PLANNING BOARD , CITY OF SOUTH MIAMI
JUNE 28 , 1983
The meeting was called to order by Chairman Smith at 7 : 30 P . M. The
Pledge of Allegiance to the Flag of the United States of America was
followed by the roll call .

Hearing #83-8 Joseph R. Colletti
(Owner : Isilio and Loyda Melean )
Request : 1 . ) Variance to allow a screen enclosure and whirlpool with
a rear setback of 2 feet where 10 feet and 122 feet are
normally required .
2 . ) Variance to allow a lot density of 59 . 2 percent where
forty (40) percent is normally required .
Legal Description : Lot 1 , Block 1 , Gables Edge Subdivision , Plat Book
94 , Page 54 of the Public -Records of Dade County ,

Location : 5901 S . W. 56 Terrace .
Chairman Smith stated the public. hearing was open and asked if there was
anyone present caring to speak for granting the requests .
Mr. Joseph R. Colletti , Attorney, of 3550 Biscayne Blvd . , Suite #201 ,
presented the request to the Board . He stated that his clients , the owners ,
had contracted with a company to install a screen enclosure which was done
in February , 1983 and there were two companies involved in the installation
of a whirlpool and wood decking around the whirlpool and a separate
contractor additionally installed some cement decking the around the
swimming pool in the back yard of this residence . None of these contractors
ever applied to the City of South Miami for permits , variances or to meet
any type of those requirements . He stated that the owners were not aware.
of the necessity of obtaining variances or permits and relied on the
contractors to do everything that had to be done as the owners are from
South America and they live here only a part of the year . They have a
language barrier and are unaware of the laws of the City. Mr . Colletti
presented photographs of the property showing the existing structures
to the Board . He stated that none of the neighbors object to the granting
of the variances .
There being no one else caring to speak for or against the request , Chairman
Smith deemed the public hearing closed .
In response to Chairman Smith ' s question , Mr. McDowell stated that staff
recommends denial . Although staff does not feel strongly for or against
applicant ' s request for variances , the applicant does not have a hardship ,
except those costs which .would be incurred from relocating both the screen
enclosure and whirlpool spa . There is no hardship inherent in the land .
Chairman Smith commented that the owners have a cause of .action against
the contractors who did this work without obtaining the necessary variances
and permits and they could recover their losses from the contractors .
In reply to the question by Mr. Michelson regarding the ten foot easement ,
Mr. McDowell stated that if the zoning variance -were to be approved , they
Would also prior to being able to keep the structures where they are they may
have to get a release from the various utility companies that may have a
right to have access to that utility easement.
Mr. Perry asked Mr. McDowell if the owners were not subject to some kind
of a fine .. Mr. McDowell replied that they would be charged a double fee
plus a $50 . 00 fine for each permit that was not taken out . Chairman Smith
asked Mr. McDowell to furnish the Board members with a memo as to the
follow through on the enforcement of this .
MOTION : By Claire Abbott , . seconded by Edward Coburn , to recommend
to the City Commission denial of the requested variances .
VOTE ON MOTION : Yes - 4
No - 1 ( Lee Perry)
MOTION CARRIED .
Hearing #83-11 Earnestine J . Kenon
Request : Variance to allow a rear porch addition with a rear setback of
11 feet where 25 feet is normally required .
Legal Description : Lot 1 , Block 3 , University Gardens Subdivision , PB 89/15 .
Location : 5870 S. W. 62 Terrace .
Chairman Smith stated the public hearing was open and asked if there was
anyone present caring to speak for granting the request .

Earnestine J . Kenon presented her request to the Board stating her reasons
for the request . She presented photographs of the property and stated
that none of the neighbors object to the granting of the variance . Mattie
Brown of 6295 S . W. 58th Place addressed the Board stating that she lives
directly behind the applicant and spoke in favor of granting the variance .
There being no one else caring to speak for or against the request ,
Chairman Smith deemed the public hearing closed .
In response to Chairman Smith ' s .question Mr. McDowell stated that "staff
recommends denial . Applicant does not have a hardship , although corner
properties are subject to stricter side setback .requirements than interior
lots . Applicant ' s residence is situated on the rear setback line and
within several feet of either side setback line . The only possible
location for an addition without a variance would be on the western half
of the front portion of the property. This , however , may require redefining
the front entrace and , possibly , the creation of additional openings in
the front elevation . However, the applicant does not have a hardship
inherent in the land . "
Mr. Michelson commented that in this instance there is no hardship inherent
in the land and it was his feeling that the Board should be consistent in
ruling on variances .
MOTION : By Lee Perry , seconded by Edward Coburn , to recommend to
the City Commission approval of the variance .
VOTE ON MOTION : Yes - 4
No - 1 ( Bernard Michelson ) .
MOTION CARRIED .
Hearing #83-12 Dade County Housing &
Urban Development Dept .
Request : Approval of Final Plat of University Gardens Subdivision No . 5
including closing a portion of an 8 foot alley .
Legal Description : Lots 10-13 , Block 2 ,, Lots 19 & 20 , Block 4 , Franklin
Subdivision , PB 5/34.
Location : Property generally located on the Northwest corner of S . W.
59th Place and S. W. 66th Street .
Chairman Smith stated the public hearing was open and asked if there was
any one present caring to speak f.or .granting the request .
Mr. Donald F . Kirk of 1401 N . W. 7t.h Street , Miami , Florida , presented
the request to the Board explaining this is a subdivision of six single
family homes .

recommends approval . He also noted that. the Community Development Board
of which Mr. Perry is the Chairman has also recommended approval of this
plat .
