Res No 153-18-15186RESOLUTION NO. 153-18-15186 A Resolution confirming the appointment of Officer Rodgerick Everett to serve on the Board of TrusteeslPolice Officers Retirement Trust Fund for a two-year term ending August 21, 2020. WHEREAS, the Mayor and Commission recognize the important contributions made by those who serve on the various city boards and committees, and wish to appoint a full complement to each of the active boards and committees; and WHEREAS, Officer Rodgerick Everett has been selected by a majority of the police participants as required under Chapter 16, Article III, Section 16-33(a) of the City of South Miami Code of Ordinances; and WHEREAS, the City Commission desires to confirm the appointment of Officer Rodgerick Everett to serve for a two-year term on the Board of Trustees/Police Officers Retirement Trust Fund as the representative of the participants in the Police Officers Retirement Trust Fund. Appointment shall expire August 21, 2020 or until a successor is duly appointed and qualified; and NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, THAT: Section 1. The City Commission hereby confirm the appointment of Officer Rodgerick Everett to the Board of Trustees/Police Officers Retirement Trust Fund. Section 2. The expiration date of this appointment shall be August 21, 2020 or until a successor is duly appointed and qualified. Section 3. This resolution shall take effect immediately upon adoption. TRUSTEES PRESENT: Jose Lopez, Robert Bukens, Sally Philips, Thomas Byrne, Ryan Pontier, and Roderick Everitt Mr. Pontier was sworn in by City Clerk Maria Menendez and thus able to vote with the Trustees at this time. Mr. Roderick Everitt was elected by the Police Officers to serve in place of Mr. Aguiar but since it was not approved by the City Commission, he could note vote with the Board at this time. He was allowed to sit in on the meeting at his discretion. Chairman Lopez and Trustee Bukens who are the police officers whose term is up are allowed to serve until an election is conducted for their seats. Trustee Byrne moved to approve payment of all the invoices in Warrant 135 except payment to Benefits USA for bookkeeping fees. Trustee Phillips seconded the motion and the motion passed. Attorney Herrera advised the Board that it was time for presentations from the prospective new administrators and the correct course of action was to have the representative for their current administrator step outside. Ms. Perez stepped outside of the meeting and the remaining portion of these minutes were taken by Attorney Herrera and Attorney Watkins. NEW BUSINESS: PENSION INVESTORS Andrew McGarrell appeared personally and presented the proposal of Pension Investors Corporation. He discussed the history of his firm and their existing clients, including Miami Beach Fire, Miami Fire, and Coral Gables Fire. He advised on his experience in the pension industry and his on-going training and attendance at functions with the FPPTA and NCPERS. Trustees asked about his firm's on-line capabilities. McGarrell confirmed that it could not offer an on-line platform for participants. Trustees asked about his firm's weekly fee. McGarrell stated that he would reduce the weekly fee from $400 to $300 and commit to a three-year fee guarantee. PENSION RESOURCE CENTER Scott Baur appeared personally and presented the proposal of Resource Centers. He discussed his firm's history, experience, and existing client list. He explained the firm's philosophy about being an extension of the Board of Trustees and emphasized the importance of the administrator's dual role as record keeper and participant liaison. Trustees inquired as to specifics of the fee schedule and discussed whether it could avoid Page 2 of3 6 a monthly fee for interim financial statements. There was some discussion about who is currently preparing these statements. Mr. Baur committed to a three-year fee guarantee if selected. BENEFITS, USA INC. Pete Prior appeared personally to present the proposal of Benefits USA, Inc. Mr. Prior discussed and addressed pending concerns from the trustees. He also confirmed that his firm currently handles interim financial statements. Trustee Philips moved to hire Pension Investors Corporation. Trustee Byrne seconded the motion. The trustees voted to hire Pension Investors Corporation in a 3-1 vote. Chairman Jose Lopez cast the nay vote. REPORTS a. Attorney Attorney Herrera Harrison had nothing further to report. b. ' There is hereby created a seven-member board of trustees ofthe city police officers' retirement trust fund, which board shall consist of three (3) police officers as defined herein and in F.S. § 185.02(11), who shall be elected by a majority of the police officers who are participants of the fund, appointed as a ministerial act by·the city commission and shall serve as trustee for period of two (2) years; unless he or she sooner leaves the employment of the city as a police officer, whereupon a successor shall be elected in the same manner as an original appoinbnent. Each police officer trustee may succeed himself or herself in office. Additionally the mayor and commission shall appoint three (3) residents of the city, that shall serve as trustee for a period of two (2) years, unless sooner replaced by the city commission at whose pleasure the trustee shall serve, and a seventh trustee that shall be selected by a majority of the other six (6) trustees, and appointed as a ministerial duty by the city commission. The seventh trustee shall have the same rights as each of the other six (6) trustees appointed or elected as herein prov,ided, shall serve as trustee for a period of two (2) years and may succeed himself or herself in office. The board shall anoually elect from its membership a chairman and secretary. The chairman, when present, shall preside at all meetings. The secretary shall keep complete minutes of all proceedings of the board and shall comply with requirements ofF.s. §18S.06(3). At each quarterly meeting a report detailing the assets and liabilities of the fund as of the date of such meeting'shall be presented. All elections of the board shall be by a majority vote, a quorum being present. FouT (4) or more trustees shall constitute a quorum.
