WHEREAS, the Planning Advisory Board of the City
of South Miami has recommended the approval of a waiver of
plat hereinafter described.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND..

Chairman Smith announced Public Hearing #78-18 was in session and asked
if there was any one present wishing to speak for this request.
Mr. William D. Ward, Attorney, representing the owner, Mr. Frank G.
Flagg, addressed the Board and explained that Mr. Flagg wished to
divide his large piece of property so as to have two approved building
sites. He stated that Mr. Flagg plans to sell the westerly section and
continue to .live on the remaining tract.
Chairman Smith asked if there was any one present wishing to speak
against granting the request of the applicant. There being none,
Chairman Smith deemed the Public Hearing closed.
In response to Board' s request for staff recommendation, Mr. Godwin
stated that the application meets all requirements of .the City and
recommends approval.
MOTION: By Mr. Michelson, seconded by Mr. Huey, to recommend
to the City Council approval of the waiver of plat as
submitted.
VOTE IN FAVOR OF MOTION: Yes - 6

Legal Description: Lot 9, DAVIS HIGHLANDS, PB 51/59.
Location: 7901 S. W.' 59 Avenue.
Chairman Smith announced Public Hearing ##78-19 was in session and asked
if there was any one present wishing to speak for the request..
Mr. Robert Marshall and Mr. Wayne Widawski addressed the Board and
explained that for the last 20 years Mr. Widawski owned a 50' tract of
land which is part of platted lot 9, but under City of South Miami
zoning Codes is not buildable. It was his intention to sell 27' off
Of the south side of his tract to Mr. Widawski, thereby .making two' .
approved building sites.
Chairman Smith asked if there was any one present wishing to speak
against the request.
Mr. Jose A. Villar, owner of the property located at 7931 S. W. 59
Avenue (Lot 8) asked if both lots when approved would meet all City
zoning codes. Mr. Godwin assured Mr. Villas that the plat as submitted
would meet all City of South Miami requirements. Mr: Villar also
showed concern about the possibility of a future home to be built
lowering his property value. After further discussion, Mr. Villar
stated that he wished the Board to consider this his formal objection.
Mr. Martin Haskell of 7910 S. W. 58 Court addressed the Board and
stated that he lives directly behind the subject property and that he
did not object to the request but asked if there would be a proper rear
setback area.
Mr. Godwin informed Mr. Haskell that when a home is built on this
property the plans will have to meet all City zoning and building codes
before a permit is granted and that the required rear setback is 251 .

Chairman Smith announced Public Hearing #78-20 was in session and asked
if there was any one present wishing to speak for this request.
Harry Rosenfeld, M. D. , owner, and Mr. Jerome Filer, Architect, addressed
the Board and explained their request. Dr. Rosenfeld stated that he has
been a practicing physician in the South Miami area for many years and
it was now his desire to contruct a new medica.l. office on his property
on Sunset Drive. Mr. Filer discussed the proposed building plans
with the Board,. explaining details of construction. .
Chairman Smith asked if there was any one present wishing to speak
against granting the request of the applicant. There being none,
Chairman Smith deemed the public hearing closed.
Discussion. wa.s had by the Board with Mr. McCoy bringing up the subject
that he liked the proposed plans but will the finished building in
fast be built like shown. Mr. Filer and Dr. Rosenfeld stated that they
plan no major changes to the plans unless City requirements call for
them.

to the City Council approval of the requested variances
subject to the building being built substantially as to
the plans shown the Board.

EXECUTIVE SESSION:
,Discussion was had by the Board about the feeling that there may be a.
lack of communication between t-�be Board .and City Council existing.
Chairman Smith stated that with the Board' s approval he would speak
to the Mayor and suggest a meeting between the Board members and the
City Council.
MOTION: By Mr. Huey, seconded by Mr. Doburn, to have Chairman
Smith speak with the Mayor on the above matter.
VOTE IN FAVOR OF MOTION: Yes - 6
MOTION CARRIED UNANIMOUSLY.
MOTION: By Mr. Michelson, seconded by Mr. Coburn, to approve
the minutes of the meeting of July 25, 1978 as read.
