shops at Sunset Place site plan as proposed is consistent with the proposed new Article
XII and Sections 20-3.3(F), and 20-3.5(I) and modifications to Sections 20-3.1, 20-3.3(D), 20-3.4, 20-3.5(B and C),
20-3.6, 20-4.3, 20-4.5, 20-4.5.1, 20-5.11 and 20-6.1 of the Land Development Code of the City of South Miami.
WHEREAS, at its October 26, 2017 meeting the City of South Miami Planning Board recommended
approval with conditions of the site plan with the vote being 6-1 in favor; and,
WHEREAS, the City Commission desires to approve the The Shops at Sunset Place site plan, with
conditions.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF
SOUTH MIAMI, FLORIDA AS FOLLOWS:
Section 1. The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and
correct and are hereby made a specific part of the Resolution upon adoption hereof.
Section 2. The City of South Miami hereby approves, with conditions and voluntary proffers, the
site plan submitted in conjunction with the redevelopment of The Shops at Sunset Place located at 5701
SW 72"d Street for a Mixed -Use Project on The Shops at Sunset Place property. A copy of the site plan is
attached hereto and made a part hereof as Exhibit "A". Said conditions and proffers are enumerated
below:
General Conditions
1. The proposed development will be substantially built in accordance with the documents
submitted including: Letter of Intent; Exhibit A (10.16.2017); Project Narrative and Overview
(October 16, 2017); Design Concept Exhibits (October 16, 2017); Traffic Study (October
2017); Parking Study (October 16, 2017); and, Sunset Place Valet Operations Plan.
The "Initial Site Plan" documents include the Applicant's Design Concept Exhibits dated
October 16, 2017 (the "Design Concept Submittal") as updated by the renderings submitted

by the Applicant under cover dated April 23, 2019, consisting of five (5) sheets, and presented
by the Applicant to the City Commission during the public hearing conducted on April 23, 2019
(the "Updated Site Plan Renderings"). The Initial Site Plan approved by the City Commission
incorporates the Updated Site Plan Renderings. The changes from the Design Concept
Submittal reflected in the Updated Site Plan Renderings are listed in conditions (a) -a) below.
Defined terms appearing below in quotations are taken from the Applicant's Design Concept
Submittal.
a) A redesigned plaza space of approximately 7,500 square feet on San Remo and Red Road
that includes: (i) a reconfigured "Cafe Kiosk" (previously depicted in the Design Concept
Submittal at Sheet A-1) and (ii) a flexible outdoor performance area within the re -designed
plaza;
b) The reconfigured "Cafe Kiosk" includes: (i) a stepping fagade on its western elevation
intended to function as both seating for the outdoor performance area and as stairs; and
(ii) a green roof which may be accessible via the stepping fagade and which may contain
outdoor seating;
c) The addition of four fields of solar panels within the "Cinema Roof' area depicted on the
Design Concept Submittal at Sheet A-5 that are anticipated to generate approximately 100
kilowatts of solar power;
d) The addition of white and/or reflective cool roof treatments on: (i) the existing
"Residential Roof" "Cinema Roof' and "Retail Roof' areas depicted on the Design Concept
Submittal at Sheet A-5; and (ii) the rooftops of the new residential and hotel structures
excluding the portions of the rooftops occupied by pool amenity decks;
e) The addition of a green roof on the "Existing / Expanded Retail" structure depicted in the
Design Concept Submittal at Sheet A-1;
f) The addition of suitable shade trees and landscaping on the development's Sunset Drive
frontage in those areas occupied at present by on -street vehicular parking spaces upon the
condition that the City in fact removes said on -street vehicular parking spaces on the Sunset
Drive frontage;
g) The prohibition against the planting of palm trees along the Sunset Drive, Red Road, and
US-1 frontages;
h) The reduction in the amount of glass used on the exterior of the new residential and
hotel structures from that amount originally depicted in the Design Concept Submittal with
the amount of reduction to be confirmed at time of building permit submittal;
i) The use of materials and/or treatments on the exterior windows of the new hotel and
residential structures that are designed to reduce bird collisions; and
j) For a variety of reasons including concern over sea level rise and groundwater levels, the
Applicant has the option to remove the vehicular parking spaces depicted in the
"Underground Level" of the Design Concept Submittal at Sheet A-0. If the Applicant

