Public Hearing #75-7 DADE COUNTY HUD Request Approval of Final Plat of UNIVERSITY GARDENS #4 SUBDIVISION. Legal Description: A portion of the Northwest 4 of the Northwest 4 of the Southeast 4 of Section 25, Township 54 South, Range 40 East, Dade County, Florida, being more particularly described as follows: Begin at the center of said Section 25 and run North 89 Degrees 37 minutes 45 seconds East along the North line of the Southeast 4 of said' Section 25 for 333 .21 feet; thence South O. degrees 04 minutes 42 seconds West along the West line of the East 4 of the Northwest 4 of the Northwest 4 of the Southeast 4 of said Section 25 for 216.03 feet; thence North 89 degrees 37 minutes 45 seconds East along a line parallel to the North line of the Southeast 4 of said Section 25 for 100.00 feet; thence South 0 degrees 04 .minutes 42 seconds West along a line parallel to and 100.00 feet East of the West line of the East ;f of the Northwest 4 of the Northwest 4 of the. Chairman Coburn stated the public hearing was open and asked if there was anyone present who wished to speak in, favor of this request. Mr. Aubyn L. Jones of Dade County HUD addressed the Board and stated that this subdivision had come before the Board for approval of the Tentative Plat at the meeting of April 8, 1975. At that time, the Board recommended to the City Council denial of the request of the applicant unless the depth of lots 41 , 5 and 6 be lengthened to 80 feet. Mr. Jones pointed out that these three lots have been increased to 80 feet. depth .in the Final Pla in accordance with the Board's request. He further stated that they will put a suitable buffer along 62nd Avenue and 64th Street which is the rear . of the property. There being no one -else present to speak either for or against granting the request of the applicant, Chairman Coburn deemed the public hearing closed. A. discussion was had by the Board and, upon being questioned by the Board, Mr. Jones stated that S. W. 64th Terrace goes through to S. W. 60th Court. MOTION: By Mr. Fleischer, seconded by Mr. Michelson, to recommend to the City Council approval of the Final Plat of UNIVERSITY GARDENS #4 SUBDIVISION and further recommending. that a suitably designed buffer be required along S. W. 62nd Avenue and also S. W. 64th Street for the length of the subdivision. VOTE IN FAVOR OF MOTION: Yes - (5) MOTION CARRIED. Public Hearing #75-8 DADE COUNTY HUD Request: Approval of Final Plat of UNIVERSITY GARDENS #5 SUBDIVISION. Legal Description: Block 25 CAMBRIDGE LAWNS FIRST ADDITION, PB 30/13. Location: Between S. W. 62 Street 501 ; S. W. 62 Avenue 701 ; S. W. 60 Avenue 601 . Chairman Coburn stated the public hearing was open and asked if there was anyone present who wished to speak in favor of this request. Page 2 - 6/10/75 jk Mr. Aubyn L. Jones of Dade County HUD addressed the Board and stated that a team of landscape architects had visited the site for the purpose of solving problems concerning the trees. He then read into the Minutes a. letter from Melvin J. Adams of HUD addressed to Mayor Jack Block dated June 10, 1975. This letter stated that in the process of designing streets utilities and storm drainage, in order to preserve an existing row of trees the centerline of the proposed street was relocated with a seven foot off-set from the center line of the 50' right-of-way.. After construction had begun it was discovered that the existing trees are too close to the proposed curb on the north side of the street and they will have to be removed. However, HUD will provide the money and landscape services to create a proper buffer along S. W. 62 Street. Mr. Jones stated that the trees will be replaced with the same type trees having dense foliage in order to have the same type of buffer. There being no one else .present to speak either for or against granting the request of the applicant, Chairman Coburn deemed the public hearing closed. MOTION: By Mr. Michelson, seconded by Mr. Bowman, to recommend to the City Council approval of the Final Plat of UNIVERSITY GARDENS #5 SUBDIVISION with the understanding that the trees which are to be removed will be replaced with the same type of trees to form a suitable buffer along S. W. 64th Street and 62nd Avenue which is the rear of the property. VOTE IN FAVOR OF MOTION: Yes - (5) MOTION CARRIED. EXECUTIVE SESSION: MOTION: By Mr.. Coburn, seconded by