exercise that option, the Applicant shall satisfy its parking requirements in the proposed
garage.
2. In addition to the above listed in Condition 1 The proposed development will be
substantially built in accordance with the plans submitted entitled "The Shops at Sunset
Place Planning Board Submittal Drawing Set 10.06.2017", consisting of 44 sheets and
prepared by
Zyscovich Architects and dated 10/6/17 and the survey that was prepared by E. R. Brownell
and Associates, Inc. and consists of three sheets dated 7/19/17; 10/26/16; and 10/26/16,
respectively.
3. All documents submitted with this application are to be made part of the record.
4. All off -site improvements required under any approvals shall be completed prior to the
first Certificate of Occupancy of Phase 2, unless such deadline is extended by the City
Manager.
5. Any improvements in the Public Right -of -Way shall be approved by the applicable agency
(FDOT, Miami -Dade County and/or City of South Miami).
6. All impact fees shall be paid by the Applicant prior to issuance of building permit.
7. The Applicant shall provide a letter acknowledging compliance with the applicable Level
of Services requirements prior to the issuance of final permit to the property. If any
concurrency approvals expire a re -review shall be required by the appropriate agency.
8. Any changes that increase densities, intensities or population shall require a new
Concurrency Analysis.
9. Applicant shall submit verification from Miami -Dade County that the proposed new
development has been reviewed and approved for all access management considerations
prior to site plan approval.
10. Flood elevations shall be reviewed and approved for consistency with FEMA
requirements and the City's National Insurance Flood Program Ordinance prior to building
permit approval.
11. The Applicant shall comply with applicable conditions and requirements by Miami -Dade
County Public Works Department, Fire Rescue Department, Department of Regulatory and
Economics Resources - DERM (DRER), Miami -Dade County Water and Sewer Department,
and FDOT.
Construction General Conditions
12. A Construction and Maintenance of Traffic (MOT) Plan shall be provided by the Applicant
to the Building and Public Works Departments for approval prior to start of construction.
Access points by construction vehicles shall be provided within the MOT. All construction

vehicles must use SW 58th Avenue, unless otherwise approved by the Building and Public
Works Department.
13. The Applicant shall provide a Construction Air Quality Management Plan to the Building
and Public Works Department prior to the start of construction and there shall be no
deviation without written consent of the City Manager.
14. A Construction, Demolition and Materials Management Plan (CDMMP) must be
submitted by the Applicant at time of building permit and there shall be no deviation
without written consent of the City Manager.
15. Construction shall only take place Monday through Friday during the hours of 8:00 a.m.
and 5:00 p.m.
Landscaping
16. The Applicant shall meet all of the minimum requirements of the City Code, Chapters 18
and 24 of the Miami -Dade County Code and specifically comply with all conditions imposed
by Miami -Dade County Department of Regulatory and Economic Resources - DERM (DRER),
if any.
17. The property shall be landscaped in accordance with the landscape plan, included with
the site plan submittal.
18. Pursuant to Sec. 20-4.5, as may be amended, the Applicant shall preserve existing trees
(including native trees) during the development of the project, wherever possible. If the
trees must be removed, the Applicant shall be required to mitigate the impact in accordance
with City requirements. If the relocated trees do not survive, the Applicant shall be required
to replace the trees in compliance with City requirements.
19. That the Applicant comply with the Miami -Dade County Landscape Code, as applicable.
Traffic
20. That the Applicant participate with the City in its efforts to obtain certain approvals from
the Florida Department of Transportation (FDOT) to permit the following traffic movement:
Left turns from Eastbound Sunset Drive to Northbound US1.
21. That the Applicant submit a 58th Avenue Traffic Assessment on an annual basis for a
period of five (5) years after completion of the Phase 2 construction.
22. That the Applicant design and propose for City Commission approval prior to the first
Certificate of Occupancy of Phase 2, unless such deadline is extended by the City Manager,
bicycle and pedestrian safety improvements along the adjacent road segments to the
development as outlined in the South Miami Intermodal Transportation Plan (SMITP) dated
January 2015. This includes the following:

Bicycle Infrastructure along Sunset Drive and 57th Avenue/Red Road
Neighborhood Greenway along SW 58th Avenue
Crosswalk Improvements at the intersection of US-1 and SW 70th Street/SW 58th
Avenue and US-1 and SW 57th Avenue/Red Road.
Reference Figure 1 Network Plan included in the adopted SMITP as a resource document for
further information about the above bulleted items.
Off -Street Parking/Lighting
23. The project shall provide the minimum required number of parking spaces for the
proposed development which is 2,369.
24. The Applicant shall install and maintain light fixtures which project the light rays directly
to the street and shall include shields which restrict projection of light rays outward to
adjacent properties and also restrict the upward projection of light rays into the night sky.
25. That the off-street parking standards within Sec. 20-4.4 remain applicable for the
proposed development.
Environmental
26. The Applicant shall meet the requirements of the Miami -Dade County Water -Use
Efficiency Standards Manual, effective January 2009, as may be amended from time to time.
27. All storm water drainage systems shall be maintained in working order at all times in
order to avoid localized flooding during and after a storm. Parking shall be prohibited on top
of any drainage inlet or drainage manhole.
Signs
28. Provide and obtain approval for the Master Signage Plan prior to submitting for building
permit approval.
Architecture
29. Substantial compliance with the approved plans including: design, materials, and color
palette.
30. The proposed development will be substantially built in accordance with the documents
submitted including: Letter of Intent; Exhibit A (10.16.2017); Project Narrative and Overview
(October 16, 2017); Design Concept Exhibits (October 16, 2017); Traffic Study (October
2017); Parking Study (October 16, 2017); and, Sunset Place Valet Operations Plan and the
plans submitted entitled "The Shops at Sunset Place Planning Board Submittal Drawing Set
10.06.201701, consisting of 44 sheets and prepared by Zyscovich Architects and dated
10/6/17 and the survey that was prepared by E. R. Brownell and Associates, Inc. and consists
of three sheets dated 7/19/17; 10/26/16; and 10/26/16, respectively.

31. The Applicant shall further be required to comply with all applicable land development
regulations.
Voluntary proffers
32. The Applicant voluntarily proffers, and the City accepts, $1 .5 million ("Mobility
Contribution") to be used by the City in the City's sole discretion for the design, engineering,
and construction of safe pedestrian passage by and between the project and the South
Miami Metrorail Station in the form of either: (1) a pedestrian bridge; or (2) grade -level
improvements to the adjacent pedestrian crosswalk system. The Applicant shall tender the
Mobility Contribution to the City when it obtains its first building permit for new
construction on the multi -family or hotel components of its phase II construction. For the
avoidance of doubt, a demolition permit does not trigger the obligations set forth in this
paragraph.
33. The Applicant voluntarily proffers, and the City accepts, $250,000 ("Placemaking
Contribution)" that the Applicant will use to retain the services of a design professional with
expertise in placemaking, public realm improvements, and streetscape design to develop a
Placemaking design guidelines (the "Manual") for Sunset Drive and the Hometown and,
relatedly to acquire public realm improvements for Sunset Drive. The Placemaking
Contribution shall be allocated as follows: (1) $100,000 shall be for development of the
Manual; and (2) $150,000 shall be for the purchase of public realm improvements, street
furniture, planters, chairs, benches, or like improvements as recommended by and
consistent with the Manual. The Applicant shall make the Manual available for the City's
used throughout the Hometown.
Section 3. Effective Date. This Ordinance shall be conditioned on the enactment of an ordinance
creating Downtown SoMi (DS) zoning district and shall become effective immediately after the enactment
and effective date of that ordinance creating the Downtown SoMi (DS) zoning district.

"Doc" Mainicri, who died
on Much 13 at age 90,
always figured his life had
been spared for a good
reason, and he made the
most of his time.
The youngest of 11 chil-
dren, Mainieri played base-
ball at West Virginia Uni-
versity. He earned master's
and doctorate degrees from
Columbia, which is how he
got his "Doc" nickname.
After college, Mainieri
was drafted into the U.S.
Army during the Korean
War. After boot camp,
roughly 700 soldiers stood
on the tarmac, waiting for
thew assignments.
Nearly all of them went
to the front lines, and most
of those men died in com-
bat. Mainieri was one of
just seven soldiers who
were instead sent to Eu-
rope, a non,combat mis-
sion.
"Dad felt God allowed
him to survive so he could
do good works for society,"
said his son, Paul Mainicri,
who is the head baseball
coach at LSU and the win-
ner of the 2009 national
championship. "That had a
major effect on him."
Mainicri eventually left
the military and was hired
by lack Neither as Dade
North's first baseball coach
in August of 1960.
Mainieri's first team went
14.8. Dade North didn't
have its own field yet, and
the Falcons practiced at a
local high school.

1964 junior College World
Series.
Mainieri went on to
coach the Falcons for 30
years, becoming the first
junior college baseball
coach to win 1,000 games.
He rammed to the Junior
College World Series four
more times over the next
decade and was named to
the NICAA Hall of Fame in
1933.
He was also elected to
the National College Base-
ball Hall of Fame in 2014.
But even though some
may dismiss Mainieri s
accomplishments As having
been achieved at "just a
junior college," Division I
coaches knew their way to
Dade North.
So did pro scouts.
Mainicri helped send 35
players to the major
leagues, including Steve
Carlton, Mike Piazza, Mick-
ey Rivers, Becky Dent and
Warren Cromarde.
"He was a big mentor, a
legend," Dent said. "He
was one of those tough
little Italian guys. if you
were on first base, you
better break up the double
play or you'd hear about it."
First baseman Randy
Bush, who played 1,219
major league games and
slugged 96 homers, is a
good example of how Mai-
nieri's keen eyes for base-
ball helped his athletes.
Bush didn't get drafted
out of high school or out of
Dade North, where he
played for Mainieri in 1977-
78. Bush may have been
discouraged ... but Mainieri
wasn't.
"Doc Mainicri changed
my life in a tangible way,"
Bush said. "He said,'You
will get a chance. These
scouts are not seeing the
improvement in you. I want
you to come play for me in
the Cape Cod League, and
you should accept the
scholarship offer to play at
the University of New Or-
leans.' "
Bush did exactly what
Mainieri asked him to do,
and — sure enough — the
Twins drafted him in the
second round in 1979.
"There have been many
times," Bush said, "that I
have reflected on what my
life would've been if not for
Doc Mainierl."
Mainieri was an original.
When he won his national
title in'64, there were no
Pon teams in Miami. The
Dolphins, Heat, Marlins
and Panthers didn't exist,
and it would be nearly two
decades before the Uni-
versity of Miami Hurricanes
would win their first nation-
al title in football.
Skip Berman, who won
five national titles at LSU
but before that was a prom-
inent assistant coach with
the Miami Hurricanes un-
der Ron Fraser, called Paul
Mainieri as soon as he got
the news on Demic.
"He said, 'Paul, your dad
was a pioneer.I learned
from him. Fraser teamed
from him. Every coach in
Miami gravitated toward
him, He was the king.'