Mr. Fleischer, to excerpt and approve the portion of this meeting pertaining to Public Hearings Nos. 75-7 and 75-8. VOTE IN FAVOR OF MOTION: Yes - (5) MOTION CARRIED. Mr. Fleischer asked how the action was progressing with regard to the illegal signs in the City and Mr. Russe stated that Mr. Fisher and Mr. Holmes, the new Code Enforcement Officer, are working on them now. Schultz stating that they objected to the granting of the Home Occupational License. Mr. Pierce stated that Mr. Yappa had furnished the Board with an Affidavi bearing the signatures of 43 residents in the immediate neighborhood stating that they did not object to the granting of the request of the applicant. EXECUTIVE SESSION: In response to a request of the Planning Board for an opinion from Jim Duncan, Zoning Consultant, regarding the rezoning of the north side of S. W. 41st Street between S. W. 58th and S. W. 59th Avenues, a memorandum from Mr. Duncan dated May 27, 1975 setting out his recommendations with this regard was presented to the Board. A discussion was had by the Board. There was some confusion expressed by various members of the Board as to the proper procedures for processin this type of hearing. Lots 26, 25, 24, 23, 22, 21 and 21 are presently being used by Fidelity National Bank. However, it was pointed out that the bank does not own lots 22 and 23 which are being held in life estate. It was the opinion of the Board that only lots 1 through 4, plus 10' of lot 5 are presently owned by the bank. First, as to the validity of the expanded usage itself, and secondly, if valid, as to the appropriate method to permit expansion within the framework of proper planning and zoning procedures. First, it appears that the proposed expansion can be accommodated without having an undue adverse effect upon surrounding residential areas, but only if certain designed precautions are first required. These would include (1) the location of all structures on lots fronting . on Bird Road, (2) the prohibition of all vehicular. access. to- S.. W. 41st Street, (3) the provision of. a 15 foot intensively landscaped perimeter buffer along S. W. 41st Street, (4) the placement of extensive land- scaping throughout the entire vehicular use area, (5) the prohibition. of all lighting in vehicular use areas abutting residential areas, and (6) , the requirement of a Unity of Title between all lots (1 through 8 and 20 through 2.6) involved in. the overall site plan. The second question as to how to properly permit the above usage should be initially addressed by removing the current C-2 zoning on lots 20 through 23. This classification is totally improper as it has been appliec and could have a seriously damaging effect on not only the surrounding neighborhood, but also on the credibility and integrity of the City' s entire zoning program if left in place. Since the City does not have within its zoning code, the mechanism for permitting transitional parking areas for commercial use adjacent to residential areas, it appears that the "variance" procedure would be the most appropriate route to permit the expanded use and accomplish .the design objective enumerated previously. An outright rezoning of lots 20 through 26 would not permit the protection requirements necessary to make the expanded use compatible. It is my recommendation, therefore, to leave. all lots abutting S.. W. 41st Street zoned RS-4 and permit the vehicular use area expansion contingent upon a satisfactory site plan a.dherring to specific design requirements which ensure compatability with adjacent areas. In lieu of platting the directors of the building and zoning department and public works department may require any dedications, reser- vations, or improvements required in connection with platting under this chapter, including the posting of a performance and maintenance bond, as may be neces- sary to carry out the intent and purpose of this chapter. (3) The resubdivision of land heretofore platted is of such unusual size or shape, or is surrounded by such develop- ment or unusual conditions as may determined by the director of building and zoning department and the director of public works to justify the waiving of the requirement for recording a plat. In lieu of the recording of a plat, such conditions may be imposed as may be deemed necessary and appropriate to preserve the public interest. (Ord.
